well legally by state definition but for arguments sake I'm going to say that under medical marijuana law you are supposed to keep everything private on your own property. even though he is just burning the leaves, they still contain THC and he is burning them when he could be composting or making hash. im sure the surrounding neighbors had thc in their bloodstream as a result of burning the leaves but also there were probably little kids and animals who had an effect (oh think of teh children!)
