You are right I mis-spoke, It is not a crimminal offense to be in the USA undocumented. Working in the USA undocumented can but 99%$ of the time does not carry a crimminal offense but To do so their would have to be a crimminal trial instead of a civil immigration hearing in front of a judge.

This is next to impossible and would require tons of resorces which they do not have.

In almost every case carries no crimminal offense to work in the USA.
