Do you not recall the fallout when the decision was made to try 9-11 conspirators in federal court in New York rather than doing so at Gitmo in front of a military tribunal?   • @tommysch Two reasons: he is a foreigner and bringing a cause of action against the US military is hard to do, even if you have tangible proof (McCarthy/Army). It is a complicated and complex issue. If he did sue, would he do so pro se or would he look to the international courts for support? Say the IC took on his complaint. Do you think the courts would hold the US accountable? There is no precedent and he is one man. His story is tragic, but until that place is closed, this will continue.
