  • @SolarEXtract Actually, they didn't remove his freedom of speech from him. Had he complied with their instructions he would have been allowed to hold onto his sign on the first floor. What they did, was violate a court order instructing the DOA to only use rules that were in force on 28 JAN 2011 - which allowed them free access to that area of the building. As suc h he has a case against the Captiol Police and the DOA for violating his first amendment rights to assembly.

  • The people saying these guys were in the wrong have a poor grasp of constitutional protections, unfortunately. Reasonable time and place restrictions have long been argued and precedented in court decisions. That's where we get the familiar 'not being allowed to yell fire in a crowded theater balcony restriction.' Restricting the right of the people to peaceably assemble on the second floor is NOT a reasonable restriction of time and place, and hopefully the judge understands that.

  • By the way I was a prison guard for 10 years, dealing with actual criminals, and I would never, ever have allowed this situation to get to the point it did with these people being as respectful as they were. I have respect for authority, but you should not have to bend over and kiss their asses. These people were free American citizens, and if you are too "polite" to do what they did fine, but to say they were wrong, to not be willing to fight for their right to make this stand is UNAMIERICAN

  • @cruciphile Actually, the people in Wisconsin are by and large nice and friendly people. The entire state should be proud about how the protesters and the law enforcement handled this difficult situation brought about by the unreasonable requests of the government. Here, here Wisconsin!

  • You have not had your rights infringed upon. Time/Manner/Place restrictions, so long as they are content neutral are constitutional. The State is allowed to ban signs on floors other than the ground floor.

  • That guy from the Capitol Police was the same one who was running the show on March 1st when they wouldn't let people into the building. He wouldn't give me any information on a number to call to ask about why they had the Capitol on "lockdown".

  • So, let's see. You are instructed to take your sign to a different place where the posting of signs IS permitted and instead you argue with the office who is doing his job. Then you argue and say he did something wrong. The officer is just doing his job and you act like a jerk. You should have complied, and then made a complaint later to the appropriate people.

  • @Whitelitr but it is still their right to be standing there and peacefully protest. Say someone was going to take your house and family away because you wore a bright green shirt on a Tuesday and green shirts are only allowed on wednesday.........would you so graciously follow orders and then complain about it later? It may not seem like this is a big deal now, but when civilians don't know their rights they are taken away slowly-one by one- and this should scare you.

  • @BassAssasin13 - Your argument is specious. The scenario you describe and the scenario in question are radically different. My statement was that the protesters should have complied and then take it up at an appropriate time and with the people in charge, not arguing with the officer. Most bldgs of this type have rules now (thank you 9-11) regarding what can be where. If they were in an area where protesting was not allowed, there should have go to where they were told they could protest,

  • @BassAssasin13 - My daughter's school is public. I have every right to go there, hang out, visit class and so on. If however, I started waving a sign around in the front hallway, I would be asked to leave. The protester's were asked to go down into the rotunda, not stand where they were. Their right to protest was not infringed, they just did not want to do it where they could, but where they wanted to.

  • @Whitelitr I don't think protesting was prohibited, just signs. There's actually a prohibition on signs in my state's (Michigan) capitol even though it's been packed with protesters.

  • @Stateslate - from what I gathered in the admittedly poor quality video, they were OK with protesting and even the sign, just not doing it on the second floor. The could have gone back down into the rotunda and been fine, They didn't want to do it. They were in the wrong.

  • @Whitelitr Yes, most building do have rules. But those rules do not allow any law enforcement officer to deny anyone their Constitutional Rights.

  • @ReadyForBattleAMV - Watch the video again. No one was denied their rights. They were told they could not stand on the upper floor and that they had to go down into the rotunda on the first floor. The Constitution does not address that. They were in the same location, just not on the second floor. They went hoping to make a scene, and they did just that.

    Read the court order, it says all policies and procedures should go back to before the protests, this includes being allowed to be on any floor. Also, as the man in the video said, the "rotunda" in other instances also includes the first mezzanine.

  • Court Date is April 8th 10 AM Room 1000 Dane County Courthouse...  Will set up an Actblue for court costs...

    Article I, §4 Right to assemble and petition. Section 4. The right of the people peaceably to assemble, to consult for the common good, and to petition the government, or any department thereof, shall never be abridged.

  • First amendment violations, assault and battery, attempted murder, stealing private property, extortion, threatening to assault and kidnap private citizens/disabled veteran(s), violations of the ADA (americans with disabilities act) and RICO Act.

  • I've been arrested 3 times for civil disobedience. For my Union. Only times in my life. We were ready to fight, but each time the DA, dismissed the cases. I went once with a friend, and judge "Nancy", dismissed all charges. You need a picture of that sign " no second floor" for your case. FIGHT IT!!! I believe the guy, weddings first floor, second floor. I wish I lived there. I go with. Thanks again.
