However, the Duty of Care in law which Costco is required to uphold towards both employees and customers is not negotiable. There should have been a written risk assessment for the storage of the machines. If not, negligence is demonstrated. Hence, case in tort law. What is the delay with the action? What does your solicitor say the reason for delay is in this case? Did you know that Mrs. Berry has the legal right to see her medical reports, including of the incident? She just needs to write to the hospital and /or GP and ask to see them. These hospital assessments will form part of the evidence on which any claim for compensation will be based. Good Luck.

In the United States, Costco is fully aware, this kind of case would have resulted in a multi-million dollar settlement. The media would have been all over it. Contact the various US outlets (CNN/ABC/NBC/FOX) via e-mail, and appeal to the media. US companies like Costco cannot stand media criticism, and will eventually settle if the story gets picked up.

craigdevlin1, the last thing that we want is sympathy; the accident took place on the 5.4.03 as you can see the video was submitted long after the accident. You mentioned money, just for the record the date today is October 1st 2008 and my wife has not received a single penny settlement.

Her accident has cost her all of her life savings and she had to close a life insurance policy at present she has to survive from loans from the family with interest rates accumulating and was told by her Solicitor that the defendant would not have to pay for her interest accumulating. The reason I posted this video here of my wife's accident is because we have had three and a half years of hell.

The Defendant's, a large multinational corporate, their representative's insurers and lawyers are determined at any cost to have our case thrown out. We have had two solicitors' that totally ignored all the protocols that was advised by Lord Woolf.

We find our selves in a situation that our solicitors are prepared to take the blame for professional negligence rather than to allow the defendant to answer for their negligence.

One can see by the defendant's neurologist report that there isn't going to be anything fair about this accident, considering that Medical Experts suppose to be giving honest statements this one never even bothered to have all the required proof before making such a terrible statement.

There has not been an expert witness that produced a report on behalf of my wife, "considering that the defendant has admitted liability". There have only been experts for the defendant.
