At around 0:42 when you say he has insta charged shots, its a glitch in spectate. The sniper charge is always full, and the cloak for spy is always at its top but is sitll going down.

Yeah, bad memories from other ppl haxing. For example that one time I was a spy with cloak-and-dagger a Scout ran RIGHT in front of me, aiming at me. I moved slightly to the left and it's aim followed me perfectly (right before he shot me and I was cloaked and he didn't even bump me first so he "saw" me as i was invisible). The funny part is that I owned that guy even when he was hacking :3
