If something is used for COMMERCIAL purposes it's properly identified as EQUIPMENT. These laws and the difinitions change all the time. In California, you still have to have a valid drivers license and a valid registration with a tag display on the vehicle or you'll be cited. Remember the STATE must do what ever is deemed reasonable to keep it's citizen safe and keep things in order. Federal law does not trump state law unless the Fed can claim jurisdiction. So... The Federal deffinition of a "motor vehicle" only applies if you are being tried under a federal statute. Traffic tickets are never governed by federal statute however, they are handled by state, county and city statutes, codes and ordinances. My state has its own deffinition for a motor vehicle that specifically includes all personal vehicles that are not used for commercial reasons.

It's very true. I'm fighting a case on a DUI conviction and under the pretense of the constitution, a person conducting business and utilizing their vehicle for revenue generating means is only susceptible under to receive infractions on a motor way. Unless, corpus delicti is inferred in the complaint. You can speed as much as you want, drive without a license, insurance or even registration. This is written law of the land and they can not invoke the rights of their business upon you.
How does this work? U R driving without a license based on these legal theories and you get stopped. Do you then cite these laws when asked by LEO why u don't have a license? How does this work in practice? I'm not saying I advocate any of this, but I find it fascinating.

These laws and the difinitions change all the time. In California, you still have to have a valid drivers license and a valid registration with a tag display on the vehicle or you'll be cited. Remember the STATE must do what ever is deemed reasonable to keep it's citizen safe and keep things in order. There are loopholes in all laws and some laws just don't work for every situation and are amended OFTEN.

Federal law does not trump state law unless the Fed can claim jurisdiction. So... The Federal deffinition of a "motor vehicle" only applies if you are being tried under a federal statute. Traffic tickets are never governed by federal statute however, they are handled by state, county and city statutes, codes and ordinances. My state has its own deffinition for a motor vehicle that specifically includes all personal vehicles that are not used for commercial reasons.

It's very true. I'm fighting a case on a DUI conviction and under the pretense of the constitution, a person conducting business and utilizing their vehicle for revenue generating means is only susceptible under to receive infractions on a motor way. Unless, corpus delicti is inferred in the complaint. You can speed as much as you want, drive without a license, insurance or even registration. This is written law of the land and they can not invoke the rights of their business upon you.

Driving without a license is not a crime. Still you have a point. And not having a license is a true pain in the ass. Can't board a plane, can't vote in some cases, try getting utilities without a license or SSN.

@teckniec2 just a matter of time before the trouble happens. suggest have your affidavit of truth ready. would suggest also dont have a registration/anything other than proof of ownership(letter, receipt, etc..). if possible, when being stopped, do not stop. either turn back around & go back home, or go to a friends house that would not mind storing your property until you return. the police cannot tow on private property. you shouldnt get a eluding charge if you follow the speed limits & such.

Can't be a constitutional republic and a corporation, they are mutually exclusive. Republic = people govern.
