  • @smkurtz I'm the same boat as you sparky :p I once was driving to v.a to get a friend I hadn't seen for ages, and on the way my friend who was with me almost got side swiped and fish tailed several times by either a drunk driver or someone extremely impaired who decided to swerve through three lanes of traffic almost hitting other cars as well. :/ If I ever got so drunk and had to work the next day and didn't have a way back, I'd rather get to work late then drive drunk.

  • the accuracy of the breathilizers they carry around are iffy; when they do fieild test or even the breathilizer its to confirm that intoxication was the reason for the poor driving. When they take them back to the jail there is a very accurate breathilizer test that is used.

  • because you have to develop probably cause by administering field sobriety exercises before you can make an arrest so you can show defense and the jury that she was driving while in actual physical control of a motor vehicle while under the influence of alcohol, and at that point is when you can ask for a breath test.

    Field sobriety tests to establish probable cause for the use of breathalysers? What is this? Science meets medieval practice? Probable cause is how they drive, and breathalysers are certainly not more inaccurate or intrusive than field sobriety tests. Field sobriety tests are nothing but primitive and outdated nonsense! Stick a breathalyser to them, and if they blow positive just bring them in for blood testing to establish hard proof. This is how it is done in modern countries.

  • It's not really so-called "patience." He has a very deliberate purpose by taking so much time with the driver.

    Every time he issues an instruction, anyone who is sober can see that the driver is impaired, whether or not she complies with it.

    So, since it's all taped, this 'field sobriety test' is really not meant to determine whether or not a person is impaired, but whether he/she is easily convicted.

    Just like collecting evidence at a crime scene, that's what the cop is doing.

  • @DaftPACman I'd say there is very few depts that dont have breathalyzers. In the US there r these silly things called rights. The officer must get probable cause in order 2 utilize an intoxilyzer. All of these field sobriety tests then give the officer the probable cause. After these he would administer that portion of the test and arrest the subject. Then back @ the department the official reading from the breathalyzer is taken. The breathalyzer is the bigger sized machine. Intoxilyzer=roadside

  • yea, I have had friends that were pulled over, they were drunk but they passed the field tests with flying colors. The officer did it multiple times to make sure and then sent him on his way sense he was able to balance perfectly, follow his finger from left to right with random stops, etc etc. Yet, he should have had a DWI. LOL

The officer can then use the field sobriety tests as their back-up plan. With all this they arrest them and get the official reading at the station from a calibrated machine....yadda yadda yadda

  • that's because the probable cause to believe someone is impaired would be the field sobriety exercises.  The breath, blood, or urine tests are just the icing on the cake.

  • You would have to study the laws to really understand why.

    Usually there are two parts to DUI/DWI charge. 1) Is the driver over the BAC via a test? 2) Is the driver IMPAIRED even if UNDER the BAC?

    Also, just because you get pulled over doesn't mean the cop can just give you a BAC test and let you go or not. The driver might have a legal right to a BLOOD test, not a breath test. To do this they have to take you down to the station.

    Here the cop is videotaping the driver as EVIDENCE for court.

  • Some Lawyers would try to say that the breathalyzer was inaccurate or was administered incorrectly by the officer. This proves in court that the person in question was incapable of controlling a motor vehicle despite what an improperly calibrated or administered breathalyzer might say.

  • @justpeekinaroundhere From what a friend that is a cop tell me. You can testify to the person physical ability to do the field sobriety test in a trial. But the portable breath test the cop cant. It has some thing do with it how accrete it is.

    He can testify in probable cause hearing to the person failed portable breath test and the field sobriety test.

    It seem the court has a lot of step and rules that change depending on how fare you are to court.

    Infact, a PBT is just that - preliminary. The real test is back at the station.

The "Field Sobriety Test" allows the office to show reasonable cause to escalate the traffic stop to a breathalyzer and proove the cause for arrest, if they simply arrested the driver, a decent bottom feeder, I mean lawyer could get the case thrown out on lack of due process.

A field sobriety test ensures that the person's coordination is so impaired that they are not capable of driving - and if the cause is the influence of drugs/alcohol, that's an arrest.

  • @justpeekinaroundhere On top of what others have already said, some states (such as CT where I've been a cop for 5 years) do not permit their police officers to use breathalyzers on DUI stops. Personally, I do not agree with that at all but it is the law of CT.

Field sobriety tests means the police officers (if it goes to court) can submit an indicia (them and any other witnesses) showing that the person was not in full control of themselves. The other alternative is a blood test but by the time that may be done, the blood alcohol level may have decreased in the time between pulling over the car, transport time and getting the blood test done.

  • @justpeekinaroundhere in most jurisdictions, there are two separate citations; driving over the legal limit and driving under the influence. the fsts are to determine driving under the influence and breathalyzer to determine if driving over the legal limit.

  • I have been in this situation with these road side tests (no DUI thank god.) and the cops were rude, unprofessional, did not explain instructions clearly, obviously trying to get me to screw up for an easy DUI charge.

  • I don't know how cops in other countries test for DUI's. But yes "usually" in the US the cops MUST do a field test BEFORE they do a breathalyzer regardless of how drunk the cop thinks the person is. Otherwise a judge could "throw out" the breathalyzer/blood/urine results due to a lack of probable cause. Most police departments put on extra patrol units for DUI enforcement so there are plenty of officers for the shootings, assults, robberies etc...

  • The "test" are voluntary in almost any state. That's what makes them admissable in court. The breathalyzer merely confirms the officer's suspicion that the driver is under the influence.

  • it's standard procedure, the subject must fail all portions of the FST (field sobriety test) for the Breathalyzer test to take place. The officer has to do an FST no matter how drunk they may seem or else the person can take the case to court and say the officer didn't do an FST and have probable cause to breathalize them.

  • I think it depends on the state... but as far as I know the cops HAVE to do the field test no matter how drunk they think the person is. Otherwise the person being arrested could come back in court and say the cops had no cause to do a breathalyzer, blood test or whatever they need, and therefore the only real hard evidence the person was drunk could be thrown out. I dont know if this cop was being an ass or not but he could have been covering his own ass to make the arrest.

  • This lady was definitely drunk as a skunk and I wouldn't trust her on the road. However, many many people stopped for "suspected DUI" are stopped for other reasons (i.e. burned out tail light, etc.). Then the cop sticks his big bloodhound nose in the car and smells "alcohol" (which could be O'Douls or other non-alcoholic beverage). This gives reason for the cop to (as far as I'm concerned) falsely imprison the driver. After this the driver may as well say sayonara to their life for a while.

  • Those roadside acrobatics are just BS. When the cop gets someone to step out of their vehicle because he/she "smells alcohol" they have pretty much made up their mind that they are taking the person to the clink. People don't have to do those stupid acrobatics, but they do have to submit to a breath or blood test at the station. DUIs are mostly victimless "crimes" so I think they shouldn't have these laws except for people who are really endangering others. The .08 BAC is BS too!

  • A question if I may: Why don't the police just simply give her a breathalyzer test, rather than this crap? I'm not sure of the U.S. Citizen's rights, but in Canada, if you appear intoxicated, they'll automatically tell you to take the breathalyzer... if you refuse (It's your right) is the same as admission of guilt. No roadside test is as thorough as a breathalyzer.
