Medicare coverage was improved, Medicare Advantage Programs got subsidies cut. I am on a Medicare Advantage plan, they are dirt cheap. My premium could double and it would still be dirt cheap. These plans can include gym memberships. The AARP has endorsed the Medicare changes, they also endorse Medicare Advantage plans.
Brown won because Dems did not deliver on reform at the time, this has changed the climate.

It is failure of the Judiciary and judicial review. Much like the Catholic Church and pedophilia, it must appear infallible, and so refuses to address and curtail clear constitutional violations expounded from "precedents".
