@beamprimary There is not many people who prepare for a situation to happen more than I. I shoot IDPA and USPSA and practice at the range, no less then 3-4 times a week. I carry a defensive pistol LOADED every day. I have a licence to do so and no obligation to inform the police on contact. BAAA little sheep.

@commonman80 What would be the reason to "put a rifle round" from 60 yds. in some stupid ass unless it was personal, and they just wanted to make him dead? It's obvious open carry is no help in this situation! Open carry for personal safety involves direct physical confrontation with someone trying to rob or hurt you; or someone who is with you (ie) your wife/girlfriend children etc. I think if open carry were accepted for a period of time it would probably be practiced a lot less.

@FUdirtbag There has to be some truth to what you are saying here. Maybe if not being cheap about it; the extra paperwork is a hassle and is too much to bother with. There are some people that just want to show the world that they know they have the right to carry. I have a concealed carry permit. The last time I carried a weapon outside of my own property was about three yrs. ago on a "wilderness type" camping/fishing trip. It was just extra weight!!
@ohannahdad It's your right but is it worth it? You know you're gonna draw attention to yourself EVERYTIME you open carry, to me it's just worth the hassle. Plus, I'm not sure of the process of getting a permit is in other states, but where I'm from it was merely a 4 hour course with 10 minutes of shooting, filling out the application and begin the waiting game. I would rather deal with this than trying to explain to the authorities everytime that it's my right to open carry.

@ohannahdad Sorry about that, when i said "you" i meant the people who open carry. It's true that given time, the issue of having to be confronted by cops may go away...but most likely will never go away completely. There will always be an alarmed citizen who called in a suspicious person with a gun. And in most cases of contact with police, I've noticed that alot of advocates decide to make it a situation. Just ID yourself and comply within reason and things will go alot smoother.

The point is when will the police agencies who recieve the complaint calls about open carriers start responding properly? The dispatchers who recieve these calls should tell the "alarmed citizen" that there is no law against open carrying a weapon. That is their job!! How many citizens have been told (in the passed) "We can't do anything if nobody broke the law." This applies here!!

@hapelliotte I knew of a young lady (some time ago) who had a stalker in her apartment building. She went to the loca police dept. with a complaint. She was told that they could not do anything without proof that he broke the law. Many cops won't honor the law for open carry, but will for a stalker. It has to do with control. Video cameras and open carrying citizens "levels the playing field" (just a phrase) and LEO(s) are not happy about it. I sometimes wonder about open carry "complaint calls"

The successful functioning of any govt. operation is done through checks & balances. We have drifted from that practice long ago. I'm from Iowa and it's legal to open carry in public....but this is a good example of why I choose not to openly carry. People call you in because firearms make them nervous, because anytime on the news they hear about firearms usually has to do with hostile intent.

Missouri open carry laws are very confusing because each city and/or municipality can determine whether its legal or not. I know you can't in St.Louis city or in Kansas City, but I have no clue for St. Charles. These technicalities are why I just carry concealed...
My issue with this stop is that the cops didn't check the law BEFORE detaining these gentlemen. The police have just as much right to follow me down the street while they check their books as any other person.

It is perfectly legal to open carry in the state of Missouri, Police officers do not have rights, they have only the authority granted them by the people in pursuit of their duty. 911 and police dispatch centers need to become more familiar with the laws and to help educate the public regarding these incidents. It would go a long way to help inform the public of their rights and reduce the waste of city/county resources.
I respect the police officer's attitude, what the officer's did violates our rights as law-abiding citizens of the constitution of the united states of america. Removing his weapon was illegal and detaining them in my opinion is justified by the complaint. I don't believe anyone acted wrongly in this video except the police officer removing the firearm... You are correct... In this case civil rights were not respected and i dont like that but these police in the video acted respectfully and acknowledged that they were in the wrong... They just do what they're told and let the courts figure out the law stuff. Anyone has the right to ask anyone anything, but they do not have the right to seize property or ID someone without suspicion of a crime.

@ironhorsetamer completely disagree. I want those cops questioning these doughboys to see what they are up to. They wanted to get in a confrontation except it didn't get heated like they wanted. Kudos to the cops. And BTW cops do get get guns stolen from them, it happens. You have to take this in the context of what was happening at the time here in St. Charles. The city council was trying to pass some kind of controversal gun law and that's why the pinheads are there trying to start trouble.
Aren't the cops open-carrying? They don't seem to worry about getting popped in the back of the head while on duty. Let's not forget, police are citizens too. As a resident of St. Charles, I applaud the officers in this video. They were easy going and non abrasive throughout. This guy was hoping this would happen, just so he could run around and tell his buddies he got x amount of hits on YouTube. I am 100% in favor of the 2nd Amendment and encourage people to exercise their right, but use a little common sense. This is why your permit is call a "Concealed" Carry Lisence, not an "open" carry license. Nice work St. Charles PD!
@ignigknogt I will extend that to include the city of St. Charles in general and not just that street. It is comprised largely of suburban sprawl mixed with a restored homes old town area that you see in the video. I bet more than half those violent crimes consist of domestic disturbances, the rest being a drunken punch in the face somewhere. In the video notice how many babies in strollers you see, and that was on a rainy day. Packin heat here is unneccessary, hence the officers curiousity.
The man says the officer is wrong about the possibilty of the open carry gun getting stolen. He is an 'expert' he says. I just watched a video on youtube about just such an incidence in Milwaukee. Kudos to the officer for being the better man. I want to add I have been to that location numerous times- there is absolutely NO reason to need a firearm in Main Street St. Charles. None.

Saint Charles, Missouri is statistically one of the safest cities in America. 2005-2008 it had 1 murder per year. Not a single was the result of a random street crime - so murder is an almost non-existent risk to the general public. In 2009 it had 0. There were 81 assaults in 2010. Most of them likely minor punch ups. It has also 155 members of LE for a population of 65000.
I understand people have the right to open carry. But visitors doing it in a S.C mainstreet are asking for trouble.

None of the businesses down there allow you to enter their premises with firearms. So what good does it do? Look these guys were trying to set up a confrontation and failed, again kudos to the officers for being the better men.

He was either bullshitting or trying to see how long it took for someone to get concerned and call the authorities. Which they were then ready to record. These guys were inconsiderate of the Saint Charles public. If i could carry concealed or open, i would choose concealed. No need for some doughy slob to scare a bunch of mothers with their children on the mainstreet.
@videostar07 Yea the cops also handled this amazingly. In cities with an actual crime problem or no open carry culture the police would have been quite ticked off. Getting called to a man with a gun call is probably the worst call for obvious reasons - and to get their and find it's some tourist seeing how much he can get away with would piss them off. Although i am not saying i disagree with the right to open carry, but use it wisely.

@shawnsent Just carry concealed, and surprise an attacker. The one thing I agree with the police about is, the fact that, If you open carry, you may become a target. It actually gives the perpetrator an upper hand in a conflict. Also, would it be wise to listen to an ipod with headphones, or browse for books with a weapon exposed at your side? It would be more of a headache than anything. You would have to constantly worry about a deranged individual grabbing it off you. They are out there.

Mo. 's a great State, and we have some of the BEST Law Enforcement Officers around. That being said, we probably have some of the most screwed up laws of just about anywhere. To complicate matters further there are Federal, State, AND local weapon ordinances that completely override AND contradict each other. But, hey, look @ it this way,, lawyers, legislators, judges love this stuff. It insures them a JOB, like forever.
I'm quite disappointed that we live in a country now where people are scared shitless of guns. "Oh my, he has a gun!" Yeah, and it's holstered at his side, not waving around in his hand. People don't know their rights. Anyone who is surprised or scared of seeing a person openly-carrying, doesn't know their rights and therefore has no cause for grievance if/when armed conflict with the government ever occurs.

I'm glad that the officer's were nice and respectful, and that they actually took the time to look up the law rather than just blindly assume and wrongfully arrest. They actually seemed like they were doing what they felt was right, and not mean spirited. However, I really wish they wouldn't have detained you as they did. Ignorance is no excuse.
It's not that simple. Your "disturbing the peace" is purely subjective. If an officer were to bring up this veiled threat it would simply place him/her in the group of officers who simply don't understand the value of public relations in a community. This group, and they're out there, do a disservice to the community and their fellow officers. Public co-operation is key to good police work. At least the officers in this video were smart enough to steer clear of this approach.
Strange how these people were detained by the police because this officer was unsure of a basic law. Yes, these officers were courteous but they should have apologized for their ignorance and leave it at that. Instead they had to insert their "buts". The fact that the second "off duty" policeman decided to stay even when he realized the true nature of this call is somewhat suspicious. .. to me at least.

no one can expect the police to be familiar with every single gun related law. but they shouldn't have assumed that these guys were breaking the law, either, and they shouldn't have disarmed anyone.
Since Open Carry creates anxiety and causes police to conduct detentions wasting time and money of both police and law abiding citizens, then why not grant automatic CCW to citizens who pass the checks and balances to be allowed to own guns, and sell numbered badges to wear when OC?
Also, for those who choose to OC, require it be loaded and a badge exposed beside it. Citizens may be called to arrest or aid in arrest, so a gun badge makes a little sense.
A non-LEO badge could be silver, and of a distinctive design designated for civilians, and it could be required it be worn visibly beside the holster, along with a permit card. Permits would be State-wide, rather than County.
Permits could be valid for 4 years, and revocable for cause. The County Sheriff or State Police would administer the program.
Officers seemed quite reasonable to me. Citizen called in a complaint, based on visual of openly carried weapon, cops would be remiss not to investigate as they did.
And they went out of their way to be polite.
That 4th Amendment argument is crap, "unreasonable" being the key word.

It is true the men were not breaking any laws. Nor were the police. The actions of the police were reasonable on their face-- ie, citizens had complained and the men were checked out by the police. Entirely politely.

Unless they are doing anything illegal, or the cops have suspicion the guys are doing anything illegal, he can't detain them or ask for id. Plus, the police officer didn't even know the law, so how would he know if they were breaking it if he didn't know it?

@billydunwoody im a criminal justice major. i know the law the open carry law, along with many other laws for that matter, change constantly. the officer was honest in saying he wasnt sure of the law, and he checked into it right then and there and you're manipulating what i said. when someone calls in, the police have to investigate it if it is something that can cause a threat to the public. someone called and said "there is a a man with a gun" he said it in the video. i know both officers btw

It states that acting in a manner or appearing in a manner that would cause a reasonable person to believe that he or she might be in danger is punishable by a misdemeanor and is considered a public disturbance. looking at that, the men should have been cited because people in today's world panic very easily and wearing a gun in public is likely to turn heads. he did this deliberately to "catch" the police.

A disturbance charge is defined as an action which unsettles the normal proper order of a public space.
I don't open carry because I never want to have to deal with anything like this and because carrying concealed provides a tactical advantage while carrying openly can make you the priority target of a crimnal. Of course I also believe that anyone who wants to open carry should be able to do so, no matter where they are.
I agree that the entire premise of hiding the weapon is unreasonable but I must say that the police were civil and reasonable and tried to convince the carrier that things you *can* do and things you *should* do are not always the same. When confronted by the "gun guy" with information they did listen and not get huffy like so many do. Any Law, Municipal Ordnance, State Statue, County Code, or even Federal Code or Supreme Court Ruling that infringes, restricts, prohibits or otherwise violates the Second Amendment is a Violation of the Constitution (the Supreme Law of the Land).

I see a lot of people calling these cops rainbow of names. I don't agree with the cop removing the gun and trying to enforce something he doesn't fully understand. However I would like to point out that the officer did get a couple of things right which kept this from becoming a free-for-all. Most police officers seem to view the law as their restraint from exercising a power and authority they think they have.
I'm not an open carry believer, I tend to agree with what the cop said, wearing a gun in plain sight is a warning to everyone you're carrying and they're more likely to sneak up behind you and crush your skull in and take your gun than to come at you face to face where carrying concealed is designed to protect you.

I carry a defensive pistol LOADED every day. I have a licence to do so and no obligation to inform the police on contact. BAAA little sheep.

Open carry for personal safety involves direct physical confrontation with someone trying to rob or hurt you; or someone who is with you (ie) your wife/girlfriend children etc. I think if open carry were accepted for a period of time it would probably be practiced a lot less.

There are some people that just want to show the world that they know they have the right to carry. I have a concealed carry permit. The last time I carried a weapon outside of my own property was about three yrs. ago on a "wilderness type" camping/fishing trip. It was just extra weight!!

Plus, I'm not sure of the process of getting a permit is in other states, but where I'm from it was merely a 4 hour course with 10 minutes of shooting, filling out the application and begin the waiting game. I would rather deal with this than trying to explain to the authorities everytime that it's my right to open carry.

It's true that given time, the issue of having to be confronted by cops may go away...but most likely will never go away completely. There will always be an alarmed citizen who called in a suspicious person with a gun. And in most cases of contact with police, I've noticed that alot of advocates decide to make it a situation. Just ID yourself and comply within reason and things will go alot smoother.

@hapelliotte I knew of a young lady (some time ago) who had a stalker in her apartment building. She went to the loca police dept. with a complaint. She was told that they could not do anything without proof that he broke the law. Many cops won't honor the law for open carry, but will for a stalker. It has to do with control. Video cameras and open carrying citizens "levels the playing field" (just a phrase) and LEO(s) are not happy about it. I sometimes wonder about open carry "complaint calls"

Missouri open carry laws are very confusing because each city and/or municipality can determine whether its legal or not. I know you can't in St.Louis city or in Kansas City, but I have no clue for St. Charles. These technicalities are why I just carry concealed...

I respect the police officer's attitude, what the officer's did violates our rights as law-abiding citizens of the constitution of the united states of america. Removing his weapon was illegal and detaining them in my opinion is justified by the complaint. I don't believe anyone acted wrongly in this video except the police officer removing the firearm... This is all respectful and i wouldnt be upset with this if i was in any position compared to some other situations i have seen...

I could see the frustration of the men who were stopped and detained but at the end of the day everyone seemed to be ok and safe... I suppose my above comment seemed to condone the wrong-doings... They just do what they're told and let the courts figure out the law stuff. Kudos to the cops. And BTW cops do get get guns stolen from them, it happens. You have to take this in the context of what was happening at the time here in St. Charles. The city council was trying to pass some kind of controversal gun law and that's why the pinheads are there trying to start trouble.

As a resident of St. Charles, I applaud the officers in this video. They were easy going and non abrasive throughout. This guy was hoping this would happen, just so he could run around and tell his buddies he got x amount of hits on YouTube. I am 100% in favor of the 2nd Amendment and encourage people to exercise their right, but use a little common sense. This is why your permit is call a "Concealed" Carry Lisence, not an "open" carry license. Nice work St. Charles PD!

It is comprised largely of suburban sprawl mixed with a restored homes old town area that you see in the video. I bet more than half those violent crimes consist of domestic disturbances, the rest being a drunken punch in the face somewhere. In the video notice how many babies in strollers you see, and that was on a rainy day. Packin heat here is unneccessary, hence the officers curiousity.

Saint Charles, Missouri is statistically one of the safest cities in America. 2005-2008 it had 1 murder per year. Not a single was the result of a random street crime - so murder is an almost non-existent risk to the general public. In 2009 it had 0. There were 81 assaults in 2010. Most of them likely minor punch ups. It has also 155 members of LE for a population of 65000.
I understand people have the right to open carry. But visitors doing it in a S.C mainstreet are asking for trouble.

None of the businesses down there allow you to enter their premises with firearms. So what good does it do? @shawnsent Just carry concealed, and surprise an attacker. The one thing I agree with the police about is, the fact that, If you open carry, you may become a target. It actually gives the perpetrator an upper hand in a conflict. Also, would it be wise to listen to an ipod with headphones, or browse for books with a weapon exposed at your side? It would be more of a headache than anything. You would have to constantly worry about a deranged individual grabbing it off you. They are out there.

Everybody just walked around with a gun, or two, or three. Why not? I wouldn't be against it. Until they do away with all the laws restricting firearms. Mo. 's a great State, and we have some of the BEST Law Enforcement Officers around. That being said, we probably have some of the most screwed up laws of just about anywhere. To complicate matters further there are Federal, State, AND local weapon ordinances that completely override AND contradict each other. But, hey, look @ it this way,, lawyers, legislators, judges love this stuff. It insures them a JOB, like forever.

I'm quite disappointed that we live in a country now where people are scared shitless of guns. "Oh my, he has a gun!" Yeah, and it's holstered at his side, not waving around in his hand. People don't know their rights. Anyone who is surprised or scared of seeing a person openly-carrying, doesn't know their rights and therefore has no cause for grievance if/when armed conflict with the government ever occurs.

I'm glad that the officer's were nice and respectful, and that they actually took the time to look up the law rather than just blindly assume and wrongfully arrest. They actually seemed like they were doing what they felt was right, and not mean spirited. However, I really wish they wouldn't have detained you as they did. Ignorance is no excuse.

It's not that simple. Your "disturbing the peace" is purely subjective. If an officer were to bring up this veiled threat it would simply place him/her in the group of officers who simply don't understand the value of public relations in a community. This group, and they're out there, do a disservice to the community and their fellow officers. Public co-operation is key to good police work. At least the officers in this video were smart enough to steer clear of this approach.

Strange how these people were detained by the police because this officer was unsure of a basic law. Yes, these officers were courteous but they should have apologized for their ignorance and leave it at that. Instead they had to insert their "buts". The fact that the second "off duty" policeman decided to stay even when he realized the true nature of this call is somewhat suspicious. .. to me at least.

Since Open Carry creates anxiety and causes police to conduct detentions wasting time and money of both police and law abiding citizens, then why not grant automatic CCW to citizens who pass the checks and balances to be allowed to own guns, and sell numbered badges to wear when OC?
Also, for those who choose to OC, require it be loaded and a badge exposed beside it. Citizens may be called to arrest or aid in arrest, so a gun badge makes a little sense.

A non-LEO badge could be silver, and of a distinctive design designated for civilians, and it could be required it be worn visibly beside the holster, along with a permit card. Permits would be State-wide, rather than County.
Permits could be valid for 4 years, and revocable for cause. The County Sheriff or State Police would administer the program.

Officers seemed quite reasonable to me. Citizen called in a complaint, based on visual of openly carried weapon, cops would be remiss not to investigate as they did.
And they went out of their way to be polite.
That 4th Amendment argument is crap, "unreasonable" being the key word.

It is true the men were not breaking any laws. Nor were the police. The actions of the police were reasonable on their face-- ie, citizens had complained and the men were checked out by the police. Entirely politely.
If there was actual malfeasance on the part of police, the men have recourse in a court of law. So, let them sue.

Unless they are doing anything illegal, or the cops have suspicion the guys are doing anything illegal, he can't detain them or ask for id. Plus, the police officer didn't even know the law, so how would he know if they were breaking it if he didn't know it?

@billydunwoody im a criminal justice major. i know the law the open carry law, along with many other laws for that matter, change constantly. the officer was honest in saying he wasnt sure of the law, and he checked into it right then and there and you're manipulating what i said. when someone calls in, the police have to investigate it if it is something that can cause a threat to the public. someone called and said "there is a a man with a gun" he said it in the video. i know both officers btw

It states that acting in a manner or appearing in a manner that would cause a reasonable person to believe that he or she might be in danger is punishable by a misdemeanor and is considered a public disturbance. looking at that, the men should have been cited because people in today's world panic very easily and wearing a gun in public is likely to turn heads. he did this deliberately to "catch" the police.

If they were brandishing their guns then you may have a point. They broke no laws. If what you say is true then whoever passed the open carry law (municipality, state, etc.) could be libel for not taking proper steps in creating public awareness for this law. Hey, why not cite the complainants for creating a public disturbance? Ignorance is no excuse.

He cant be responsible for peoples perception or emotions to things. He was doing nothing illegal, and was open carrying legally, thats why the cops let him go. Also, if there was enough evidence to cite him for public disturbance, why didn't the cops do that, or even mention that in either video?

I don't open carry because I never want to have to deal with anything like this and because carrying concealed provides a tactical advantage while carrying openly can make you the priority target of a crimnal. Of course I also believe that anyone who wants to open carry should be able to do so, no matter where they are.

I agree that the entire premise of hiding the weapon is unreasonable but I must say that the police were civil and reasonable and tried to convince the carrier that things you *can* do and things you *should* do are not always the same. When confronted by the "gun guy" with information they did listen and not get huffy like so many do. I appreciate these type of police, who I think genuinely want to keep peace, not enforce the NWO corporate rules.

the officer is floundering on the law so as to justify his inadequacy. but he was responding to a complaint from a concerned citizen that isnt aware of the laws. it is the idiots that call police that carry guns to complain about lawful citizens that carry guns. we dont have to many of these issues in Arizona as we passed laws allowing citizens to carry concealed without a ccw. yes you read it right Az allows concealed weapon without a permit. i love my state. vote conservative.

i wish all cops were this reasonable and polite. while i agree that the 2nd gives you the right to carry open it does freak a lot of people out, and if a citizen tells the officer about it , its his duty to investigate. the 2nd cop even apologized for detaining them. this kind of thing will happen until people get educated. kudos for taking that chore on.

I see a lot of people calling these cops rainbow of names. I don't agree with the cop removing the gun and trying to enforce something he doesn't fully understand. However I would like to point out that the officer did get a couple of things right which kept this from becoming a free-for-all. Most police officers seem to view the law as their restraint from exercising a power and authority they think they have.

I'm not an open carry believer, I tend to agree with what the cop said, wearing a gun in plain sight is a warning to everyone you're carrying and they're more likely to sneak up behind you and crush your skull in and take your gun than to come at you face to face where carrying concealed is designed to protect you.
