Alright this guy is Bullshit! I ran my own private server before and the rule state that if you make ANY profit at all you have to split it with blizzard of course blizzard getting a bigger % ... Private server are for the people who really cant afford the 15$ a month or who just enjoy the outrageous damage / gear upgrades - So no Private servers are not a waste, Blizzard IS making money from these top rated servers and people DO enjoy playing the WoW servers.

Well Ive tried quite a few Private servers and can honestly say Blizz has nothing to worry about. The quality of game play falls well short of retail. Some are just flat out horrible. Very unstabble. custom realms with huge npcs all over the place. more like playing make-believe circus. Id bet most are made by kids who havent even reaches puberty yet.

No early ZG - Classic order of releases. No stupid corrupt GMs and slacky devs. Population growing daily, but it's pretty much brand new and people still leveling to 60. Really great feel and I suggest this new realm to anyone.

The above applies equally to a lot of software out there, not just WoW. If they ban your account, that means you violated the ToS that you agreed to, so you no longer have the right to use the copy of the software that you bought. So if you want to use the software, you must buy another license. (Note that I'm not a lawyer, and a lot of this stuff is clearly spelled out in the "license agreement" that all software comes with that hardly anyone ever reads.)

A server called scape gaming got shut down and sued by blizz for over 10m because the server made over 12m from selling virtual goods on theere server. blizz won and the owner of the server spent jail time because 12m she made from the server was spent on a house car and many more things, So she could not pay blizzard.

You are you using someone else's copyrighted software without their permission, so yes. That said they will go for the server and shut it down and those making money. Its unlikely they'll go for the actual players, although they reserve that right if they want. Were they to go for you i would guess you'd would hear from it first via you ISP, slim odds

One note is that, I think you're in the clear if you're just playing on a private server. For those of you who play once in a while or have been interested in trying. However, hosting a private server or even setting up a repack [Trinity or ManGos], are definately in a risky zone. Like Markee states here, whenever Blizzard decides to take action against these servers. It's mostly towards the + 50.000$ a year servers. That they make via donations. No signs of catching people who just play though.

Not one console game makes you pay monthly TO USE the product you already payed for. @Sauby02 What a lot of people don't understand about software is that when you go down to the store or go online and buy a copy of the game, a small fraction of that cost is to go for the packaging and distribution of the software, but the vast majority of the cost is for the LICENSE to USE the software. It does not give you the right to use the software however you want. The monthly fees are for server upkeep and - you guessed it - license to continue to use their servers and the software.

I played on private servers for 2 years. Since WotLK, scripting outruns all private servers and makes the game very complicating. Those private servers cant keep up anymore unfortunately.

I think it interesting that private servers are a violation of copyright, granted I dont think people should have the right to play on a private server if they never bought the game but if you did purchase the game and all the expansions that go with it it seems to me that you should be able to play on a private server instead of being forced to pay monthly to play the game that you bought (Since the only "Legal way" to play wow is on there servers) then a private server should be legal.
