The fact that the cops could smell the drugs coming from the house/apt i would say they had probable cause. We should just burn the Constitution, if the government or law-enforcements do not follow it themselves. It is useless if the people who writes the amendments and swears to follow and protect it is immune to the rules and laws that governs our nation.
The question is: Are these PIGS certified by the state or city and have they gone through a training course to certify them to use their nose as a legitimate marijuana sniffing PIG? If they do not have the certificate proving completion of the course authorizing their PIG nose to sniff or make judgement, then NO! This man is free, just like if you get caught speeding and that radar PIG is not certified by the state or city to use the radar scanner, then you win the speeding ticket.
The Cop's are very Cunning now if you are going it by Hydroponics all the Law has to do is check Your power Bill Bacause you have to use Hell a lot of Electrical power to grow your Pot So Watch out. If I had the money I love to buy a Large Big House with a Large Sun roof in one big room You know it like having a giant window on the roof it helps to bring sunlight in doors that way I could grow any thing I like I got my fingers crossed.
Weed never hurt nobody so why the fuck and we smoke it if we choose to without being controlled and forced into prison if we get caught when it's never hurt anybody!? Not even yourself! Why not get this madness over now and legalize it because it has to happen one day.
MARIJUANA ISN'T A FUCKING DRUG!!! IT JUST GROWS OUT OF THE DAMN GROUND!!! If you just happened to burn it, it just so happens to be awesome. It's not a drug. It's nature. You can't fucking outlaw nature. You wouldn't outlaw childbirth or rain, would you? Just prohibit bamboo while you're at it.
This country is turning to shit.the dumbass government always thinks that they are making the right choices for us but there actually fucking things up.this us not a free country.if people tell you that they are wrong yea we can vote and have religion rights but that is about how far freedom rights go in this country.man theres all kinds of murder and rape going on right now as we speak but instead a couple of limp dick morons decide instead to illeagally break inside a innocents persons house
you can go into any market in the U.S. and buy cancer sticks and retard juice if your over 18/21 yet you cant smoke a harmless herb in the privacy of your own residence
The guy got 11 years for a reason, he must of had a lot of marijuana in his possession, and was likely dealing. Cenk, marijuana is illegal, i don't understand why you think that it shouldn't be enforced when someone is using it in their home. If a person breaks the law, they have to deal with the consequences if they get caught.
@Nick1989 Laws that are unjust and that should not be laws are supposed to be nulled. Even if he had the most pot ever found the bust has to be thrown out. It was an illegal entry. Basically the cops invaded a house and then claimed because they are cops they can do this legally. Bull sh*t. things like this are the precursor to more tyrannical behavior.
It is exigent circumstances. The man was breaking the law-please note that I am for the legalization of marijuana. But while it is a crime, the police did nothing wrong. And of course you can't go get a warrant and then come back looking for the pot. That being said, 11 years is insane. Come on, get real, six months tops.
@genungapearl why can;t you go get a warrnt and come back??? Pot heads are so laid back anyway, they won't even attempt to destroy evidence. If anything, they would try to hide it. It would be found. They would be legal in their bust and it would stick. No warrant, no bust. Scalia is a f**ing piece for that bit of tripe. When asked why the war on drugs continues, the answer Hillary Clinton gave was "there is just too much money to be made with it." Nothing about helping anyone or the public.
please tell me that guy is not actually going to jail for 11 years for smoking. whats wrong with this country? and how much worse will it get in the future?
FUCK THE GOVERNMENT 11 years is a long time i dont care what they say, i bet not one of those politions could take the punishments they dish out. weed is not that bad
Sounds completely constitutional to me. The noise of a toilet flushing in relation to drugs can lead to 'destruction of evidence'. Scalia is a pimp. The most thoughtful and sometimes hilarious opinions to read.
The punishment may not fit the crime, but the underlying law which made the arrest legal is sound.
What sound could they possibly have heard that would indicate evidence was being destroyed... Other than, you know... *puts fingers to lips and inhales*... Its amazing what lies will hold up in court these days...
Sometimes I never think politely campaigning to get pot legalized never works. Sometimes I predict violent wars on the arresting of victimless criminals will however occur.
they don't need a warrant. It's called the "plain view exception" which means that if an officer is in an area where he or she has legal right to be and can detect with any of the senses (mainly sight- hence the "view" part but also smell or hearing) they can enter without a search warrant. i really don't agree with the marijuana laws but this is sort of an open and shut case because it was a supreme court decision that made the rule in the first place. Hopefully they'll overturn it though.
11 years just for smoking some pot! I hope I heard that wrong?
I've always envied the colonies for their Constitution........freedom of speech, right to bear arms (bit iffy on that one), no cruel and unusual punishments, protection from illegal searches and a right to reasonable privacy.
With cases like this it looks like the people of the colony are kissing goodbye to their liberty and handing over all their rights to the police mistakingly thinking it is in their best interest.
@19996669991 There are no freedoms. Now, you can't even voice your opinion about our fucked government because it goes against the "patriot" act. The founding fathers were rebels ! They fought against facism they rebeled against tyrrany and founded this country. You do that now and you're an enemy of the state, unpatriotic. blah blah blah. One of these days you are going to wish you had a gun in your hands. Don't expect anyone to protect you. Call 911 by the time they get there you're dead
Fuck I didn't want to comment but I have to say this. We ALL know weed isn't good for you, that it is a drug and is bad in large quantities having said that, cigarettes are WAY worse to your health and addictive and so is alcohol. A person can smoke as much as they want, but harsh restriction on the weed, this drug FUNDS gangs. Legalize it & tax it & let people out of jail if you just caught them smoking it. less money wasted on prisoners, more money from taxing it would fix the states deficits.
Jct: Stop making fun of the judge who said having marijuana is criminal. It is. You don't like it, I don't like it, but that your law so lump it or change it. Constant bitching about how terrible it is for people to enforce your laws isn't useful, is it, it hasn't helped in 5 decades. Big Pharma wants healthy herb illegal and that's what they've got so quit jawing about what is and change it.
I always thought telling the police to politely stop their heinous unjust actions of kidnapping people of victimless crimes and imprisoning them is not solving anything.
@RyunSharp If they are allowed to search your house than 9 times out of 10 there is a good reason. Arrest is only temporary, so suck it up. If it get scum bags off the streets, than I am O.K with the Police being rude when they search me or some one else. If you think selling drugs is a victimless crime, remember next time you read/watch some thing on the news that says drug cartels decapitated 12 people in Mexico. And you have to be dumber than a brick to not know drugs are bad for you.
@acdc30450 Your full of shit. Marijuana victims get way more punishment than other criminals and are a majority of the USA prison cells.
Even if the police get rapist and murderers off the street, it still doesn't excuse or redeem them of their constant need to arrest victimless criminals.
Drug cartels exist because we have made drugs illegal. It's not the drugs that are bad, it's the drug cartels that prey on the users because the police are out for them too!
I agree that marijuana should be legalized and that people who are in jail for JUST smoking marijuana should be released, key word JUST. If you have a problem with the police going after marijuana users, than write your politicians at the federal/state/local levels and demand that they decriminalize marijuana, because we live in a society were politicians "guided by lobbyists" make laws and the police enforce them. If we legalize marijuana, the drug cartels will turn into the tobacco companies.
Of course not. Just people who smoke pot. The only reason that there are drug dealers who deal in pot is because it's illegal. Bootleggers have a hell of a lot harder time getting money these days than some years ago because now alcohol is legal, & now that it's not, I've seen bootleggers busted left right & centre for years.
The problem is the fact that weed is illegal, and thus, there's more profit to be made form it for the morally wrong kind of people.
@Darquine I agree that Pot should be legal, but tightly regulated. Even in the Nether Lands there are tight restrictions on where and what quantity you can smoke Pot. The reason is because it is bad for you. Yes it helps people who have diseases, but a lot of drugs that help sick people " morphine, prescription meds" are bad for you when you use them recreationally. Yes legalizing Pot will cut down on the amount of money for gangs, but after prohibition ended they moved on to weed, so whats next
@acdc30450 LOL whut. Take a week off and do an experiment. Smoke pot all day for 3 days. Then drink all day for 3 days. See how you feel after each, and compare.
Police can smell marijuana anytime they want. The did it t0 me back in 1975 while i was driving down the interstate . I made the mistake of glancing at the parked police cruiser as I went by and they came after me. they stopped me and when i opened the window the first thing he said was "I smell marijuana", and me and my wife and car was searched. There was no marijuana and it was never smoked in that car. Police lie routinely- part of the job. My old man was a cop and he told me so.
@duster011 Criminals lie, and to take down criminals, you got to think like one. A lot of people who yell at police brutality seem to not care about getting criminals off the street
@duster011 I agree, we should hold them to standards. It just seems that bleeding heart will bash Police at the first chance but turn a blind eye when dealing with criminals
Love ya Cenk but you're straight weak sauce on this. Why just ridicule this bust for being "in his own home"? Why not also "anywhere"? I can be buzzed as hell at a bar but I can't be blazed? Smashed is OK but not stoned? Why does placing marijuana cigarette cartons at the package store alongside the liquor bottles even pose an issue? The right of privacy is sacrosanct but Cenk could also highlight the essential hypocrisy of weed not being as legally ubiquitous as a can of beer.
well you arnt suposed to shoot cops but we can tourcher here so maybe you could casterate them it would change their minds from aggression against the people they are supossed to protect and serve or do they take that oath anymore?
If the cops heard a machinegun going off they shouldn't need a warrant? If the bacon heard gunfire they would have run like hell. They love the pot busts because the vast majority of pot smokers are docile.
The only way to destroy pot is smoke it, eat it, or flush it. So i can't flush a toilet near a cop without getting the door busted down for probable cause.
Funny how in the USA you can have guns no problem, but you can't have a plant/herb, it's soo fucking backwards. Lets go drink some beers, smoke some cigs, and shoot some guns!, now that's a unhealthy "legal" mixture of doom lol
@KangaKucha so everytime i see police near my house i have to be carefull not ot use the toillete otherwise they will bust my door?....doesnt make sense
Welcome to America, land of the free, home of the brave, the country you can trust to imprison people for life for smokin' some pot! Liberty here I come!
That's right America, warrant-less search & seizure, warrant-less wiretapping, warrant-less assassinations, and secret mass donations of Federal funds to foreign governments. When the fuck are Americans going to realize they live in a dictatorship? Its so depressingly pathetic to still see the vast majority of people uphold this bullshit American patriotism that everything is fine when literally NOTHING is fine. GET OFF YOUR FAT ASSES AND REVOLT YOU LAZY MORONS, THIS-IS-YOUR-COUNTRY!!!!!
@3star2nr Did you know that you're a coward? I would rather rot in jail knowing I attempted to fulfill my duty than sit in my home, cowering in fear, wanting things to change but too fearful to ever consider doing it.
@GooGobbler113 If your revolution was against the big multinational corporations, that profit off of senseless wars and genocide, branded as "protecting freedom". IF your revolution was against the huge corporations that profit off of keeping people sick, overworked, and on the edge of survival I would support you.
If your revolution were against the corporations that invade and plunder poor countries, then label their inhabitants terrorist when they resist I would support you. But it isn't
also if this were a true dictatorship you would be traced and arrested for that very post you just made. Cenk and ana would also be arrested as political criminals just for making this very video.
The fact that they wont be and you will sleep soundly in your bed tonight, then wake up and post stuff like this tomorrow says that you Aren't living in a dictatorship, so stop wishing for one.
@3star2nr I said nothing about killing congress, I said revolt. To replace the current, corrupt "system" and replace it with one who's main interest is the interest of the U.S citizens, not the mighty mighty dollar.
@GooGobbler113 nothing will change man. You'll change the puppets but the masters will put the strings back on
Say you are successful corporations will come in after the dust has settled and go back to business as usual. You and your "patriots" will sit in horror as everything goes back to what it was and you would have given your life for nothing.
You can't win because you can't kill greed.
The only solution is to make some things non profit. And people like you call that socialism
@GooGobbler113 Im not saying all corporations are bad, but war, health care, and matters pertaining to law and order should not be for profit.
Also international trade should be controlled by a doctrine of FAIR trade rather than the system of "Free trade" Which allows corporations to exploit poor countries.
Corporations shouldnt be allowed to lobby congress, the media should be non profit etc.
Unfortunately you are going to call me a socialist and not listen and continue to live in the lie
@3star2nr I'm not going to call you a socialist, I'm going to laugh at you for realizing what's wrong, seeing how things would have to be for it to be right, yet being too cowardly to be able to accept what has to be done for this to happen. Your knowledge of what's wrong with the system is admirable, but your cowardice to what has to be done for these changes to take place is painfully laughable. Why don't you go vote to those who keep it the same to change things? Moron.
Fucking cops...I've had cops do this to me. Sorry to bust the balls of the...like....6 decent cops in the US, but.....FUCK YOU COPS!! It's called discretion, exercise it.
Who is going to buy marijuana, get pursued by police, run into their apartment, and then light it up instantly? You'd have to be pretty damn high already to do something that stupid.
they heard the bubbling of the bong. and Fck this bs it is unconstitutional!!!!!!!!If you support prohibition then you support gangs, murder, human trafficking and countless other crimes which are funded only through prohibition. you also support Rapists, killers, child molesters and other violent criminals being let out of prison early, just to make room for the millions of nonviolent offenders of the prohibition laws. Are we crazy?
To entertain the idea that the police, who are already notorious for violating Basic Human rights, will have another lame EXCUSE to violate people's civil rights is maddening. Where is the Tea Party on this...? Can you Imagine the Bullshit we would be put through if the Cops had the authority to break in your house cause they supposedly smelled Pot, Are you serious...?
11 years? Whew, that's gonna cost the tax payers $330,000.
But hey, why spend that money building a School or catching real criminals when you can put someone in prison for something that isn't really a crime, any way?
5:40 ish - "I smell marijuana; they might be destroying the evidence!" I literally burst out laughing because the thought I had was, hmm....well, yeah, they ARE destroying the evidence, in the sense that once they've smoked it all, it's destroyed. It's gone!
God, fucking cops think they can burst into somebody's house and get them for a victimless crime. I think it's pretty clear that in this case they were just trying to cover up their own stupid mistake.
Were the charges for smoking weed or SELLING it? It was mentionned that they found cash, which leads one to believe that the charges were for distribution.
One clarification; the point of the 4th amendment isn't to protect someone who's guilty of a minor crime. It's about protecting the innocent from invasive practice.
"If you didn't have anything to hide, then you wouldn't mind us coming in"
The inadmissability of evidence collected by violating the 4th amendment is key to maintaining that protection. But ultimately the protection isn't for this guy, it's for all of us.
The fact that the cops could smell the drugs coming from the house/apt i would say they had probable cause. Possession and smoke weed is a crime (not that i think it should be) Its like saying so what if there's a meth lab next door. He might have also put the rest of the residents at risk if he was trafficing drugs as well.

It's like giving police the ability to make up search warrants on the spot for something they thought they smelled at the time. Utterly ridiculous.

Jct: Stop making fun of the judge who said having marijuana is criminal. It is. You don't like it, I don't like it, but that your law so lump it or change it. Constant bitching about how terrible it is for people to enforce your laws isn't useful, is it, it hasn't helped in 5 decades. Big Pharma wants healthy herb illegal and that's what they've got so quit jawing about what is and change it.
kingofthepaupers 1 year ago
I always thought telling the police to politely stop their heinous unjust actions of kidnapping people of victimless crimes and imprisoning them is not solving anything.
RyunSharp 1 year ago
@RyunSharp If they are allowed to search your house than 9 times out of 10 there is a good reason. Arrest is only temporary, so suck it up. If it get scum bags off the streets, than I am O.K with the Police being rude when they search me or some one else. If you think selling drugs is a victimless crime, remember next time you read/watch some thing on the news that says drug cartels decapitated 12 people in Mexico. And you have to be dumber than a brick to not know drugs are bad for you.
acdc30450 1 year ago
@acdc30450 Your full of shit. Marijuana victims get way more punishment than other criminals and are a majority of the USA prison cells.
Even if the police get rapist and murderers off the street, it still doesn't excuse or redeem them of their constant need to arrest victimless criminals.
Drug cartels exist because we have made drugs illegal. It's not the drugs that are bad, it's the drug cartels that prey on the users because the police are out for them too!
RyunSharp 1 year ago
I agree that marijuana should be legalized and that people who are in jail for JUST smoking marijuana should be released, key word JUST. If you have a problem with the police going after marijuana users, than write your politicians at the federal/state/local levels and demand that they decriminalize marijuana, because we live in a society were politicians "guided by lobbyists" make laws and the police enforce them. If we legalize marijuana, the drug cartels will turn into the tobacco companies.

Police are evil...... Nuff said.

@RyunSharp Murderers, rapists, child molestors, gang bangers, drug dealers, pimps, con artists, and muggers good according to you ?
acdc30450 1 year ago
@acdc30450
Darquine 1 year ago
@Darquine I agree that Pot should be legal, but tightly regulated. Even in the Nether Lands there are tight restrictions on where and what quantity you can smoke Pot. The reason is because it is bad for you. Yes it helps people who have diseases, but a lot of drugs that help sick people " morphine, prescription meds" are bad for you when you use them recreationally. Yes legalizing Pot will cut down on the amount of money for gangs, but after prohibition ended they moved on to weed, so whats next
acdc30450 1 year ago

My old man was a cop and he told me so.
duster011 1 year ago
@duster011 Criminals lie, and to take down criminals, you got to think like one. A lot of people who yell at police brutality seem to not care about getting criminals off the street
acdc30450 1 year ago
@acdc30450
In my world view, we should hold police to a little higher standard than criminals.
Thinking like a criminal is a police tool, acting like one is a crime- at least in a better world

@GooGobbler113 You can call me a coward all you want, if it strokes your ego and makes you feel like a man
Fact still remains, that nothing will change your revolution wont do anything but get you and many other's killed senselessly.
The fundamental source of all our problems is the culture of corporate greed, until that's addressed nothing will ever change
People like you are too busy hating the puppets to recognize that the true enemies are the ones pulling the strings.
3star2nr 1 year ago
@GooGobbler113 If your revolution was against the big multinational corporations, that profit off of senseless wars and genocide, branded as "protecting freedom". IF your revolution was against the huge corporations that profit off of keeping people sick, overworked, and on the edge of survival I would support you.
If your revolution were against the corporations that invade and plunder poor countries, then label their inhabitants terrorist when they resist I would support you. But it isn't
3star2nr 1 year ago
also if this were a true dictatorship you would be traced and arrested for that very post you just made. Cenk and ana would also be arrested as political criminals just for making this very video.

3star2nr 1 year ago
@GooGobbler113 We are losing liberties because its profitable.
Corporations own prisons. thats why so many people are in jail
Corporations own the pentagon, this why we go to war.
Corporations control health care thats why we can't afford it
Corporations control politics thats why its corrupt
Corporations want resources thats why we are in the middle east
Corporations own the media thats why we are lied to
What do you think overthrowing and killing members of congress will solve? NOTHING
3star2nr 1 year ago
@3star2nr I said nothing about killing congress, I said revolt. To replace the current, corrupt "system" and replace it with one who's main interest is the interest of the U.S citizens, not the mighty mighty dollar.
GooGobbler113 1 year ago
@GooGobbler113 nothing will change man. You'll change the puppets but the masters will put the strings back on
Say you are successful corporations will come in after the dust has settled and go back to business as usual. You and your "patriots" will sit in horror as everything goes back to what it was and you would have given your life for nothing.
You can't win because you can't kill greed.
The only solution is to make some things non profit. And people like you call that socialism
3star2nr 1 year ago
@GooGobbler113 Im not saying all corporations are bad, but war, health care, and matters pertaining to law and order should not be for profit.
Also international trade should be controlled by a doctrine of FAIR trade rather than the system of "Free trade" Which allows corporations to exploit poor countries.
Corporations shouldnt be allowed to lobby congress, the media should be non profit etc.
Unfortunately you are going to call me a socialist and not listen and continue to live in the lie
3star2nr 1 year ago
@3star2nr I'm not going to call you a socialist, I'm going to laugh at you for realizing what's wrong, seeing how things would have to be for it to be right, yet being too cowardly to be able to accept what has to be done for this to happen. Your knowledge of what's wrong with the system is admirable, but your cowardice to what has to be done for these changes to take place is painfully laughable. Why don't you go vote to those who keep it the same to change things? Moron.

Umbreona 1 year ago
One clarification; the point of the 4th amendment isn't to protect someone who's guilty of a minor crime. It's about protecting the innocent from invasive practice.
"If you didn't have anything to hide, then you wouldn't mind us coming in"
The inadmissability of evidence collected by violating the 4th amendment is key to maintaining that protection. But ultimately the protection isn't for this guy, it's for all of us.
