  • tactikalguy1 i do enjoy all ur videos because there are police out there that abuse their power and act in bias. but to my understanding of the term of art "duress" is used in criminal law as an excuse, rarely a justification, at trial. and can be brought about by 1 bodily harm or death 2 the lesser of two evils . even in the situation with a contract there must be force or violence involved. ie. ur forced to rob someone bc someone threatens your kids with a gun. illegal but excusable

  • and although a reasonable person in these circumstances can use this excuse, it still stands in court that the actus reus (criminal act) and mens rea (intent), of the person claiming duress, was present at the time of the illegal act. Therefore some degree of culpable liability remains and rather than getting acquitted like in a justification defense, the sentence would be reduced. but thats just how i've learned to interpret the terms of art in my law classes.
