I'm going to side with UPS on this one, the RLA is an obsolete piece of legislation that FED Ex uses to undermine the union aspirations of its workers. Over the road freight movements by Fed Ex should be governed by the NLRA not the RLA, unless of course they are moving on a flatcar or flying through the air. Fed Ex's manipulation of their business model is coming back to bite them in the ass and it serves them right.
There was no bailout from the administration, and UPS did not receive a dime in taxpayer funds. You are referring to a FedEx smear campaign resulting from UPS's insistance that both companies be classified under the same labor laws. FedEx is fighting this because they don't want their employees to be able to unionize.

Now I could see some common ground if we took all employees that work at an airport and governed them under airline laws, and all non-airport sorting hubs as just that, non-airline personnel. That makes more sense to me and would still leave FedEx in a better position since they are mostly airline employees but still equal rules for both companies.

From what I have read/heard on this FedEx is working under some very old rules and UPS wants them to follow the same rules that UPS is aready following. That does not sound far reaching to me...
Also, FedEx is the one who is teamed up with the USPS and last time I checked they are part of the US government.
As a businessman myself, UPS has provided my shop a much better service to our area than FedEx. I have had to do refunds, put up with delays, drive a half hour to pick up a package that a driver refused to deliver (because he didn't "want" to stop in our area during clearly posted business hours)... and the most horrible customer service the shipping industry can provide through FedEx.
I'd gladly pay my taxpayer dollars to help a company like UPS, if they needed it.

I work at ups, we wrote our gongress man to change fedex's contract laws. They are under the RAILROAD ACT OF THE 1920's when they ship by AIR and LAND. Fedex does not have to unionize because of this, thus saving them millions of dollars. what ups DID DO.....

I don't care who is doing what or who is right or wrong. UPS accused me of being a liar when they didn't deliver a package that they said they did. I wrote my congressmen and signed the petition. I will do anything to help put them out of business. UPS is just an ugly monster at the core of their business. When I order online I don't buy from places that ship UPS. I often times pay an extra $20 to have something overnighted just so it will be sent FEDEX.

However, they chose in the 1980’s to outsource their express delivery to their existing Ground drivers (which fall under the NLRA). When they realized their mistake in the 1990’s, they sought to be reclassified under the RLA, but were forced to drop their case by massive Teamster pushback.

FedEx Compares not to Ups in every way. Ups treats its employees well, its service is undeniably efficient. FedEx, well, they have no union, they pay their employees a bit more but you basically have no benefits and management are AssHoles!

@irishamerican8790 - Sorry, you are mistaken. FedEx Express, FedEx Ground, and FedEx Freight are all separate companies. The Ground and Frieght companies are already under the same legislation as UPS. Only the Express company is under different legislation because it is an AIRLINE. FedEx and UPS worked together several years ago to try to get the airline segment of UPS under the same legislation as FedEx, but it didnt work out. Now UPS is trying to disrupt FedEx operations.
UPS offers more benefits to their workers than FedEx does. The pension plans are better and the health benefits are better. And in the right-to-work states they give you the option whether you wanna join the unions or not, you dont have to. FedEx pays very little, they make you work on weekends and fire people left and right just to make sure they are making their money quotas for the quarter. UPS is a 5 day a week job with great benefits. Stop whinning FedEx

That's not to justify what FedEx is doing, what I mean is that UPS is going about this the wrong way. UPS should be trying to get the current laws should be changed so that neither company has to deal with powerful unions, not be trying to change the current laws so that both companies have to. Unions destroy efficiency and drive up costs (and through that prices) by demanding wages higher then what a worker's productivity would justify.

If the current law were changed to bring both companies under the same rules it is true that it would increase the competitiveness of the industry but overall it would decrease the efficiency and increase the costs of production for the shipping industry as a whole.

UPS is not asking for a bailout. FedEx is trying to keep it's special provisions in the FAA bill. FedEx does not want to play under the same labor laws that ALL the other express delivery companies must follow.

If FedEx is wrong to have all of its integrated delivery network under the RLA, then why did UPS previously try to get its air express company under the RLA? UPS failed to do so, due to union pressure and the government not agreeing that UPS's network is integrated in the same way as FedEx's. So now UPS is trying to get congress to change the rules and disrupt FedEx operations for UPS's benefit.

You can't take a job and say "I'm worth more than this", because if you were, you would have a job getting paid more wouldn't you? I'm going to side with UPS on this one, the RLA is an obsolete piece of legislation that FED Ex uses to undermine the union aspirations of its workers. Over the road freight movements by Fed Ex should be governed by the NLRA not the RLA, unless of course they are moving on a flatcar or flying through the air. Fed Ex's manipulation of their business model is coming back to bite them in the ass and it serves them right.

You are referring to a FedEx smear campaign resulting from UPS's insistance that both companies be classified under the same labor laws. Now I could see some common ground if we took all employees that work at an airport and governed them under airline laws, and all non-airport sorting hubs as just that, non-airline personnel. That makes more sense to me and would still leave FedEx in a better position since they are mostly airline employees but still equal rules for both companies.

Only EXPRESS (the AIR division) is what's being draggted into this Bill..by UPS.! From what I have read/heard on this FedEx is working under some very old rules and UPS wants them to follow the same rules that UPS is aready following. That does not sound far reaching to me...
Also, FedEx is the one who is teamed up with the USPS and last time I checked they are part of the US government.

As a businessman myself, UPS has provided my shop a much better service to our area than FedEx. I have had to do refunds, put up with delays, drive a half hour to pick up a package that a driver refused to deliver (because he didn't "want" to stop in our area during clearly posted business hours)... and the most horrible customer service the shipping industry can provide through FedEx.
I'd gladly pay my taxpayer dollars to help a company like UPS, if they needed it.

@MrSirBadass There is no union at fedex. their air and ground are different companies. the overnight driver can't take your ground packages. the ground delivery people are independent contractors. they pay their own expenses, such as maintenance on the trucks. they pretty much don't take any days off. they would have to pay someone else to cover for them.

I work at ups, we wrote our gongress man to change fedex's contract laws. They are under the RAILROAD ACT OF THE 1920's when they ship by AIR and LAND. Fedex does not have to unionize because of this, thus saving them millions of dollars. what ups DID DO.....

I don't care who is doing what or who is right or wrong. UPS accused me of being a liar when they didn't deliver a package that they said they did. I wrote my congressmen and signed the petition. I will do anything to help put them out of business. UPS is just an ugly monster at the core of their business. When I order online I don't buy from places that ship UPS. I often times pay an extra $20 to have something overnighted just so it will be sent FEDEX.

How does a company classify employees who don't work near a railroad or airstrip under the Railway Labor Act? While UPS may stand to gain from this, so do many FedEx employees.
Think about it, or just look up "Brown Bailout" on Wikipedia.

@rasldf The reality is UPS could have structured their operations in a way that their express delivery operations would also be included under RLA. However, they chose in the 1980’s to outsource their express delivery to their existing Ground drivers (which fall under the NLRA). When they realized their mistake in the 1990’s, they sought to be reclassified under the RLA, but were forced to drop their case by massive Teamster pushback.

Reguardless of anything, BOTH companies deliver packages to the customer by a TRUCK, right? Wow fedex is full of crap. I can't believe how misleading this ad is. UPS gets paid because we work really really hard. I've worked for a few different places. I've never seen a more hard working place then UPS. I work tonight. And every guy will be covered head to toe in sweat. Like they jumped in a pool. Shirt completely soaked. The drivers get slammed everyday with stops. Most can'l even see or walk through there trucks in the morning. Stop the lies fedex

There is NO bailout! This is a play on words. Fed Ex is a master of this. Don't believe them! Believe me, anything Fed Ex wants only benefits Fed Ex. They have been hiding behind this out dated law for over 30 years. Fred Smith is scared to shitless about the union getting into Fed Ex because he know that he will have to pay his employees better and make it so it doesn't take a million years to get to top pay. Thats why they have spent over 23 million dollars to spread this crap!

@irishamerican8790 - Sorry, you are mistaken. FedEx Express, FedEx Ground, and FedEx Freight are all separate companies. The Ground and Frieght companies are already under the same legislation as UPS. Only the Express company is under different legislation because it is an AIRLINE. FedEx and UPS worked together several years ago to try to get the airline segment of UPS under the same legislation as FedEx, but it didnt work out. Now UPS is trying to disrupt FedEx operations.

UPS offers more benefits to their workers than FedEx does. The pension plans are better and the health benefits are better. And in the right-to-work states they give you the option whether you wanna join the unions or not, you dont have to. FedEx pays very little, they make you work on weekends and fire people left and right just to make sure they are making their money quotas for the quarter. UPS is a 5 day a week job with great benefits. Stop whinning FedEx

That's not to justify what FedEx is doing, what I mean is that UPS is going about this the wrong way. UPS should be trying to get the current laws should be changed so that neither company has to deal with powerful unions, not be trying to change the current laws so that both companies have to. Unions destroy efficiency and drive up costs (and through that prices) by demanding wages higher then what a worker's productivity would justify.

@finlandia420 If you really did produce enough to justify your salary then you would be paid as much as you are now absent a union and have no need for a union in the first place. The very fact that a union exists proves that you are driving up prices for your own benefit at the expense of the consumer. There would be many more jobs in all the industries that ship packages if package shipping rates were even a few cents cheaper. Next time try economic reasoning instead of nonsensical babbling.

If the current law were changed to bring both companies under the same rules it is true that it would increase the competitiveness of the industry but overall it would decrease the efficiency and increase the costs of production for the shipping industry as a whole.

UPS is not asking for a bailout. FedEx is trying to keep it's special provisions in the FAA bill. FedEx does not want to play under the same labor laws that ALL the other express delivery companies must follow.
All truck drivers should fall under the NLRB and not the RLA.
Anybody else wonder why the "brownbailout" video poster will not let you comment. It's because they are afraid of the truth.

@hwy666 Wrong, totally. The RLA exists to protect integrated delivery networks. If FedEx is wrong to have all of its integrated delivery network under the RLA, then why did UPS previously try to get its air express company under the RLA? UPS failed to do so, due to union pressure and the government not agreeing that UPS's network is integrated in the same way as FedEx's. So now UPS is trying to get congress to change the rules and disrupt FedEx operations for UPS's benefit.

fedex was in big trouble for treating thier subcontractors as employees and government got involved fortunately for those mistreated.Fedex is a very manipulative and deceiveing employer to those who aren't aware of what they should be doing.They try to maintain an impressive image through media contributions,in movies,etc.Anyone who knows labor laws quickly realizes how pathetic of a company they are.Happy to have quit this greedy,shameful company.Didn't take long to realize thier ways.

It actually would put both UPS and FedEx under the same labor laws because as of right now FedEx is under the RLA act which entitles them to withhold their employees from unionizing and possibly striking. Which in turn would obviously cost FedEx a lot of money because they would have to pay there workers what their worth in both wages and benefits.

@flossmore17 If a person agrees to do a job for X amount of dollars, they are getting paid what their worth because they and the employer agreed on the wage. You can't take a job and say "I'm worth more than this", because if you were, you would have a job getting paid more wouldn't you? I run a pack and ship store and the FedEx guys are harder, more disciplined workers than the UPS guys because the UPS guys have a union to protect them when they get lazy.
