Kuo Ying-nan murio en el 2002 y return to innocence es un hito que nisiquiera imitadores han logrado superar!! y lo que hizo grande la cancion no es solo el coro si no la union de elementos .

return to innocence es un claro ejemplo , cretu mezclo elementos separados por continentes , y por culturas , uniendo occidente y oriente , un canto trival oriental con elementos occidentales pop de los 70 tipo led zeppelin , creo una fusion perfecta entre la musica y la voz!! ademas de mezclar compuso una letra que como las maximas de confusio en pocas palabras deja un mensaje contundente que te cuestiona y te llega al alma!! eso es tener creatividad .
enigma es un concepto de musica muy diferente a las demas , michael cretu es filosofo y atraves de la musica el deja un mensaje filosofico, el es productor , ingeniero de sonido , compositor , mezclador , cantante etc. una de las cosas maravillosas de enigma es la combinacion de elementos que estan por separado, no todos los elementos el los invento , pero lo admirable es como mezcla de una forma magistral todos los elementos.

@kainashhsu Sampling law is convoluted; international sampling law is more convoluted. But usually the artist being sampled receives royalties and credit, and if everything is done through proper legal channels and an appropriate agreement is reached, the samples can be used, everybody is happy, and everybody gets paid.
@FELIPE3802 As I said in another comment, there is no need to be uncivil. But let's say you have a song that IS public domain. Okay, public domain; woot. But let's say it's performed by a particular orchestra and released on a commercial CD. The song is public domain; but the *performance* by that orchestra belongs to the orchestra. So if you sample that particular orchestra, you're stuck paying royalties to them or whoever represents them, and they can sue you if you don't.

The case was settled out of court for an undisclosed amount of money and all further releases of the song were credited (including royalties) to the Kuos. @kainashhsu Sampling law is convoluted; international sampling law is more convoluted. But usually the artist being sampled receives royalties and credit, and if everything is done through proper legal channels and an appropriate agreement is reached, the samples can be used, everybody is happy, and everybody gets paid.

@FELIPE3802 As I said in another comment, there is no need to be uncivil. But let's say you have a song that IS public domain. Okay, public domain; woot. But let's say it's performed by a particular orchestra and released on a commercial CD. The song is public domain; but the *performance* by that orchestra belongs to the orchestra. So if you sample that particular orchestra, you're stuck paying royalties to them or whoever represents them, and they can sue you if you don't.

The article is on page 14, next to a large ad for "The World Is Not Enough." Search on Google for "virgin records lawsuit enigma" without quotes, click "Books" on the lefthand side. The Billboard article should be the first result.

@FELIPE3802 As I said: look up "virgin records lawsuit enigma" without quotes (e.g. "") on Google, click "Books" on the left side, stop typing everything in all-caps, and the first link at the top has an article from Billboard Magazine dated July 31 1999. They settled out of court, meaning Enigma, Virgin etc., PAID THEM and put their names in the credits of the newer CDs, and the suit went away. Ergo, they have the right to use the samples now because they give credit to the singers.

For my part, I worked at a radio station for 8 years, and I specifically cited Billboard, which is a trade magazine on the music industry, because it is considered reputable. The book "Music and Technoculture by Rene T. A. Lysloff and Leslie C. Gay, Jr. gives a long detailed discussion of the lawsuit. In being "settled" there is no admission of guilt by the defendants.

Reading further, I suspect Virgin (and by extension EMI, the parent company) would probably have won based on testimony. However, settling is faster, and easier, and honestly much safer. The point is not who won or lost; the point is that there was a lawsuit at all; to be perfectly honest, the larger point is that because it was settled, they cannot sue again.
