I think it should be a choice: You can leave up to $1million to each of your kin when you pass, tax free. After that, you have to choose: you can leave 100% of the rest to charity, at 15% tax rate, or you can forfeit 100% to US gov't. Most people will choose to leave it to charity, which is great. The heirs get $1million... plenty to take care of yourself if you have the right financial planner but, not enough to make you filthy rich and an embarassment to society.
