The treaty doesn't guarantee anything, it is a CHARTER so it's ASPIRATIONAL not LEGALLY BINDING

That's not actually correct, at the moment the charter is aspirational. If Lisbon is ratified the charter of fundamental human rights gains treaty status and is then legally binding.
