Agencies are unconstitutional if and when their powers are not defined in the constitution (which they mostly are), not because they are there and do a bad job (Post Office).
@scepticsteve The FED is a private bank that only has one customer the U.S. government. It creates money out of thin air and then "loans" it to the government. Only congress has the power to coin money, they do not have the power to surrender that right just as you don't have the power to surrender yours. The FED is unconsititutional even thought its been around since 1913. These private bankers have set themselfs up as the middlemen between the congress and the mint. End the FED.

Your argument would amount to "the US government cannot surrender postal service to a private entity". Yes it can. They have the power, they don't need to use it. It doesn't state that it's an exclusive right, either. The constitution doesn't say you cannot coin your own money (there are laws that prohibit that, though).
There is nothing unconstitutional about the FED or FedEX.

A power isn't an obligation. Congress CAN coin money. It can also let some other entity do it (Fed). Or it can do nothing and let competitive currencies do the job. If that's correct reasoning, the Fed is not unconstitutional. Just bad policy. I have a bigger problem with the monopoly of the currency implemented by other laws. If there was no monopoly, unsound paper money couldn't do much harm (you'd switch to shells or gold coins or whatever).

And where does the constitution say anything about "agencies"? Certainly a Treasury Department is constitutional and Justice might be as well. Oh, the Fed and Commerce are also constitutional:
"To coin Money, regulate the Value thereof, and of foreign Coin, and fix the Standard of Weights and Measures;" US Const. Art. 1, Sec. 8 'Powers of Congress'
Although they might be bad policy, that doesn't mean they're unconstitutional.

Agencies are unconstitutional if and when their powers are not defined in the constitution (which they mostly are), not because they are there and do a bad job (Post Office).
Yeah, the EU is screwed, don't follow that model.

@scepticsteve The FED is a private bank that only has one customer the U.S. government. It creates money out of thin air and then "loans" it to the government. Only congress has the power to coin money, they do not have the power to surrender that right just as you don't have the power to surrender yours. The FED is unconsititutional even thought its been around since 1913. These private bankers have set themselfs up as the middlemen between the congress and the mint. End the FED.

Your argument would amount to "the US government cannot surrender postal service to a private entity". Yes it can. They have the power, they don't need to use it. It doesn't state that it's an exclusive right, either. The constitution doesn't say you cannot coin your own money (there are laws that prohibit that, though).
There is nothing unconstitutional about the FED or FedEX.

@scepticsteve They never voted on an ammendment to the consititution that would change the wording:
Article I, Section 8 of the Constitution says that "The Congress shall have Power...To coin Money, regulate the Value thereof, and of foreign Coin," and Section 10 says that "No State shall...coin Money". It is illegal for private citizens to coin money. The law that created the FED was unconsititutional. To take away from or add to the consititution you must pass an ammendment.

@UtherPendragan I don't get how these quotations make you believe that the constitution says private citizens cannot create money (general laws prohibit that right now, not the constitution). Depending on how you define money, we alsways have and had competing currencies (checks, IOUs, etc.).
Again, a power is not an obligation. Congress can decide not to coin money and let private entities do that. States are prohibited, not citizens. It's bad policy, not unconstitutional. Wish it was.

But letting the Fed print money is not unconstitutional, although bad policy. So I don't see where my conclusion is wrong.

A power isn't an obligation. Congress CAN coin money. It can also let some other entity do it (Fed). Or it can do nothing and let competitive currencies do the job. If that's correct reasoning, the Fed is not unconstitutional. Just bad policy. I have a bigger problem with the monopoly of the currency implemented by other laws. If there was no monopoly, unsound paper money couldn't do much harm (you'd switch to shells or gold coins or whatever).

@UtherPendragan It would not be "ok". But that doesn't mean it's unconstitutional. Congress has the power to maintain a post office, right? So it's constitutional for the feds to deliver letters. But that doesn't mean it's unconstitutional for the feds to outsource that service to FedEx. Running a post office is constitutional, not running one would also be constitutional. It's a power, not an obligation or monopoly. Running a post office is constitutional, but bad policy. So is having the Fed.

It's also not unconstitutional to let Blackwater run security for war prisoner camps. The feds "provide for the common defense", even if they have outsourced parts of the execution to a private entity. It's a power, not an obligation to do it in a specific way or do it at all. You can't just declare smthg unconstitutional because it's bad

@maskedphrogg Where do you get that "theory" from? The constitution doesn't talk about means of executing power. It enumerates the powers, i.e. what the government is allowed to do. It doesn't tell the government how to run a postal service, just that it is allowed to run one.
And again, it's a power, not an obligation. It is perfectly legal not to execute the power to run a postal service and leave it in "private hands". It's a power, not an obligation, not an responsibility, not a must.

Read the Constitution. It describes the limits of Federal Government rather explicitly.
You can justify Acts of Congress that are clearly contrary to the meaning or intent of the Constitution any way you choose. But don't expect others who would rather limit government to the confines specified in the Constitution to agree with you.

The FED is either a private institution or a government agent. In both cases it is constitution -though bad- for them to coin money. Private players aren't forbidden by the Constitution to coin money but congress is allowed to do so!

Every power not granted to the feds goes to the states and people (10th Amdt). It does not clearly define limits, although it clarifies some. Otherwise the document would be thousands of pages to mention everything they cannot do...
The federal powers start with zero and then the constitution starts to give some...

The constitution grants powers to the government, it doesn't list it's limits. The government is limited to the powers enumerated. Your formulation implies government has the powers unless the constitution limits them.

The US Constitution does not grant rights. It recognizes rights that were in existence BEFORE the Constitution came to be. The US Constitution grants to Gov limited powers and explicitly specifies certain responsibilities of Gov. You're not even looking at the right document let alone the right paragraph or page.
