Mr. Bolton acknowledged he was aware that SMART policy prohibited offensive, racial or ethnic remarks or jokes,

He said he and Mr. Gonzalez "used to joke around...we talked about everything," he said, and he denied having said what Mr. Gonzalez alleged. Mr. Bolton, a twenty-one year employee of SMART, described the September 26,2008 encounter as follows: he walked in from the parking lot and there were "a bunch of guys by the stock room-Dwight,Gilbert and Pete-talking politics." He "had a pop in his hand" which he placed in the refrigerator, and as he walked towards the time clock they asked, "Hey, what do you think about a black man being president?".

Mr. Littlejohn recalled being present when the incident between Mr. Bolton and Mr. Gonzalez occurred. He testified that as he walked by the stock room,he heard Mr. Bolton say he "wasnt giving and deer meat to someone who votes for Obama," and he did not hear any statements about blowing his brains out. Mr. Littlejohn identified a September 29, 2008 statement he wrote a couple days after the incident. "Talking is common," Mr. Littlejohn said, and "sometimes the language gets rough,"

Ms. Asstolas said the Company (SMART) did not terminate Mr. Bolton at that time because "we believed he'd learned his lesson from the hearing and had been made aware that disciminatory comments are offensive and create a hostile work environment, and we believed he understood it".

The department asserted that Mr. Boltons comments had included "raghead", "towel head", and "asking Mr. Barash where his camel was" The department alleged this conduct interferred with Mr. Barash's employment and created a hostile work environment. Hearings involving this charge, Ms. Asstolas said, are currently ongoing.

After diversity training, Ms. Asstalos said, Mr. Barash continued to complain that Mr. Bolton was making offensive comments, and on June 19, 2006 he filed another charge. The Department of Civil Rights investigated the matter again and issued a charge of unlawful discrimination against SMART based upon their findings that Mr. Barash had been, and continued to be, subject to harassment based upon his national origin.

Ms. Astalos testified that racial jokes and slurs, as well as threats of violence, violate SMART policy and subject an employee to discipline up to and including discharge. She stated that several years ago, Mike Barash filed a complaint with the Michigan Department of Civil Rights claiming Mr. Bolton had been making offensive ethnic comments. As a result, he said, SMART offered diversity training to all maintenance employees, including Mr. Bolton, to educate them about antidiscrimination laws.

Prior to then incident giving rise to Mr. Boltons termination, Mr. Taylor said, he spoke with Mr. Bolton regarding claims made by Mike Barash that Mr. Bolton had called him a "rag head" or a "towel head". According to Mr. Taylor, Mr. Bolton said, "I'm not calling Mike Barash a rad head, I'm calling myself a rag head". Mr. Taylor recalled telling Mr. Bolton that such comments were not acceptable. "He understood what I meant," Mr. Taylor said.

Mr. Taylor testified that he supervised Mr. Bolton for more than five years and that during that time SMART had a policy prohibiting racial and ethnic discriminaion and jokes. Another policy, states that "physical acts of violence, or threats of violence by or against any persons who work for SMART will not be tolerated", and adopts a so-called "zero tolerance" approach to such conduct. Under the policy, Mr. Taylor said, an employee threat of violence even against a non-employee is prohibited.

Detroit -- FBI agents have searched the offices of a Detroit produce company, looking for evidence of illegal kickbacks paid to Teamsters officials, according to records filed in federal court.

Among the records sought were any "that support payments and or kickbacks to union officials, specifically Michael Townsend or union entities, from January 2003 to June 2009."
