That is true. Gnat thought marty killed Eli but the evidence turned out difference. The proof against Cole was already in the system. Everytime Cole's life is fucked up, he screws up and hurts someone but then he gets a slap on the wrist. Cole is more of a threat 2 society than Gnat.
