Rehabilitating a man that has wounded 80 and killed 13 so he can; again walk among us, is not justice. Facing the people that he has directly hurt and having them decide his fate, is justice. Having the system carry out the wishes of those victims; good or bad, is justice.

There was a guy in Texas that was executed for burning down his house while his two children were in it. His lawyer, interviewed after the fact thought he was as guilty as sin and was simply ensuring that procedure was followed.

Rehabilitating a man that has wounded 80 and killed 13 so he can; again walk among us, is not justice. Facing the people that he has directly hurt and having them decide his fate, is justice. Having the system carry out the wishes of those victims; good or bad, is justice.

I think the point Silveracity is trying to make is that although soldiers are asked to kill each and every day, they can and should be brought back into society, even though they are deadly killers. Similarly, Hasan could be rehabilitated.
I don't agree with this point of view, because it ignores motive. The soldier under orders has different motives (especially if being shot at) than someone like Hasan who premeditated murder. However, it could turn out that he's simply crazy.

The Uniform Code of Military Justice does not guarantee all of the same rights and privileges afforded civilian criminal going through trial.
And I have not heard that Hasan was ever tortured or abducted. From what I know, his lawyer has seen him, so habeas corpus doesn't apply.

Defending is not just about proving innocence and in this case Hasan's guilt is unquestionable. Defense is also about presenting to the court state of mind, intent, and circumstances. These greatly influence and shape the kind and severity of the sentencing. Defense lawyer might actually convince Hasan to plead guilty and save the victims' families the ordeal. There was a guy in Texas that was executed for burning down his house while his two children were in it. His lawyer, interviewed after the fact thought he was as guilty as sin and was simply ensuring that procedure was followed.
Turned out the guy was innocent. The fire inspectors that convicted him didn't know wtf they were talking about and every expert than has been asked said the guy didn't start the fire. Texas executed an innocent man.

Some defendants are obviously guilty ahead of time, but our Constitution grants all citizens full and fair due process of law. Defense attorneys ensure that due process is carried out.

really, if you start down a road of not providing fair trail for some who are guilty, one day someone who is innocent doesn't get a fair trial and then justice is completely dead. with law, precedent is very important.

I say that theirs allot of radically religious people in the military christian and muslim which creates tension in some cases. Both parties are wrong because they're both equally retarded for believing in fairy tales but that aside the bigger evil is the radical islamic people since they kill innocent people and justify it so easily. Presumption of innocence.
Due Process.
Right to an attorney.

It's called the 6th amendment, it's something our soldiers have died to protect. Hasan is gonna get the death penalty, but the 6th amendment is vital to achieve a fair and just court system.

at least thats what the supreme court said when they found that GITMO detainees have habeas rights and must be prosecuted in one way or another....and not indefintely detained without trial...
right now, many of them are at still at GITMO cuz they cant be tried by our courts cuz of all the laws we broke in their detention/interrogation...

The 6th amendment says everyone has the right to Assistance of Counsel for their defence.
I would also hope that everyone reading this presumes that a person charged with a crime is innocent until proven by competent evidence to be guilty.

this is america. its supposed to be innocent until proven guilty and everyone is entitled to legal representation. I fully agree with col. galligan. I understand where blitzer was going on the first question and he let the man address the issue but he just tried to slip that comment in there like it was nothing. Everyone feels bad for the families and victims but this is america for now and people deserve a fair trail.

You are 100 percent right, ajla. I'm sure this guy has a hard time sleeping at night thinking about who he has to represent, but everyone deserves legal council. Look at the Boston Massacre, nobody wanted to represent those men, but John Adams did and most of them were eventually proven innocent. I mean, how would you feel if you were charged with committing a crime you didn't and your legal representative answered Wolf with "Yeah, this guy is definitely guilty, I shouldn't represent him."
