  • You should be allowed to put anything on youtube as long as you put those involved in the credits. They should put someone in charge of sending bombs to people who file DMCAs... Fuck WMG, fuck the trolls, and fuck anyone who so much as THINKS about filing a DMCA for any reason whatsoever.

  • @cruciphile If you're talking about the DMCA then it's pretty much a necessary evil. The problem addressed in this video is not the act itself, but Youtube's knee-jerk mechanism for dealing with complaints filed under the act. Because they shoot first, ask questions later people are able to make FALSE complaints in order to kibosh and suppress opposing viewpoints.

    There are other video sites like Vimeo etc but those hosted in the USA will all be subject to the DMCA.

  • @AssassinKirk29 i had videos of executions in iraq in my favs list on my original channel piketyl000, that i had in my favs list for over two years that had hundreds of thousands of views and when i post my first video of the aftermath of a US dropped bomb in afghanistan youtube terminated me.

  • @studmuffin234able they should not be censoring the media we post AT ALL. the fact that they do negates any pretense of freedom we might claim as americans.

  • @cruciphile To be fair though, you have freedom to act within the law. You don't have freedom to do whatever the hell you want, right?

    You have to look at it from Youtube's point of view. They get billions of views per day and a lot of those come from children. If they don't act on the complaints that they receive about distressing content then they are liable to legal action.

    It has always surprised me that YT would take down videos without trying to judge if the complaint is legitimate. Instead, they force the victim to file a counter-notification.

    On the complaint form, they should have in big red letters: "Warning! YouTube users do NOT own a copyright on their videos unless they have paid for such and received certification. Otherwise, reporting people for using portions of your videos is a FALSE infringement claim. It constitutes PERJURY!"

  • @Astrobrant2 The reason for this is that copyright law varies by region. Under the Berne Convention, the creator of a work assumes copyright at the point of its creation and no registration is necessary. In the USA copyright registration is what you might call an "optional extra" that would put a litigator in a better legal position during a claim.

  • @starfedrogue hey! you should watch a video on my channel in my favs section, i think it has more to do with fazing out the smaller partners on youtube and giving them less attention. i have had a channel since 2006 called piketyl000 and i posted my first video 3 months ago and it was gory and i was not shocked that it got suspended and i got a warning and a week later a appealed it and they decided to suspend me for 90 days. i just checked today and they have terminated me for multiple flags??

  • The problem is that Youtbe keeps the flags on channels that have videos restored. That is just retarded. Three false flag mean the removal of a channel. Three sock accounts can do that plus it provides the docs of the user to the flager. It is plain ridiculous that after years of requesting these changes nothing is being done.

  • the 2nd option will create more work (reading and making a legal decision) than yt will want to do or are, in its staff, equally qualified to do. in order to file a dmca, a letter, physical, should be sent with a code to be entered by the user into yt systems. yt are obliged to respond to dmcas, but this way wouls cut false dmcas down to almost zero with very little work. unless of course they expect a backlash for their shitty service and millions of them to be filed - which could be arranged.

  • This is not to defend False DMCA but to clarify Fair Use. You can not copy any video from YT without violating the Terms of Service making any copies stolen property not protected by Fair Use. Videos on YT are not "Public" per say, but come with binding Terms of Service you agree to as a User which prohibit any copies by any means. Fair Use is secondary and only applies if the video image was obtained outside of YT. Even mirroring a video with permission is illegal under the Tof S. See vid resp.

  • My other channel was deleted for a YouTuber flagging my video as his video and he doesnt even own the rights to the video he got it just as I did downloaded it from another website! YouTube are also idiots for not researching the claims, even after I told them that he didnt own the copy rights to it! So YOUTUBE are solely accountable for following through with it without checking the claim! Sineater6609 was the account!

  • Many thanks for raising this issue. Myself and four users have had more than 30 videos removed because of a false copyright claim by a single claimant.

    YouTube responded said that once a claim has been made, they are required to remove the material.

    Why don't they require the claimant to substantiate their claims to begin with? Now I am forced to follow teh DMCA procedures thereby losing my anonymity and revealing even my address an telephone number to the claimant whom I know nothing about.

  • The one video I watched of Coughlan666 involved a 1:45/1:56 video of other persons content. There was no use of it for education, review, etc. How can that video be considered fair use?

  • If that footage was used without permission, and then the video was DMCA'd by the copyright holder, that would not be a false DMCA. It would be legitimate.

    Open Letter 2 is about any and all false DMCAs. Coughlan's situation is just a current example.

I do agree that the mass DMCA's and stuff have to stop, which is the fundamental issue at hand. What's ever scarier is that they're trying to get an international version of the DMCA out there.

  • Signed. And if you find abrupt spikes of ratings from a single IP you could investigate the location of that IP. If it is a residential address you can easily assume that 1000 people cannot live in a 50 foot square house, therefore abusing your system. And then you can permanently ban that IP from all youtube access.
