I'm glad I live in Montreal where people can still stand up to injustice in public (although the cops here are trying to change that, too). 20 hours in jail for theatrical activism? I can't believe people here are actually defending the cops' abuse of authority in this case. Fortunately the NYPD and City Hall have now payed up $23,000.00 to settle their wrongful arrest of Reverend Billy, but still, that the cops think they were justified in doing this in the first place is scary.

I hope that christian fundamentalist realize very soon that no one is trying to stop them from practicing their faith. If that were happening christian churches would be systematically shut down. That's not happening. Nor are christian schools being closed.

Now now..It's perfectly okay to speak your mind about something in America..just make sure the following doesn't get implemented: - No loud talking - No more than 3 people can hear what you have to say at any given time - No more than 4 people at your assembly - Only one person can talk using the above rules - One can only talk if they are also promoting a big corporation.

The question remains: if this Reverend Billy was violating a well-established ordinance regulating public demonstrations, why wasn't he arrested and charged pursuant to that ordinance? Why did the police have to pow-wow for several minutes in order to come up with this "harassment" charge, which is apparently typically applied to stalkers, not public protestors? And why did the prosecutor submit this legal theory to the judge? Pathetic.

That's true - the First Amendment doesn't cover incitement (strictly construed), "fighting words" (strictly construed, evidence of provocation generally admissible), defamation (strictly construed, especially with respect to the "media"), obscenity (virtually restricted to pornographic depictions of illiegal sex acts - e.g., child pornography), and some conduct which has a speech component (e.g., yelling in public).
