LoL even in a narrative that takes place in 1960's United States - we still have trouble perceiving racial discrimination, or conceding it even happened.

..the police officer evens admits that; they would rather convict him without much evidence than look stupid. Notice that Frankie's father- who the films wants to portray in a good light, is forgiving and doesn't even believe it was him.
The purpose of that storyline then is to show attitudes towards black people at that time, and to get audience to empathise with them (as it ends tragically) and also to show the good in Frankie's father's character. It's not racist, that's a very narrow view.
This part of the story is clearly a story additional to the main plot about a good honest family who are still finding it hard to integrate into 'white' society. The guy is black, he works at the school, ever see anyone talk to him? Then the 2 young kids make comments about his race (obv overheard from parents who gossip about him) He's got no friends, he stays at the school and drinks alone. Then they pull him in for the murder because it's convienient..

I don't know, I have to agree that it was an example of 1960's racism that the janitor was charged with those murders without a shred of evidence and ignoring the fact that they had convicted someone else for the crime.
