    This has nothing to do with "laws and regulations" because that shit doesn't matter when you have a trained killer with an itchy trigger finger enforcing their INDIVIDUAL assumptions of what you should and should not do upon you. You can't expect to obtain freedom by peacefully arguing, you need to FIGHT BACK!!!

  • The guy is a dick for walking up into the conversation that way, unless it was close friends or family the cop was talking to, or he was directly involved in what they were talking about. There is a big difference between "right" and "legal". Had he stayed 15-20 feet away and the cop had come to him about it, that would have totally not been on the guy with the camera. Keep your distance.

I guess I see your point also but if there was something private about the conversation the officer had other options too, like detaining the man or putting him in a car and interviewing him privately. It was rude in a way but being rude isn't an excuse to violate someones rights.

  • @EnochianBorg It's not about privacy or being rude, it's about the cop interviewing the individual knowing that you're at a safe distance in case the suspect decides to fight, or in case you are actually there to jack the cop and help the suspect escape. It's a safety issue.

  • @Mindcrime121 Yes, I agree with you. Safe Distance is always a good thing. There is a fine line between interfering and safely documenting an occurring moment. When news gathering or just recording in public I always keep a safe distance as well as interact with officers and other public workers doing their jobs to ascertain the safe buffer from any dangers. I also use common sense to determine where I should or should not be first. I think the cameraman in this video was too "in your face"

  • I agree with the premise of the video. If cops have nothing to hide they wouldn't mind being recorded but I think you were pressing your luck here.

    You walk up into a a private conversation. In many states it is illegal to voice record.

    If you want to record public officials, why not do it properly?

    Don't get in the way and make sure you are not on private property.

    You are just trying to give the cop a reason to harass you.

    As far as the cop goes, I can't believe that' he's a training officer.

I have seen many recent cases where police have tried to enact the "wire tap" law to video recorders in public and the courts have thrown them out. One of the cases even went up to a District Court, which held that public servants should expect to be recorded in the public. I'm not aware of any State that would charge someone for this - maybe I'm wrong.

  • @1775novten All party consent is required in California, Connecticut, Delaware, Florida, Illinois, Maryland, Massachusetts, Michigan, Montana, New Hampshire, Pennsylvania and Washington.

    In Illinois, Massachusetts, and Maryland it is illegal to film the police in any way and these states do prosecute.

  • @toolmkr1 Again, I believe you are referring to the wire tap law which applies to phone calls. I have heard of people being charged (not sure about convicted) for audio recording in secrecy, but if your camera is in plain view or if you announce "I'm audio and video recording" then you have met the requirements of the law. Check out Glik v Cunniffe, which was heard by the Federal Court of Appeals.

  • You don't have to be a press person (reporter) to videotape civil servants (cops) while they are performing their duties. You must however , stay out of the way and be cooperative with reasonable requests. Cops have no right to demand that you stop recording, or take your equipment from you or touch you in any way for legally recording thyem. If you hire someone to cut your grass; are you not allowed to check/record to have assurance that it is being done correctly? Exact same principle.

  • @mvallin Exactly, you can't just walk in to the middle of an investigation. But you can safely record in a public place from a safe distance and from within if you are involved or being detained for questioning. You do not have to have permission to audio record in a public place and wiretap laws do not apply since no wires are being taped. You also don't need permission to document events in a public place unless the event is otherwise closed to the public by permit itself.

The fact is that NO ONE on public space has a reasonable expectation of privacy. People might not lilt being photographed, but it IS NOT illegal.

    It goes both ways dude. He doesn't have the right to interfere with the cop doing his job, but neither does the cop have ANY right to object to being recorded. If the cop had said, 'you are interfering with a police action, please back off'', that would have been one thing, but the cop said STOP RECORDING. He can not do that. A person has every legal right to record a public servant in their duty. You will see many states upcoming codify, that it is unquestionably legal.

  • If there were REALLY something illegal with you filming the officer, he would never have returned the camera but would have taken you AND the camera to jail.   • Its mostly the videographers fault. Yes, we have the right to record, but OBVIOUSLY being annoying about it will make the officer disregard it. And if he asked you to stop at the beginning why would he be more lenient when you say "hell no, I can do what I want"? You gotta treat cops like cops. They know what their doing and instead of just saying "no" you should explain the law to them so they know that you know. It doesn't matter how they say it, or their personality. I think the people recording the police should be respectful, and if the police tell them to step back, they should, but they have every right to record their civil servents in action.   • Video taping the police is walking a very fine line. It is illegal to interfere with the police in any way. I would recomend shooting video from a distance and not inter-acting with the police at all. Of course once they notice that you are keeping record of what they are up to, you could very well become a target. After video taping a couple incedents with police I was arrested several times for a number of bogus charges, and now I'm fighting for my freedom.

  • First of all let me tell you I have known Corporal Lee for over 4 years, and he is one of the best VCU police officers I have ever met. You went up to him looking for trouble, and he handled it camly, he was trying to do his job, and you had no right to interfeer. Now what if something bad had happened while he was talking to the other guy and you were in danger I assure you that Lee would risk himself to ensure you were safe and that nobody got injured. You had no right to be there period.

    Clearly Corporal Lee seems to have been doing his job. He also seems to have responded inappropriately when a citizen lawfully observed the performance of his duty. He didn't like it? FINE.   • I believe that this officer could have arrested the recorder for interfering. The video recorder is interfering with the officer's conversation with the other party by shoving himself into the scene. Even though the recorder stated that he was not interfering, he was pressing himself into the conversation. Next time, you should stand a little farther away, and if the officer still approaches you from the distance, then the officer does not have the legal ground to seize your camera.

    All this does is reinforce their position of not allowing people to video tape and makes it much more difficult for someone who is actually taping an injustice.

    After that the cop said let me see the camera, which is illegal unless he's getting arrested.

    Since he gave the camera back and didn't make an arrest, he's liable legally.

  • Thats not true at all actually you can record anyone at any time with Video and/or Audio.

    In some states both people being Audio Recorded need to know and in some states only one of the people involved in a conversation needs to know that one person being the one recording.

    People that produce documentaries and investigative reporters do this all of the time its perfectly legal.

  • Video taping someone does not qualify as an obstructive act and you either do or should know that.

Cops need to be taught that they cannot put their hands on other people or take others' personal property by force or fear just because they are wearing a uniform and badge. When cops start losing their jobs and ending up in jail for their criminal acts they will stop abusing and start serving the people.

  • Just a note, I had seen this more and more and then less and less. Police will sometimes try to tell you that you are breaking wiretap laws by filming them. This is NOT TRUE by any means, if they are outside and you are in public there is no presumption of privacy. Of course I would not recommend trying to film them in their living rooms. This man had every right to film in public, bottom line. The police use video all the time, no reason why we shouldn't as well, Way to goNeverLET CPS IN EITHER

  • I am 16 and my high school offers a law class which I do take and we have gone over in depth each amendment and video taping only apply to the press it clearly says it and any law class that goes over this will say it so yes I do know about the constitution and its official meaning not what any citizen decides it means

  • Hi mate. There is nothing unlawful about filming the police in public. Look up the difference between legal & lawful, they are so far apart you won't believe it. Why would anyone need permission to do something that is not unlawful? Check out my vids & see how to deal with the police when they try to stop you from filming in public.

  • while it is laudable that there are people making an effort to feed our homeless population, the policeman was in his right to refuse to be recorded. the person recording this video acted very immature, could not give a reason for his recording, and did not respect the policeman while the officer was in fact doing his job. Perhaps if the volunteers were to clean up after themselves, and GET A PERMIT to use the property, the policeman wouldn't even be there. all of these slanderous comments on...

  • Obviously the feeding group was breaking the law prior to the officer stopping them or he woudn't have been talking to the feeding group in the first place. There is also a clear visible sign that says not trespassing at that structure. The structure from what I have learned is actually a field office for RPD and VCUPD and not a shelter. But let's talk about how trashed your feeding group leaves the park. The historical park. Stop seeking attention and do something else worth while!

  • If the officer pepper sprayed, beat you with an asp baton, tased you, shot you, then you would actually have a legit complaint. The officer was more then professional in his request for the camera. You did not provide any tangible form of identification to the officer during the stop. He identified who he was without a problem. You hide behind the camera and the youtube forum where you can cry foul and get other people like ErieParties to do your dirty work for you.

  • . If you want to talk about injustices then lets talk about the condition that you and your groups leave the historical Monroe Park in after your weekend feedings. The park is blanketed in trash and rotting food, which is not picked up by your group or any of the people that you help out. This leaves volunteers like me taking their time out to make sure that the park is in a better condition then your group leaves it in. Lets do an expose about that.

  • The officer asked you several times to turn off the camera. You were obstructing and lucky you didn't get a charge from it. He was just doing his job and it didn't involve you. And Monroe Park belongs to the university so it is not public property.

You should have not gotten that close to start with. I really think your commentary after the screen goes blank is blown out of proportion.
