EVeryone has an option to drive a car or not so no requiring someone to buy car insurance along with the car is not unconstitutional. But no one has a choice about being alive, so you can't mandate they carry or buy health insurance.
As to whether or not having a national health plan brings us into the 20th century or not I couldn't care less, nor could I care about most of it, I already have socialized medicine with the V.A., But I do stand up for the constitution which makes no provision for the Democratic leaders violating people constitutional rights by demanding they buy into the national health care system. So they better go back to the back room and figure out how to do it without a law requiring everyone to have it.
We have public schools, libraries and even a US Mint, none of which are in the constitution. Implied powers, people. If you hate those, you pretty much have to give up the entire Louisiana purchase. Or how about the pursuit of happiness? When one is wiped out financially because they or their spouse or their kids or their parents got sick or injured, they aren't spending money on cars, or stock or whatever actually makes this economy run.
Actually all of those things except the Libraries has been added as amendment to the Constitution. The libraries aren't Federal in any way except through funding and that is spotty at best through humanities funding usually distributed to states with attachments to other bills.
As for the pursuit of happiness, feel free to pursue it. But happiness isn't guaranteed only the freedom to pursue it.

If one wishes to drive a car, you CAN choose not to have insurance, but driving without it is asking to be pay thousands for minor altercations. People have a right to live, absolutely, but they should not have their care in the hands of businesses who will screw you because of "preexisting conditions" like acne, or deny you life-saving medical care because the insurance you have now doesn't cover transplants or even just second opinions. That's the care we have RIGHT NOW and it's NOT WORKING.
Those who choose to drive a car without insurance are breaking a law that is valid constitutional. Making a law that everyone must buy health insurance is unconstitutional on it's face. There is no provision affording any branch of the government that power. Thus any act to pass such legislation will be an over reach by it's proponents.
Just because what we have now isn't working, doesn't justify breaching the constitution.
You know, I don't think it is a bad idea re-working some things like health care. But it will take time and patience with well thought out planning to not only avoid a breach of the constitution, but to actually make it work for everyone. Unfortunately the Dems. are desperately tryoing to pass anything in order to prove their not as crazy as they appear.

Be that as it may, I can see how requiring people to purchase a product or service from a private company is at the very least setting bad precedent. Whether it would actually be "unconstitutional" I'm honestly not sure (what part of the constitution would it violate?). But this is why we need at least a "public option", or better yet our own NHS.

There are plenty of federal offices, institutes and programs--in both the executive and legislative branches--the tasks of which are not *specifically* outlined in the Constitution, but which could be construed as falling under one of the general mandates of the government outlined therein, or even as simply carrying out the will of the American people. Those aren't "unconstitutional". E.g., the CDC, Student Loans, National Weather Service
In all fairness you can't compare apples to oranges. Just because the Federal government decides to implement a program is not the same as mandating a federal program. Are you or anyone being mandated to take part in any CDC program ? What about Student Loans, any laws that you know of that every American must take out a Federal funded student loan ?

Many, many years before this bill ever see implementation if ever ! That means they'll be collecting the tax money with no strong box to store it and will instead be free to spend it willy nilly just like they are trying to do with the stimulus money which should be getting applied to pay off the debt. The ten years starts 2011 but the actuall spending of the bill starts in 2014. If you took ten years 2014 to 2024 you would find the bills actuall cost is double. They need the numbers so they lie. their cost is only for 6 years.

They have socialized systems. All are facing rising cost and dealing with it by rationing care, restrictions on choice of Doctors and other barriers. Example Canada you may wait 8 months or more for knee surgery. UK at any given moment there are 700,000 people on waiting list for surgeries. Some of them are now introducing more market oriented features. They are moving to free market while we are moving to more Gov. We have the highest quality care more Gov. will destroy that. We need less Gov.
The two examples you cite must be purely anecdotal. Rising costs are universal, but whatever you've heard from whomever, having lived in the UK (and thereby covered by the NHS) and having friends who are British physicians with whom I have spoken very recently about this topic, it is not the case that the UK is "rationing care", moving toward "free market" healthcare, that the waits are unnecessarily long, etc. We (the US) do not have the highest quality *for the best price* or *the most people*
It was the republican party that brought in part D in medicare. Which by the way cost all of us. People don't seem to understand that the Gov. sets the prices for 1/2 the healthcare sector directly and the other 1/2 indirectly. They control production and consumption. They have done a BAD job of keeping cost down. This bill is more of the same and will raise cost on middle incomes the most.

There is nothing in these bill that would put healthcare dollars in hands of consumers that would drive down prices. These are just an expansions of a failed Government system like medicare which is broke. Be prepared to have MICA taxes triple over the next few years.
Price gouging and lack of competition in the industry is due to Healthcare industry paying off politicians to pass legislation that benefit the industry at the consumers expense. That is why they won't allow purchasing across state line. That would give millions access to affordable care. A plan in Kentucky cost $450 month the same plan in Ma. is $1200. Think if we all could buy to the Kentucky plan the others would have to lower prices. You could choose frm 100s instead of the few in ur State

Sorry classicphile, for-profit health insurance companies come much closer to death panels than the democratic provision for reimbursing end-of-life counseling. When my son had lymphoma, the denials were automatic. Automatic. Each one had to be contested. His little friend at the clinic, Tara, had to leave treatment when their insurance was completely canceled. She died while her parents were trying to get her into St. Judes. If that's not a death panel, what the hell is?
No, they do not come closer to death panels. Public health entities do alot more denying than the for profit health insurance companies. If this bill goes into law, you will find the number of denials going up, not down. And there's more to "death panels" than just "death counseling". (that is assuming death counseling is included in this "reform"...im getting conflicting messages)

The GOP had the power in Congress for 15 years, and could have reformed health care their way. Instead they did absolutely nothing and sat by while the system deteriorated with exploding costs and exploding number of uninsured.

There is a "Health Care Panel". It's in the bill, Sheldon. The panel would review 3 areas before determine whether a person is treated.

We have public schools, libraries and even a US Mint, none of which are in the constitution. Implied powers, people. If you hate those, you pretty much have to give up the entire Louisiana purchase. Or how about the pursuit of happiness? When one is wiped out financially because they or their spouse or their kids or their parents got sick or injured, they aren't spending money on cars, or stock or whatever actually makes this economy run.

Actually all of those things except the Libraries has been added as amendment to the Constitution. The libraries aren't Federal in any way except through funding and that is spotty at best through humanities funding usually distributed to states with attachments to other bills.
As for the pursuit of happiness, feel free to pursue it. But happiness isn't guaranteed only the freedom to pursue it.
There are no implied powers, only those spelled out by the Constitution or by amendment.

If one wishes to drive a car, you CAN choose not to have insurance, but driving without it is asking to be pay thousands for minor altercations. People have a right to live, absolutely, but they should not have their care in the hands of businesses who will screw you because of "preexisting conditions" like acne, or deny you life-saving medical care because the insurance you have now doesn't cover transplants or even just second opinions. That's the care we have RIGHT NOW and it's NOT WORKING.

Those who choose to drive a car without insurance are breaking a law that is valid constitutional. Making a law that everyone must buy health insurance is unconstitutional on it's face. There is no provision affording any branch of the government that power. Thus any act to pass such legislation will be an over reach by it's proponents.
Just because what we have now isn't working, doesn't justify breaching the constitution.

I take your point that in the best metro areas in the US (though not in rural areas), one doesn't have to own a car, so it's not a perfect analogy.
Be that as it may, I can see how requiring people to purchase a product or service from a private company is at the very least setting bad precedent. Whether it would actually be "unconstitutional" I'm honestly not sure (what part of the constitution would it violate?). But this is why we need at least a "public option", or better yet our own NHS.

There are plenty of federal offices, institutes and programs--in both the executive and legislative branches--the tasks of which are not *specifically* outlined in the Constitution, but which could be construed as falling under one of the general mandates of the government outlined therein, or even as simply carrying out the will of the American people. Those aren't "unconstitutional". E.g., the CDC, Student Loans, National Weather Service

Example Canada you may wait 8 months or more for knee surgery. UK at any given moment there are 700,000 people on waiting list for surgeries. Some of them are now introducing more market oriented features. They are moving to free market while we are moving to more Gov. We have the highest quality care more Gov. will destroy that. The two examples you cite must be purely anecdotal. Rising costs are universal, but whatever you've heard from whomever, having lived in the UK (and thereby covered by the NHS) and having friends who are British physicians with whom I have spoken very recently about this topic, it is not the case that the UK is "rationing care", moving toward "free market" healthcare, that the waits are unnecessarily long, etc. We (the US) do not have the highest quality *for the best price* or *the most people*

People don't seem to understand that the Gov. sets the prices for 1/2 the healthcare sector directly and the other 1/2 indirectly. They control production and consumption. They have done a BAD job of keeping cost down. This bill is more of the same and will raise cost on middle incomes the most.
Both parties are guilty of passing legislation that benefits the industry at our expense as is this bill.

I get tired of the Democrats constantly trying to project their worst faults onto the Republicans.
I'm an Independent and think Congress should all go home, take a break and enjoy Christmas with their families! Perhaps a break would allow a week or two for reflection and consideration rather than this, "We have to push this through or we all will die fear tactics."
I agree that improvements are needed in Health Care, like stopping price gouging from Pharmaceutical Companies.

They haven't got a final bill yet. But it doesn't matter because all the proposed bills are higher taxes on middle income and will drive private premiums up. There is nothing in these bill that would put healthcare dollars in hands of consumers that would drive down prices. These are just an expansions of a failed Government system like medicare which is broke. Be prepared to have MICA taxes triple over the next few years.

Price gouging and lack of competition in the industry is due to Healthcare industry paying off politicians to pass legislation that benefit the industry at the consumers expense. That is why they won't allow purchasing across state line. That would give millions access to affordable care. A plan in Kentucky cost $450 month the same plan in Ma. is $1200. Think if we all could buy to the Kentucky plan the others would have to lower prices. You could choose frm 100s instead of the few in ur State

This is a good point. Very few sets out to commit political suicide on purpose (some do it even thought they know it will cost them their seats). But many politicians that have done exactly that: committed political suicide one way or the other. I really think some dont care. Obama wants his legacy. Let someone else deal with the financial mess. He'll be long out of office by then.

No. Palin didnt say there are not. She said that the two words "death panels" didnt specifically exist in the legislation, but she reiterated that "committees, bureaucrats -- deciding who, ultimately, will receive government-run health care"

Sorry classicphile, for-profit health insurance companies come much closer to death panels than the democratic provision for reimbursing end-of-life counseling. When my son had lymphoma, the denials were automatic. Automatic. Each one had to be contested. His little friend at the clinic, Tara, had to leave treatment when their insurance was completely canceled. She died while her parents were trying to get her into St. Judes. If that's not a death panel, what the hell is?

No, they do not come closer to death panels. Public health entities do alot more denying than the for profit health insurance companies. If this bill goes into law, you will find the number of denials going up, not down. And there's more to "death panels" than just "death counseling". (that is assuming death counseling is included in this "reform"...im getting conflicting messages)

Sir, when I went to my Doc a few months ago and there was some to meat me that was not my doctor and he prescribed changes that did not go well. We do have two scales and there a truth but who has it? A judgment for based on Truth can be a bit or byte one way or another by choice and sometime that choice is flawed or overshadowed for wrong reasions. Maybe Bill can tell you what you need to know. The GOP had the power in Congress for 15 years, and could have reformed health care their way. Instead they did absolutely nothing and sat by while the system deteriorated with exploding costs and exploding number of uninsured.
In the last year, instead of joining the debate in order to shape bill to their liking, they started a smear campaign beyond the pale of anything we've seen in political history. I'm not shocked by a lot of things the GOP does but "death panels" was surprising for me.
