The deputy is an officer of the court, the judge is the chief officer of the court, the deputy works for the judge. A judge certainly can order an action form any officer of his or her court, and hold them in contempt if they refuse.

i believe the whole point is that the officer went to jail for refusing to apologize, not for breaking the law(theft). i, also, believe putting him in jail for contempt of court is bogus. if he did something illegal, then draw up a warrant and have him arrested , set bail, then have a trial with proper representation...just like the guy standing there wearing the stripes. Instead the judge bypassed due process and sentenced him, not for taking the document, but for pissing her off.

I find it absolutely hillarious that a prosecuting attorney is invoking Constitutional rights. I've never seen it it almost 7 years of practicing law. If one of my clients tried to steal a piece of paper from anyone, he would be put in jail. The prosecutor is right that a Judge cannot make people to apologize, but the alternative is if they don't apologize they accept the consequences.

The man was guilty of theft, violation of attorney-client privilege and violation of the defendant's right to due process. Everything being raised by the defense is a side issue and a red-herring. He should have gone to jail based on the three laws he broke by his initial action, regardless of whether or not he apologized and regardless of whether or not he thought he had a good reason for doing it.

If the list had your name, or someone you love on it, would that still be your stand? If he paper was in plain sight and gave probable cause to take it. I would not feel remorse either. In these cases it is hard to know who has been forced to act on the part of the Mafia, but... If it was out of open sight, the officer had no probable cause or right to invade the property of the defense. That's our law, and "all" must obey it.
