You say that he is only charging to mod it right? Mod chips are illegal Depending on country, its legislature and its interpretation. The legal status of mod chips varies from legal, for some specific functions (like region code circumvention), to being completely illegal.
(part 2.) What's that you say? Your not using mod chips? Your using softmods? Well then let me tell you, most softmods where created using the Xbox Development Kit (xdk) Which is the software that microsoft uses to create apps so they will run on the xbox. It is illegal to use the xdk if you don't have a license to use it. Which means the program itself, whatever it may be, will also be illegal.
(part 3.) The only way to have a license is if you work for microsoft. But I'm sure that the license does not grant you permission to create stuff outside microsofts company, like emulators for instance. There is an openxdk that was developed by homebrew enthusiasts that would allow them to create whatever they wanted for the xbox legally. But most of the first underground Apps, emu's, and homebrew games where created using microsofts xdk.
(part 4.) Thats way you can only find these programs in what's called "The usual places" and not out in the open. There are other factors also to consider. Some emu's, like the playstation one, require that you have the patented sony playstation bios in order to run the games. Which makes it that much more illegal. Nintendo owns there own emu's for there game boy products. Which makes ANY and ALL other game boy, game boy color, and gameboy advance emu's that much more illegal. Now on to roms.
(part 5.) U.S. copyright laws state that copyrights owned by the corporations are valid for 95 years from the date of first publication. Because video and computer games have been around a little more than three decades, the copyrights of all video and computer programs will not expire for many decades to come. What does that mean? It means that the only way you can have any of those roms legally is:
(part 6.) 1. If the copy you have is directly made using the game you PHYSICALLY own and not one you have downloaded off the internet. Even if you own the game, it is still illegal to download the copy of the game. The "please delete after 24" thing is a myth. You cant have it for any amount of time period. or
2. If you wait until the patents have expired which would be sometime around 2075. Unless the company decides to reinstate there patent's.
(part 7.) Now, if you're selling these things, well, that puts more charges on top of it all now doesn't it? So please don't call anyone a dumbass unless you know for sure what you're talking about!
