If you are on private property and have the owners permission, you may record any and all activities as long as there's notification usually in writing(a.k.a signs). Prohibited in most States is restrooms and sleeping areas, with the exception of prisons or for the ligitimate purposes of research(sleep clinics).
I love the free state project but I think choosing NH was a costly mistake. It's been my experience that many libertarian minded people prefer space. If this officer knew the property owner well he should have known he had shelter for the horses. Also, why would he arrest his son. It does not make sense. Maybe in NH all parties need to be informed of the aud/vid recording... But in Va. only 1 party (the recorder) needs permission. Maybe a state law needs to be passed to give the public the right to record themselves during legal altercations...
Does it help if you state that the recording is being done to collect evidence for your own defence or the defence of the person concerned? I believe that you cannot be prevented from doing this.

In the state of Texas you can record video\audio without telling anybody, your doing so. it's only illegal to wire tap a phone line or any communication line. without a signed order from a seating judge!
I have a Mac mini installed in my car. with both audio\video. It can run up to 500 hrs. Before the harddrive is full. it also will upload all of it to any WiFi when it's time. to my webserver.

Well the cop was obviously dealing with a bruised ego because he was getting nowhere and having to wait around, thus finding an excuse to escalate the situation, tells a man on his own property he can't videotape, so he finally got some action and stroked his ego by exerting his power over the guy. If you're on your Property, you have the right to record someone from your Property. The Cop had the option to leave and get a warrent. No Law in any state will supercede the right of someone acting in this way on their own Property.
If you're ever in this situation, don't back down. If they arrest you, go along quietly and respectfully and deal with lawsuits later.

The camera man stood at a degree that the gun couldn't be seen (tucked in the lower back area) so when being handcuffed it was made apparent. Candia cops are corrupt. I used to live within eye shot of the Candia PD station house and was harrased all the time. They would pull me over and use the No Front Licence Plate as an excuse. If you are on private property and have the owners permission, you may record any and all activities as long as there's notification usually in writing(a.k.a signs). Prohibited in most States is restrooms and sleeping areas, with the exception of prisons or for the ligitimate purposes of research(sleep clinics).

If this officer knew the property owner well he should have known he had shelter for the horses. Also, why would he arrest his son. It does not make sense. This officer unlike the other office I posted a comment about had attitude. I do not understand the need for his actions. I disagree that wiretapping laws apply while one (the recorder) is on private property with the consent of the owner, and recording the actions and statements of a potential uninvited intruder/trespasser.
Then there was the officer who confiscated personal property (side arm) without the due process of law for an imagined offence that he knew, was not justified. Then it could be taken a step further, with kidnapping - unlawful detention.

In the state of Texas you can record video\audio without telling anybody, your doing so. it's only illegal to wire tap a phone line or any communication line. without a signed order from a seating judge!
I have a Mac mini installed in my car. with both audio\video. It can run up to 500 hrs. Before the harddrive is full. it also will upload all of it to any WiFi when it's time. to my webserver.

Well the cop was obviously dealing with a bruised ego because he was getting nowhere and having to wait around, thus finding an excuse to escalate the situation, tells a man on his own property he can't videotape, so he finally got some action and stroked his ego by exerting his power over the guy. If you're on your Property, you have the right to record someone from your Property. The Cop had the option to leave and get a warrent. No Law in any state will supercede the right of someone acting in this way on their own Property.

A person carrying a gun should act accordingly and notify the policeman he is armed. The camera man stood at a degree that the gun couldn't be seen (tucked in the lower back area) so when being handcuffed it was made apparent. Even though I had a valid temp. tag on the rear of the car. That is not a valid excuse when they get behind you and SEE the valid rear tag. Their rights as a private citizens of N.H. are forfeited once they are working. There is nothing hypocritical about this. omg have you not been paying attention the animals are fine, they had a legal structure they were taking care of the animals the problem was that they refused the police on to the property that was not theirs and nor did they have permission to allow the cop on their and the cop arrested the boy because he didn't stop filming after he already said he didn't care if he was being recorded. why did the officer care all of a sudden because he fucked up on camera plain and simple.

No, they were simply being obstinate for no real reason. The cop said he didn't mind being filmed, then said he did. He has a right to change his mind, right? And he clearly did so because of the obstinateness. Which is typical action of Bourgeoisie rebels kids, now trying to make this more than it is. He ain't Rodney King!. Incidentally there is no evidence in the film which shows the animals are fine, thats just your assumption.

Yes he has the right to change his mind i just thought it was funny that he only changed his mind after he realized he just lied twice to force his way onto the property. they were both very polite especially after so many obvious lies so I don't know where you get this idea that anyone there was "obstinate" and in what way was this a rebel kid? actually it was your assumption that they weren't fine.

You stated "the animals are fine". Based on what evidence? Im sure you agree that animal welfare is important, yes? So, assuming what they said, about the owner refusing permission to go on to the property, is true, there was a very easy way to resolve matters. Keep the camera rolling and drive to where the shelter for the horses is. Take a quick video of those premises, then return and show the video. Easy, right? But no, Bourgeoisie rebel kids decide to be obstinate for no good reason.

what evidence? how about the fact that even after they got their warrant the property owners still kept their horses, and no one was charged with any kind of crime. yes the animal welfare is important but its not the only thing thats important and you can't just go barging in onto someone elses property based on a fucking rumor. forgetting the fact that the battery in the camera died. no its not just about being on the property its about privacy. video would just as well destroy that privacy.

no why do you? do you know why the horses were taken away? "because they might have a disease" so they took them to another farm which is just plain stupid. sorry i should have been more specific they didn't take the horses away from a lack shelter which was the initial complaint and the owners have not been arrested or fined for any of that the horses were taken way for the earlier explanation.

well thats interesting as a matter of fact this confirms a lot of what I said. there is conflicting information here. first of all "All 29 horses are under quarantine because they lacked health certificates and proof of an equine infectious anemia test as required by state law." not that they lack health but they lack health certificates. "filed 17 charges against Heidi Fredrick" filing charges and being fined are 2 dif things.

1)She was charged and bailed on $5,000.
2)The warrant has since been opened and is not, as you claim sealed.
3)12 Horses were taken due to shelter and welfare concerns, not because of a lack of certificates.
4)Most of the horses have recovered and have been returned, under strict controls and supervision of vets. All 17 charges stand.

you know its really sad i have to explain this simple shit to you. but those worms could have easily been contracted AFTER the horses were seized. and if those horses had worms why didnt the rest of them? why a few weeks ago didnt the vet notice any of this when he checked them out then (after all he was one of the vets that was 1. at the seizure 2. their former vet. if they had shelters for all the horses (yes some were a little cramped) and there was more structures being built then obviously

they were complying with the law and trying to take care of their animals. the report also says that the shelters were damaged by naturally occurring events not exactly something they can control. The horses had plenty of food that wasn't even in dispute but it can take a while to notice worms and its even harder after a long travel. if the horse owners are such bad people why did they get any of the horses back? the horses were at nhspca before they got to leblanc so why did they have feces?

making shit up or making wild accusations doesn't give you a better grasp on the story. according to all the sources I found on the internet including their own local papers said that only one woman was confirmed to have made a call of concern because she saw an injured horse back in the fall. animals get hurt often on their own that doesn't warrant a seizure.

the NHSPCA Disaster Response Team assisted police in removing 12 Arabian horses that were determined by a veterinarian to be at risk. at vet that just a few weeks earlier was paid to check them out and had no problem with them. the only real reason the horses were taken was because the NHSPCA was embarrassed and so was the police when they tried to force their way onto the property. this is nothing but shady politics.
