Good to know about NAD's stand and you as a CEO focusing on this important topic of Deaf Education that has been targeted and impacted by the governor's budget. It is a much needed leadership for us to know how to be proactive rather than reactive. From my understanding, according to IDEA, it does state that a continuum of educational options is to be available; however, it doesn't mean that a state is obliged to keep more than ONE school for the Deaf open. What do you make out of that?
As for your legal prong, I'm not quite sure about your claim that only parents can file suit. Sure, they're the ideal plaintiffs in any contemplated court action.
However, individuals and groups can also file suit as long as they allege constitutional issues? (i.e., 14th Amendment, Federal Preemption) Sure, there'll be standing issues, but I think they're not insurmountable.
