  • Guns are fine, but if the manager asked them to leave, they have to leave. Property rights trump gun rights. The manager can tell anyone to leave for any reason and they have to.

  • @travz21

You are exactly right concerning private property property rights.

However, the manager at DC OCB did NOT ask us to leave so your comment is not relevant to the event. The problem arose when one person complained to the mgr, the mgr actually refused to do anything about it. The other patron hen called the police, repeatedly until the PD responded. .

  • @paopencarry Well then that's ridiculous. Most people don't understand that more guns = more safety. They are just scared because it has the potential to kill someone. Well so do the knives that people are eating with, but you don't see people scared or complaining about that. The government has done a great job brainwashing people into thinking only police should have guns.

  • huh. i forgot this actually aired on TV. look at mah hair, it's so curly and sexy. that's me, the sexy Brown Jew.

  • "COME AND TAKE IT!" Bullets first ;)

  • Without giving an answer that requires that I first agree with you (I don't) can someone explain to my why you have a problem with someone being armed?

  • LOOK!!!!!!! OPEN CARRY IS LEGAL in certain states!!! That means you and your wife and your kids alarm and concern is just that....alarm and concern. It is not an open invitation to the police to make arrests or seize weapons. So sick of other people infringing on my rights!!!!!!!!!!!

  • Just keep it consealed and avoid problems.

  • @cheswic

    fail.

  • One thing i have very hard time understanding is the huge difference in mentality when it comes to guns. Gun owners, and people who often work or are around people who use guns for sporting/hunting ect. See guns often simply as tools, tools that require a lot of safety precautions but its just a gun type thinking. Yet people who are never around guns when they see one "AH OMFG ITS A GUN!!!" I tell these people its like owning a car.. only a lot safer then a car.

  • @GhostInTheShell29 Yup, it seems like most people's only experience with guns is in TV and movies, where they'll only see police and bad guys with guns. If a movie dealt with the reality of most gun owners, law abiding citizens, then it would be one seriously boring movie.

  • People need to place the blame of this on the restaraunt owner first and foremost. All he had to do was exercise his rights and ask them to leave. There was no need to call the police when these people weren't doing anything wrong.

I hope its a costly mistake on the city's part because apparently that's what it is going to take for these entities to wake up and learn the laws and obey the laws.

  • To clarify. The restaurant did not summon the police. A group of customers called the police repeatedly (they initially did not respond) until they responded. When the police did not respond they complained to the management who then also called the police to inquire of the legality to placate the gun-hating customer.

  • okay, point taken. The news people inlcuded one part of the manager's call to police.

I guess the police should have just asked him if he exercised his rights to ask them to leave and if so, were they heeding it.

  • Yep. The police never talked to the management before engaging the group.

The management had no problem with the group.

  • Basically the city says it knows the laws, these citizens were obeying the laws but tough shit, we are going to do what we want.

That usually doesn't hold up in court.

Would that argue that black people need stopped because people feel threatened in their presence?

Will they argue that police can walk into your house and check your closets just in case something illegal is in there, all in the name of public safety.

My guess is yes, some are that ignorant.

  • A mistake in the name of public safety...

Can I get women pregnant, moving from one to another to make sure they name their son Anthony, in order to populate America with more Anthonys?

Some people should not have a badge.

  • it's just a ad shame that in the end, the residents of Dickson City are going to end up footing the bill, when the borough is forced to pay for the lawsuit filed against them. too bad, so sad.

  • Now criminals know where to go to get there crime on because the public there is so afraid to stand up for there rights, others tried to but were arrested , good going squashing the 2 nd amendment,

  • I wish open carry was legal in NY, to bad the state is run by damn NAZI's. I would just love to see these new yorkers reactions when they see a guy strapped with a .45 eating next to them at a restaurant.

  • It maybe a law in PA that you can carry a gun in public view. Fine. POlice have the right if they see a plains clothes officer with a badge and gun on to check him out . Police have the right to check you out if you can legally own a gun, not some mental case or someone with harmful intent. Same thing. If you don't like it then don't carry. It maybe your right but you create your contact with police by carrying a deadly weapon. It is not harassment.

  • Completely false. The police need RAS or PC of an actual crime in order to "check you out".

Please don't continue to post legally incorrect info as fact.

  • @RANDY64612 Agreed with paopencarry. The police need to have belief a crime has been or is about to be committed to stop you. Also the courts have ruled that merely carrying a gun is not suspicion of a crime.

  • i think every one has the right to carry a gun

  • liberalssssssssssssssssss

  • All the OCB manager had to do is tell these open carry clowns to leave the property. Although it is legal to open carry this is private property and the business has the RIGHT to make you leave. If the open carry clowns refuse then it is defiant trespass and can be arrested. These clowns go to places on purpose to start a confrontation with the police, don't let them fool you. Listen to the clown in the video talking about the old days when he stated he was beat up by NYPD.

  • They don't go to start a confrontation but they are there to make themselves available for confrontation if people or authorities want to brandish their ignorance.

Whatever it lawfully takes to get the messege across and hold those in power to become educated and respectful of the laws and people's rights. Unfortunately, they show time and time again that they aren't going to do this on their own. If police handle it properly, then there are absolutely no problems.

  • As someone who has been to this town many times you have to understand that the officers from Dickson City are far from the best officers available. The officers had no clue of what the open carry laws are or many other laws. The officers from that Dickson City are in great need of training and education on legal issues.

  • Thank goodness for the Municipal updates. Too bad it hasnt made much difference. OCers still get hassled and even arrested on a regular basis. It has made it pretty clear that the officers are clearly breaking the law and they CANT claim they didnt know

  • The call from the manager of a restaurant in PA about open carry is astounding. Open carry has been legal in PA for practically forever. To the gentlemen who does not want to see his kids exposed to guns I would suggest he either move to NJ or launch a campaign to change the PA Constitution. There is no excuse for violating the Constitution in the name of public safety.

  • It will come down to the owner of the business as to whose boycott? the gun carrying customers or NONE gun carrying customers.

It will come down to the owner of the business as to whose boycott? the gun carrying customers or NONE gun carrying customers.

If the owner dont want you in there it will be trespassing.

The person should been charged with being a public nuisance

  • Did the guy get his gun back ????

  • Yes he did. They took it because it wasnt "registered" to him.

There is no registration of guns in Pennsylvania lol. Nice try.

  • it's a liberal move to not "make oc illegal", their true agenda is to make it socially unacceptable and give people a hard time when they OC.... just give the cops your ID, name and let em run your gun... But some shit is wrong with this country know... Constitution is ABOVE THE LAW! No laws can change it, they just make "gun restrictions" Such a pathetic country this is now, George Washington... Sorry bro, your free replublic is now a SOCIALIST country...

  • there isn't going to be a NWO with this going down, so back off unlawful law enforcement.

  • the more guns the better. now if more people are wearing guns, the safer it is. if you can't handle eating with a gun, go home and hide in the house like the coward you are and have your meal there.

  • we need more weapons in public. these people that are afraid are cowards. the more guns, the more safer we should feel. one idiot gets out of hand, the law-abiding citizens will help with their guns.

  • Oh, thank goodness. As long as it's in the name of public safety it's okay for police to harass people when they haven't broken the law.

  • if you think that the police cannot detain you to check your gun permit, your wrong and if you think that you dont have to cooperate your wrong. youve read the constitution now read the penal code and educate yourselves.

  • @cadetljr4 a gun permit isnt required to open carry. therefore there is nothing to check.

Try commonwealth vs Hawkins. Start with that and get back to me when you want more case law. Mere possession of a gun is not probable cause to stop a citizen using his right to bear arms. Sorry. The law is not on your side.

  • chief is going to jail. piece of shit! rot in hell

  • If Chief Stadnitski thinks this is a closed case he is crazy, a lawsuit has already been filed in Federal Court. Judging by the reaction of the idiots that live in Dickson they deserve to have to pay off the lawsuit over this illegal police action.

  • Those dickerson cops can kiss my ass and so can those dieckerson residents. I can carry so if you have a problem about my gun, leave. Why in the hell are ysou worried about open carring. We are not gang bangers or robbers!!!

  • The citizens are outraged because people carried in the restaurant "that is ridiculous".

You cant suppress my rights just because you don't agree with me, get over yourself and move along.

Just for your information, those carrying have been judged all over the country to have a lower percentage of committing a crime than than the actual officers that pin on a badge and carry a gun daily to respond to your call.

Put that in your sensationalist filled pipe and smoke on it!

  • Thanks for posting this, even though we don't have the right to carry anything to protect ourselves in Australia, I do find this a facinating subject.

  • Stadnitski needs to get his facts straight and quit relying on PSP's illegal registry of handguns.

He needs to quit insulating his officers from reprimend and own up to the fact that they messed up bad!

Hold the police to the same standards citizens are held. Ignorance is no excuse.

  • The police are obligated to check out man with gun calls, but they should have just walked in and seen that nothing unlawful was going on and walked out. The police response was outrageous.

  • in 2005 I was shooting at an old gravel pit. My shooting grop has used this place many times before for the same thing. Some lady heard us shooting so she called the cops. We told the cops what we were going to do before we started that they were cool. Stupid people are everywhere.

  • "The police are obligated to check out man with gun calls,"

I would certainly expect the police to check it but you are right when they saw nothing illegal going on the whole thing should have been dropped.
