  • Way to go! I was about to complain. Why can't they just make the streaming brower better? Instead of having to modify the movies all over again. Have a professional streamer that could automatically detects voices and others.

  • It's ironic that you're doing exactly what you're suing Netflix for: Not providing CC/subtitles.

    Not everyone understands ASL. so it would be nice if you could provide subtitles so that non-deaf people can understand what's going on as well :)

  • Sooo, this lawsuit essentially argues that deaf people are lazy bums who refuse to go to the mailbox to pick up a DVD, it seems. The DVD plan that Netflix offers is a completely reasonable alternative to the streaming service. Even if federal law DID cover this(it doesn't), the DVD plan would mean that Netflix is giving the deaf more than enough options to see their movies with captions. More so than streaming, which consists of a very limited amount of the total number of movies available.

Just cause you can hear and can watch streaming movies or tv shows any time you want and we can't have equal rights to do the same? Also we are paying for netflix why can't we also have same rights to watch movies steaming too. I would have to disagree netflix is not providing reasonable solutions the only reason the DVD have subtitles is because of ADA law not because netflix wants to. thumbs up if you agree with me

  • Netflix has claimed 30% captioning since February but had no hard data to back it up. Through Phlixie & my own blog, using data from Netflix's own API, we discovered in February the actual percentage was closer to 10% and only THIS WEEK (4 months later) has their percentage reached 30%.   • Deaf are not to be excluded or segregated from "goods and services" that are available to all others unless it fundamentally changes the intent of the goods or services provided or is considered a financial burden on the company. Netflix is far from a small company where this would become a burden and these captions would not fundamentally change the service being provided. The ADA is not about helping the disabled but about civil rights. Hearing people are entitled to equal rights so are we.

  • Netflix on-demand streaming does not fit the definition of a "public accommodation" in any way shape or form. It doesn't fit the specific definition as laid out in United States Code: Title 42,12181. This pretty much amounts to public relations blackmail by a pressure group with an obvious vast sense of entitlement. They know full well that Netflix will probably end up complying, not because of the legal merits of the case, but because they want to avoid bad publicity.

    Absolutely pathetic.

  • This is ridiculous for NAD to sue Netflix in this capitalist society. I see it as a GOLDEN opportunity for anyone to start a net streaming company to provide captioned contents over the internet not just for the deaf, but their hearing families like mine who don't subscribe. Regardless, Netflix is continuously improving but as a consumer, I'll wait until they win me over. My wife & kids (all hearing) do activities where no one would be left out anyway. NAD, you DON'T represent me! Lay off!

    too due to my poor hearing. Another reason for me not to use Netflix. :(

  • DVD special features, DVDs, movies theatres ( all screens in one location anywhere ) and TV movies , too must be on closed captions at all times !! I am pretty sure Deaf communities everywhere in North America and rest of the world are very very very fed up and tired of waiting why there are no captions in movies for long damn time . today is 2011 ?? are we caveman or what ?? Enough of craps !! Time to do action !!!

  • I am a Russian and I have decided to sue Netflix and all the movie studios for discriminating against me and all my Russian speaking buddies. How dare they only produce movies for English speaking peoples. This is unacceptable because my Russian children can not sit down and watch a movie with their English speaking friends.

    Look people here's the way it works. You don't like a service and you feel like they are not providing you what you want. DON'T PAY FOR IT.

  • @yodafunk Also, Netflix isn't the only game in town. If this were some necessity to your quality of life, I could understand the lawsuit, but this is one of MANY movie watching options. Are you going to sue the theatres for not subtitling the big screen? Are you going to radio stations for not having brail print out as the song jams along? You are deaf and for that I am sorry. Its unfortunately that you live in a hearing society. This is why it is called a disability.

  • @yodafunk The goal is to remove the word "disability" since it means broken or incapable which is erroneous. Deaf people can do ANYTHING you can, except hear. Any sensible person will remove a hurdle in the road, which is what they have been trying to do for too long. You should also know that when the deaf attempted to sue the phone company (couldn't call 911 and many died) Pac Bell in the end benefitted with 10% profit jump.. Netflix also will reap benefits at the deaf's expense.

    Except that by definition being deaf means that the person is either wholly or partially "INCAPABLE" of hearing. That their sense of hearing is not functioning properly, which is again by definition, "BROKEN".

    It's nice that deaf people see themselves in a positive light, but that doesn't suddenly make their ridiculous illegitimate civil rights lawsuit legitimate.

  • @yodafunk It is why YOU call it a disability. Deafness is not always considered a disability and many other Deaf will tell you that. We once lived in a society that considered homosexuality to be a disease and that has changed. The view of Deafness is changing as well. FYI: Theaters do provide movies with subtitles. Just because you never know about it doesn't mean it doesn't exist.

  • I used to subscribe Netflix for couple of years until I notice more, more inaccessible - even Netflix refused to reduce the cost for my membership, especially there was no CC on xbox. There was (and still I believe) NO CC for xbox, which xbox now provides free movies for all Netflix members. I was a member and had a xbox - they still refused to provide CC. They told me, "I can only use DVD!" So I cancelled my membership with Netflix.
