  • It is your firt amendment right to film ANY police in a public setting especially when he is on duty. It is against your fourth amendments rights for the cop to try to TAKE your camara. This has been ruled by several federal courts. It has also been decided that if a cop arrest's you for filming him, He can not claim immunity later from law suites for not knowing you first amendment rights. The guy filming does NOT NEED authorization in public. Know your rights people

You can find this tactic used by police every day now. If you don't answer all their questions (which you aren't obliged to do) then you are being uncooperative and "suspicious". Why is that?   • If you are on private property and have the owners permission, you may record any and all activities as long as there's notification usually in writing(a.k.a signs). Prohibited in most States is restrooms and sleeping areas, with the exception of prisons or for the ligitimate purposes of research(sleep clinics).

  • I disagree that wiretapping laws apply while one (the recorder) is on private property with the consent of the owner, and recording the actions and statements of a potential uninvited intruder/trespasser.

    Then there was the officer who confiscated personal property (side arm) without the due process of law for an imagined offence that he knew, was not justified. Then it could be taken a step further, with kidnapping - unlawful detention.

    In a nutshell, the police will say/do anything to achieve control. If YOU allow them to control you with words, then they own your mind.

    They will pretend a certain activity violates a law, to such an extreme as to arrest and incarcerate, only to later release the subject on a technicality or for lack of evidence.

  • In the state of Texas you can record video\audio without telling anybody, your doing so. it's only illegal to wire tap a phone line or any communication line. without a signed order from a seating judge!

    I have a Mac mini installed in my car. with both audio\video. It can run up to 500 hrs. Before the harddrive is full. it also will upload all of it to any WiFi when it's time. to my webserver.

  • Well the cop was obviously dealing with a bruised ego because he was getting nowhere and having to wait around, thus finding an excuse to escalate the situation, tells a man on his own property he can't videotape, so he finally got some action and stroked his ego by exerting his power over the guy.   • If you're on your Property, you have the right to record someone from your Property. The Cop had the option to leave and get a warrent. No Law in any state will supercede the right of someone acting in this way on their own Property.

    If you're ever in this situation, don't back down. If they arrest you, go along quietly and respectfully and deal with lawsuits later.

    Here in NYC, it is legal to film anything seen in public.

    2 months ago, I was at an accident scene, filming as I have for 30 years, trying to get content to sell to the papers when a member of NYPD's stupidest told me I couldn't film because it was "rude"

    As for your situation, you just say to the Cop, "Go Read the constitution and get back to me, meanwhile please move because you're blocking my shot and I take that as an act of interfearing with my rights."

    I get this type of thing in NYC at least once a month and I tell them to "back off, I'm a Lawyer and know my rights."

It is the officers or anyone elses choice to be there and be video and audio recorded! The police officer doesn't even have the authority to come onto the property with their consent therefore he shouldn't have even arrested them! If they on in public on public property THEN they can request to not be video taped and audio recorded!

  • Candia cops are corrupt. I used to live within eye shot of the Candia PD station house and was harrased all the time. They would pull me over and use the No Front Licence Plate as an excuse. Even though I had a valid temp. tag on the rear of the car. That is not a valid excuse when they get behind you and SEE the valid rear tag. I even got stopped one night coming home from a bar and was drunk, but because my employer gave the Candia PD parts for their cruisers he said he would forget seeing me.

Their rights as a private citizens of N.H. are forfeited once they are working. There is nothing hypocritical about this.   • you know its really sad i have to explain this simple shit to you. but those worms could have easily been contracted AFTER the horses were seized. and if those horses had worms why didnt the rest of them? why a few weeks ago didnt the vet notice any of this when he checked them out then (after all he was one of the vets that was 1. at the seizure 2. their former vet. if they had shelters for all the horses (yes some were a little cramped) and there was more structures being built then obviously

  • they were complying with the law and trying to take care of their animals. the report also says that the shelters were damaged by naturally occurring events not exactly something they can control. The horses had plenty of food that wasn't even in dispute but it can take a while to notice worms and its even harder after a long travel. if the horse owners are such bad people why did they get any of the horses back? the horses were at nhspca before they got to leblanc so why did they have feces?

  • making shit up or making wild accusations doesn't give you a better grasp on the story. according to all the sources I found on the internet including their own local papers said that only one woman was confirmed to have made a call of concern because she saw an injured horse back in the fall. animals get hurt often on their own that doesn't warrant a seizure.

  • the NHSPCA Disaster Response Team assisted police in removing 12 Arabian horses that were determined by a veterinarian to be at risk. at vet that just a few weeks earlier was paid to check them out and had no problem with them. the only real reason the horses were taken was because the NHSPCA was embarrassed and so was the police when they tried to force their way onto the property. this is nothing but shady politics.
