Their training state's that anyone taking photos of them while working is suspicious. Their experience has shown their friend's getting killed by Cartel's. Where the rubber met the road is when the agent turned around & drove away after stopping me. If he thought for a moment he had a legally defensible position for stopping me, he wouldn't have left without investigating further. My attitude had nothing to do with it other than to let him know there would be consequences for his actions.

That's a horrible way to do anything, and criminalizes them unjustly. They are doing their job. If there's a problem, the it need's to fixed at the training level.

As BP Agents, we cannot go around violating the 4th Amendment rights of citizens. There have been MANY times I wanted to pull over vehicles because I had that gut feeling they were up to no good, however, I couldn't articulate facts that would lead to a reasonable suspicion, so I had to let it go. Willful violation of civil rights destroys credibility of LEO's.
They did the same thing about following me for miles without pulling me over, and continued to harass me at the new border patrol checkpoint in Gila Bend, AZ. What can we do to stop the harassment?

Now being stopped with no explanation is wrong. That agent should be written up. You should have taken the vehicle number, and called a supervisor to make a complaint.

Now some dirtbag who is ACTUALLY commiting an immigration violation or any other federal violation can assume, if he attempts to intimidate the agent with threats of him violating his constitutional rights, the agent will just allow him to be free to leave. That is why agents have to continue their investigations because it is their job to determine if there is illegal activity happening in their presence.
Once the agent determines that there are no violations of immigration laws or any other federal laws being commited, you would be free to leave. When the agent approaches your vehicle, and you react in the manner that you did (UNcooperative), don't you, in a slight sence, believe that it may raise his suspicion, by attempting to Intimidate the agent with your constitutional mumbo jumbo, because any other reasonable person would be cooperative and allow the agent to continue in his investigation, if they knew that they were not commiting an immigration violation or any other federal violation.
Why do you consider the Constitution to be mumbo jumbo? Isn't the Constitution the document this agent swore an oath to uphold & defend?
If an agent displays a disregard for Constitutional protections, isn't it prudent for the individual to assume he is or may very well be operating outside the law & may engage in illegal acts such as planting evidence on or in the vehicle, lying about what is said or what happens during the encounter? Destroying evidence that could be used against him?
But let's say an agent does have the the neccesary R.S. or P.C., and has built the solid articulable facts to excecute the roving patrol stop. You may not be doing anything wrong, but in the officers perspective, you may. And it is his lawful duty to act on any suspicion that he may have.
As you undoubtedly know, if he has probable cause, he doesn't need my consent to take whatever lawful actions are at his disposal - including searching.
If all he has is reasonable suspicion, all I'm obligated to do is stop. He can detain me for a reasonable amount of time. If probable cause isn't forthcoming in that reasonable time frame, he must allow me to go on my way.
Finally, it's only his duty to act on any reasonable suspicion he may have, not any suspicion he may have.

BPA's only need reasonable suspicion to stop a vehicle if they believe an immigration violation is being commited. For any other FEDERAL violation, BPA's need probable cause to stop a vehicle. This FEDERAL violation can include the witness of a narcotics transporter, a fleeing bankrobber, a fleeing murderer, etc. Im guessing, you CPUSA, already know this. As I pointed out before, the Supreme Court in U.S. v Brignoni-Ponce has made it clear that individualized reasonable suspicion is required to initiate this kind of a traffic stop.
Proximity to the Border and/or timing is insufficient to individualize any generalized suspicion.
If the agent didn't want to antagonize me, he should have used better discretion.
What you're doing is ignoring the fact the agent initiated an illegal traffic stop.
What you're not doing is chastising the Border Patrol for wasting time and resources harassing domestic traffic instead of concentrating their efforts in a way that doesn't alienate law abiding individuals inside the country.

Reasonable suspicion must be individualized. A Border Patrol agent must have articuable reasonable suspicion to believe that I am illegally in the country or transporting someone who is illegally in the country to lawfully initiate a traffic stop. So says SCOTUS (see U.S. v Brignoni-Ponce).
Just being in an area where smuggling may be prevalent is not sufficient to stop a vehicle via roving patrol.
"Reasonable suspicion must be individualized" Not at an immigration checkpoint. Those are suspicionless stops, and they need only probable cause to initiate a warrantless search.

you should know that only reasonable suspicion is needed within 25 miles of the border. Also to the fellow worried about the Interior of the U.S. That is where ICE comes in to play, they take over after 100 miles from the border... read through the Immigration and Nationality Act and Code of Federal Regulations.

The fact is he had no lawful basis to initiate the stop. When he realized I was aware of this fact, he decided it would be in his best interests from a career perspective to leave the scene instead of furthering his culpability.

I would sacrifice showing my ID a couple times a day to have the bad guys that are living in the same town or city as my family caught. Up here in Northern Ontario Canada these "RANDOM CHECKS" by the Ontario Provincial Police are common and even reported on the news. Just returned fro a trip to AZ and was stopped at check point on I-8 in CA just before Yuma. Was sick to my stomach for hours after having to declare my citizenship to proceed. Where are we heading? Also what is the authority of the pople who man the CA agricultural checkpoints. They asked "where you coming from?" in addition to normal fruit and plants question.
This video has to do with roving patrols (see U.S. v Brignoni-Ponce), not checkpoints.
Additionally, Martinez-Fuerte dealt with permanent checkpoints where agents were only stopping & seizing individuals for a very brief period of time for the sole purpose of making an immigration query.
The other videos on this channel depict temporary checkpoints where agents oftentimes utilize drug dogs to search for drugs absent reasonable suspicion or probable cause.
While I applaud the courage of the author of this video, it is my understanding that pretty much every CBP agent from Arizona knows who this person is and what his objectives are. This may explain the frequency of his encounters with the CBP.

As you undoubtedly know, if he has probable cause, he doesn't need my consent to take whatever lawful actions are at his disposal - including searching.
If all he has is reasonable suspicion, all I'm obligated to do is stop. He can detain me for a reasonable amount of time. If probable cause isn't forthcoming in that reasonable time frame, he must allow me to go on my way.
Finally, it's only his duty to act on any reasonable suspicion he may have, not any suspicion he may have.

BPA's only need reasonable suspicion to stop a vehicle if they believe an immigration violation is being commited. For any other FEDERAL violation, BPA's need probable cause to stop a vehicle. This FEDERAL violation can include the witness of a narcotics transporter, a fleeing bankrobber, a fleeing murderer, etc. Im guessing, you CPUSA, already know this. The only reason I go into those areas is for work 14USA88. Otherwise, I go out of my way to avoid areas with a high concentration of unaccountable federal agents.
In fact, I've been "going into those areas" to work longer than most BP agents I've come across have heard of the BP.
Additionally, I'm not interested in entrapping anyone. I'm interested in being left alone - a concept DHS merely scoffs at.
BTW, don't forget the government is the largest employer of those lawyers you refer to.

They're not protecting you when they illegally seize you along the side of the road 14USA88.
As I pointed out before, the Supreme Court in U.S. v Brignoni-Ponce has made it clear that individualized reasonable suspicion is required to initiate this kind of a traffic stop.
Proximity to the Border and/or timing is insufficient to individualize any generalized suspicion.
If the agent didn't want to antagonize me, he should have used better discretion.

What you're doing is ignoring the fact the agent initiated an illegal traffic stop.
What you're not doing is chastising the Border Patrol for wasting time and resources harassing domestic traffic instead of concentrating their efforts in a way that doesn't alienate law abiding individuals inside the country.
The perspective you're missing is that this agent wasn't doing his job. He was violating the law and my rights. Why aren't you upset about that?

Additionally, you're missing a very important point 14USA88.
Reasonable suspicion must be individualized. A Border Patrol agent must have articuable reasonable suspicion to believe that I am illegally in the country or transporting someone who is illegally in the country to lawfully initiate a traffic stop. So says SCOTUS (see U.S. v Brignoni-Ponce).
Just being in an area where smuggling may be prevalent is not sufficient to stop a vehicle via roving patrol.

Additionally, probable cause is a much higher standard to meet than reasonable suspicion. Your comment makes it appear that you have it backwards.
Finally, while no suspicion is required to stop someone at a permanent immigration checkpoint setup near nexus points for border traffic, any further detention requires consent or probable cause. So says SCOTUS.

you should know that only reasonable suspicion is needed within 25 miles of the border. Also to the fellow worried about the Interior of the U.S. That is where ICE comes in to play, they take over after 100 miles from the border... read through the Immigration and Nationality Act and Code of Federal Regulations.

Didn't you just state I was antagonizing the agent from the beginning by refusing to cooperate & roll down my window? If he had reasonable suspicion to initiate the traffic stop, wouldn't these actions have increased his level of suspicion rather than lower it?
The fact is he had no lawful basis to initiate the stop. When he realized I was aware of this fact, he decided it would be in his best interests from a career perspective to leave the scene instead of furthering his culpability.

What law requires me to roll down my window, especially when I've been stopped absent reasonable suspicion. And yes, I have every right to make that determination. If he doesn't agree, he knows where the court building is.
The road (coupled with time of day) is also a perfect place for enforcement agents to violate the rights of the traveling public with impunity.

If the agent initiated the stop and seizure, how do you rationalize your statement that I was the instigator? Additionally, how do you square up your statement with the fact the agent just left when I began asking questions?
If he had reasonable suspicion to initiate the traffic stop, he wouldn't have left like he did. More likely, he was engaging in illegally shotgunning traffic and backed off when he realized he stopped someone who wasn't intimidated by his unlawful tactics.

No one forced these agents to act like jackbooted thugs. They always had the option of waving me through the checkpoints when they realized I was exercising my rights & they had no legitimate basis for continuing the detention.

I suppose you also missed the DHS Inspector General Report on the number of illegal alien felons & illegal aliens from terrorist watch list countries that are routinely released into society on an annual basis.
That's right, Customs & Border Protection as a matter of policy releases such individuals back into the country knowing that most will abscond before a final deportation order is issued by a judge.

Ill tell you what too, if I was BP I would pull you over for taking those snapshots of me and the cars. All these people are doing is their job. How long does it take to show youre ID? I would sacrifice showing my ID a couple times a day to have the bad guys that are living in the same town or city as my family caught. Unless the local police learn immigration law they need to be there. For my family if not yours. This is if you have one; You do seem to have a lot of time on youre hands.

Some have been followed home from work. Last year one was beat to death just because he was identified outside of work as one.

Another tired old argument that's been debunked before iknowy101. Several studies have been done on the most dangerous jobs in America. Guess what? Neither police officers nor federal agents fall within the top 10. That honor goes to farmers, ranchers, construction workers, fishermen, etc.
If these agents were really concerned about their safety, they wouldn't be standing around in the middle of a public highway seizing thousands of people absent reasonable suspicion on a daily basis.

Up here in Northern Ontario Canada these "RANDOM CHECKS" by the Ontario Provincial Police are common and even reported on the news. If we North Americans want to share policing that means Americans are to get the "SHOTGUN" It is illegal under our Charter of Rights and Freedoms but thanks to our own terrorist legislation we have no recourse but to bear it.

He disabled the audio bc the dispatch radio was saying his name and address. I doubt an imposter would do that, lol unless his professional hacker buddy was on standby to look up this info in the seconds that he was pulled over. Just returned fro a trip to AZ and was stopped at check point on I-8 in CA just before Yuma. Was sick to my stomach for hours after having to declare my citizenship to proceed. Where are we heading? Also what is the authority of the pople who man the CA agricultural checkpoints. They asked "where you coming from?" in addition to normal fruit and plants question.

This video has to do with roving patrols (see U.S. v Brignoni-Ponce), not checkpoints.
Additionally, Martinez-Fuerte dealt with permanent checkpoints where agents were only stopping & seizing individuals for a very brief period of time for the sole purpose of making an immigration query.
The other videos on this channel depict temporary checkpoints where agents oftentimes utilize drug dogs to search for drugs absent reasonable suspicion or probable cause.
