The ability to patton genes is a terrible thing. All you have to do is look at genetically "enhanced" agriculture. Farmers can be sued if their crop contains some of the pattoned crop, even though this modified crop occured in their field naturally. You can't control nature. You can try, but you will fail.

Indeed, it seems our patent system cant tell the difference between patenting a mouse trap and patenting the concept of killing mice. You cant patent a shiny rock you found lying on the ground, why should one be able to patent genes they only found?
sure, patent the process/method of getting insulin from those genes, but if someone else invents a way to do it better or a different use of them, they get to patent that newer, better system.
