The BETA is out, not the actual thing. You gotta pay $3000 I think to get into the Developer program, so you can get the beta, or you can get a leaked version for free...

Your account will not be removed unless you continue doing it despite warning, and it's highly unlikely that your video will be removed...

And also, I just remembered that your iPhone/iPod touch will not work anymore if you get a leaked version because it will detect that you don't have a proper "UDID" (Unique Device Identity), and then you can't go back to 2.2.1, and then you'll have a brick until summer, when you can upgrade to a proper firmware.

If you unzip the firmware, there's a DMG file readable by the Mac, and it contains a base of the iPhone/iPod touch's files.

You're incorrect on MMS. You can't do video. But you can send contacts/location/photos/audio via MMS.

I saw a picture of receiving video, you just cant send because you don't have video to send besides your movies but if you jailbreak you probably can. But then again that doesn't count.
