  • CO2 is a pollutant?....ARE THEY STUPID?

  • the executive branch cannot rewrite the clean air act so if the justices read CO2 into that legislation ( interpreting the law- that branch's separate power) that's the fault of the legislative branch that crafted the clean air act. the could have more strictly defined pollutants so CO2 would be excluded

  • people should look at the facts of the case. congress mandated that the epa regulate all air pollutants that the epa sees as a problem. massachusetts sued the epa so co2 could be classified as an air pollutant. the court said that co2 was an air pollutant and that the epa should consider regulating it.

  • This puts WAY TOO MUCH power into the hands of the Judicial Branch and the "Checks & Balances" system set up to protect us from one single branch of gov't overstepping their bounds falls apart. Everyone should be upset and alarmed about Judicial Activism.

  • Most of the people commenting here are missing the point entirely. This piece is more about Judicial Activism than it is about so-called "Global Warming" alarmism. It is about our court system circumventing the way of enacting laws as established by the Founding Fathers of this great nation-by a handful of appointed judges handing down decisions that, in effect, create new laws, rather than doing their actual job of deciding on current laws passed by the officials elected by the people.

  • Trash the Earth. God told us that it is for us to trash and use up. It is in the Bible. He will rapture us up anyway.

  • Heh, and by the way the Heritage Foundation has taken atleast $585,000 from ExxonMobil.

    From their own words:

    "Calls to drastically reduce emissions in sulfur dioxide (SOx), nitrogen oxide (NOx), mercury, and carbon dioxide would jeopardize U.S. energy and national security."

    i.e. They don't give a shit about killing Americans.

    Money talks.

  • Well, obviously industrialization isn't killing Americans. Life expectancy has risen greatly with industrialization. Threats from pollution are greatly exaggerated by environmentalists.

  • Thats largely in part due to successful regulation of public goods.

    Land, Water, Air, "Atmosphere", Fire Protection, Roads, Military etc

    If groups like these were to have their way, public goods would either be sold to the highest bidder, or trashed.

  • Supreme Court decided slavery was constitutional. I guess they are never wrong? Global Warming being caused by people is the biggest farce since the sun revolved around the earth.

  • You can't stop the inconvenient Truth. Period. I haven't yet formed my opinion of the Heritage Foundation. It seems more conservative than I would like, but often at least tries to present its work in an unbiased way. I don't care who makes laws about the inconvenient Truth. I don't think anybody has a choice.

  • Global Warming is more properly a scientific, not a political, issue. The only reason it has become politicized is because the Bush Administration used its political muscle to quash the flow of scientific information about Global Warming. Why would they do this? To foster the economic interests of their corporate sponsors, whose funding puts Republican stooges into places of power.

  • Chief Justice Roberts' view is correct, and this commentary gets to the heart of it: This case should not have risen to the level of the Supreme Court, whose role is not to decide whether or how to address a political question such as global warming. It doesn't matter in this instance whether climate change is a human-induced "crisis" or not.

  • Heritage Foundation: one of President Bush's RIGHT-WING think tanks. The Supreme Court did not make a new law. Based on current law, they determined the EPA can regulate emissions. NO LAWS were passed! This video is SPIN.

  • I think you're attacking the messenger because you don't like the message. Did you actually watch this? It doesn't SAY that any new laws were passed. It says the Supreme Court issued a political decision on a political issue instead of a legal decision on a legal issue.

  • True - What I should've said is that this is NOT an example of the Supreme Court legislating from the bench. All they did was decide a legal issue (whether or not the EPA can regulate emissions under the Clean Air Act.) Sure, the issue is politically very hot right now, but it was a legal issue once it went to court.
