Copyright infringement is a civil matter, not a felony. On the distribution side of copyright infringement, it is possible for it to be a felony, but that's rarely the case.
Moore would have to file a suit against the distributor that Rove received the video *from*. That's where the crime is. Copyright law is not like property law where receiving stolen goods is itself a crime. It just simply doesn't work that way.
