This horse is not in hyperflexion- he is at the verticle, not behind. It is a beautiful test. The double bridle is used to finess the aids; anything misused can be cruel, you can't say that the bits need to be changed just because they have been used wrongly. Although somethings with modern dressage do need to be changed, I think that your topics are not among them.
Such extreme hyperflexion and severe bit is painful for the horse, dressage needs to be changed to a more natuaral, less painful bit for the horses, does NO ONE care???

just in case you are curious...this horse rides in a broken snaffle on a daily basis and still willingly flexes and stretches his neck
