What I find fascinating is that while the police officer is friendly and shakes your hand he does so with his left hand. His right hand is resting on his belt near his pistol. This probably goes unnoticed to the general observer, but I guess that is his training in response to seeing a person carrying a gun.

You're thinking of switzerland, and it's not entirely correct in any case, there are exceptions. Sweden has fairly draconian gun control(though not anywhere near that of say the UK), especially when it comes to handguns, and there's no provisions for carrying. A large number of hunters though, so there's a lot of long guns.

In today's world, with all the nutjobs and so-called militias who pose a threat, part of a police officer's job is to be cognizant of his surroundings. He noticed a guy taping, and investigated it. The camara man was wearing a gun, but the PO still approached. I really don't think it was his ego, I think it was his duty

This sort of questioning can constitute an arrest. Any time a person reasonably feels that they can not simply 'walk away', they are arrested. This cop needs to think about that before he walk up questioning people who are commiting no crime.

Whether he is taping 'the event' or the officer himself, that does not constitute suspicious activity and is perfectly legal. By stoping, aproaching, and questioning the person the officer is giving the impression that said person is arrested, this has been tested and held many court cases.

There is case law that supports arrests by officers that were based on the officer's "hunch". The "hunch" was based on the officer's vast experience and DID hold up for a conviction in court, as the defendent was proven to have been in the pre-stage of committing a crime. If u R falsely arrested, u can sue the arresting agency.

Sweden has the lowest crime rates on the planet, and they have a law that says they MUST have a firearm! go figure. Get rid of the gangsta monkey people, and we would have a great country.

You're thinking of switzerland, and it's not entirely correct in any case, there are exceptions. Sweden has fairly draconian gun control(though not anywhere near that of say the UK), especially when it comes to handguns, and there's no provisions for carrying. A large number of hunters though, so there's a lot of long guns.

@TheKaerius not entirely , I live in Switzerland and you must not have a gun here. the army people ( mandatory service) take their gun home. about 1/4 of the population has one or more guns , all registered and depending on your nat. you can or not get a gun as a foreigner. good laws imho.

it is so sad, that in our country, we get questioned for open carry, we as citizens are pretty good and decent people, we carry to protect ourselves and other decent people from the garbage of society today. Most cops understand that, and are pro- 2nd amendment. You get (A) holes like Obama-bin-laden and hillary and the rest of the U.S. government leaders, they want to UN-arm Americans, so they can control them easier. I didn't read all the comments, just kind of scanned through. If a guy, let alone one I don't know, videotapes me driving up the street, I will be curious as well. He didn't overstep by asking why he was filming him. He stopped to ask why, the guy told him, and all was well. No criminal activity, no unrest, no harrassment, no arrest. Now the guy can continue filming and the policeman can go and do his job. The way it ought to be.

@dewrenged difficult to do in a you tube comment, it would to prove the reverse!! I perhaps should have put emphasis on violent crime. Debate on the relationship between crime and gun ownership is contentious, however to me it is common sense that if you give people more easy access to dangerous weapons, more dangerouse circumstances will persist. For further reading on this side of the debate read Zimring; Cook; Kellermann and Reay; Duggan. (search gun crime and Zimring etc in google scholar).

How many people see other people filming every day and feel the need to have that person explain their actions? Not many, usually it's someone with an air of entitlement and a big fat ego. @salcamarano U saw a cop w/an inflated ego, I saw a down to earth, affable & professional police officer approach a man with a camara and ask him very politely why he was taping. In today's world, with all the nutjobs and so-called militias who pose a threat, part of a police officer's job is to be cognizant of his surroundings. He noticed a guy taping, and investigated it. The camara man was wearing a gun, but the PO still approached. I really don't think it was his ego, I think it was his duty

When the cop asked him why he was taping he should have simply answered "Because I choose to".
This sort of questioning can constitute an arrest. Any time a person reasonably feels that they can not simply 'walk away', they are arrested. This cop needs to think about that before he walk up questioning people who are commiting no crime.

U think it necessary to have a chip on ur shoulder when dealing w/police? The officer was a perfect gentleman and it was NOT an arrest! Look up arrest in the dictionary, the officer was having a conversation, and at no time did he detain, or give any indication of a detention of the individual. He was a polite, professional, and friendly cop.

@strictlycomments The officer does not need to say you are arrested, it can be implied by his actions and questioning. Whether he is taping 'the event' or the officer himself, that does not constitute suspicious activity and is perfectly legal. By stoping, aproaching, and questioning the person the officer is giving the impression that said person is arrested, this has been tested and held many court cases.

If a judge watched this video, I believe he would concur with my opinion on it. It's apparent the man chose to converse friendly, and that he could've left at any time. The camara man was polite and respectful. For some reason, u think he should've been baiting, challenging, and unfriendly. Why?

This cop can have all the 'friendly mutual conversation' he wishes, when he takes off the uniform and clocks out.
The guy with the camera is under no obligation to explain his action to an officer when he is in violation of no law. "because I choose to" is all the explination you need in a free society.

@Anubis78250 Ultimately it doesn't matter wut u or I see, it's what a judge or jury sees. Cops have descretion in applying what they believe to be probable cause. There is case law that supports arrests by officers that were based on the officer's "hunch". The "hunch" was based on the officer's vast experience and DID hold up for a conviction in court, as the defendent was proven to have been in the pre-stage of committing a crime. If u R falsely arrested, u can sue the arresting agency.

There have been many cases where criminals and terrorists have surveiled banks/buildings/locations/and law enforcement w/ video, for planning purposes, where they intended to commit a crime.This officer investigated what his decretion told him was suspicious and he was within a lawful right to do so. He determined that the camara man was legit, had friendly conversation, and broke off his investigation. What he did was perfectly lawful & within the scope of his duty.

To suspect that that guy with the camera is involved in terrorist activity is one hell of a leap that no judge would accept. No reasonable person would be suspiscious of the cameraman. Whether he filmed the cop driving away or not.

The cop approached the camara man bcz he was filming him. NO judge would accept?! McVey video taped the the fed building b4 he bombed it and Ramzi Yousef did the same thing before he bombed the World Trade Center in 1993. Criminals have surveiled cops and cased banks& locations prior to their crimes

However in this case because of what was going on it would be completely unreasonable for the officer to suspect anything unlawful was occuring.
That is what makes this a case of intimidation and not proper action on part of the officer.
He didn't like that he was being video taped, he did not come back and question the man because he suspected anything.

Laws for open carry or conceal carry need to be scrapped. Citizens do not need to walk around like cowboys and think that one question from a police officer is a violation of their rights.
