  • The fact that the cops could smell the drugs coming from the house/apt i would say they had probable cause. Possession and smoke weed is a crime (not that i think it should be) Its like saying so what if there's a meth lab next door. He might have also put the rest of the residents at risk if he was trafficing drugs as well.

  • they don't need a warrant. It's called the "plain view exception" which means that if an officer is in an area where he or she has legal right to be and can detect with any of the senses (mainly sight- hence the "view" part but also smell or hearing) they can enter without a search warrant. i really don't agree with the marijuana laws but this is sort of an open and shut case because it was a supreme court decision that made the rule in the first place. Hopefully they'll overturn it though.

    With cases like this it looks like the people of the colony are kissing goodbye to their liberty and handing over all their rights to the police mistakingly thinking it is in their best interest.

  • I agree that marijuana should be legalized and that people who are in jail for JUST smoking marijuana should be released, key word JUST. If you have a problem with the police going after marijuana users, than write your politicians at the federal/state/local levels and demand that they decriminalize marijuana, because we live in a society were politicians "guided by lobbyists" make laws and the police enforce them. If we legalize marijuana, the drug cartels will turn into the tobacco companies.

    Of course not. Just people who smoke pot. The only reason that there are drug dealers who deal in pot is because it's illegal. Bootleggers have a hell of a lot harder time getting money these days than some years ago because now alcohol is legal, & now that it's not, I've seen bootleggers busted left right & centre for years.

    The problem is the fact that weed is illegal, and thus, there's more profit to be made form it for the morally wrong kind of people.

  • @Darquine I agree that Pot should be legal, but tightly regulated. Even in the Nether Lands there are tight restrictions on where and what quantity you can smoke Pot. The reason is because it is bad for you. Yes it helps people who have diseases, but a lot of drugs that help sick people " morphine, prescription meds" are bad for you when you use them recreationally. Yes legalizing Pot will cut down on the amount of money for gangs, but after prohibition ended they moved on to weed, so whats next

  • Police can smell marijuana anytime they want. The did it t0 me back in 1975 while i was driving down the interstate . I made the mistake of glancing at the parked police cruiser as I went by and they came after me. they stopped me and when i opened the window the first thing he said was "I smell marijuana", and me and my wife and car was searched. There was no marijuana and it was never smoked in that car. Police lie routinely- part of the job. My old man was a cop and he told me so.

    Also international trade should be controlled by a doctrine of FAIR trade rather than the system of "Free trade" Which allows corporations to exploit poor countries.

  • One clarification; the point of the 4th amendment isn't to protect someone who's guilty of a minor crime. It's about protecting the innocent from invasive practice.
