  • While I agree u should not have been under arrest, the fact is the officer stated that you WERE under arrest. At that point you should have gotten out of the car and went to jail peacefully, and fought your case in court. You cant argue with the police once they say you are under arrest.... that's the bottom line. They were wrong for using excessive force, but it could have been avoided if you made wiser decisions at that point.

The law does not state that you must do everything a police officer tells you to do. This man had every right to stay in his car, the police did not even show him 3 peices of identity so as far as he knew they could have been impersonating federal officers

  • Right off the bat this pastor broke the law by refusing to submit to arrest. He had no right to demand explanation from the agents at that time. His refusal to comply is a violation of the law, and has been upheld as a legal reason to use force to effect arrest. This pompous asshat is self righteous, and holds himself above all authority given to LE officers by the public, and the constitution. Courts have reaffirmed the LE authority to use force to effect arrest on a non compliant subject.

The officers failed to properly articulate the authority they had to forceable make that arrest. THAT is why they lost the case. LEOs must explain why they used whatever force they use, and articulate the authority to arrest someone.

    In MY view, the LEOs gave the "pastor" a lawful order, he refused, and he was subjected to forceable arrest. You are arguing philosophy over legality here

  • @lbnmp86 I agree with you. Anderson was given far too much leeway before being arrested. Courts have backed LE officers in the use of force to subdue individuals they perceive to be a threat. Refusing to comply with a lawful order to exit the vehicle is a sign that someone will resist the arrest. Tasers are a beautiful thing. I love watching the taser make people comply. It takes the hubris out of peoples minds temporarily enough to effect arrest.

    Let me explain it again, the case was first dismissed with prejudice. Prosecution appealed the decision and the case went to a jury trial. The jury found the driver not guilty. I then provided three independent sources for confirmation. Your inability to understand the sequence of events does not alter the fact that it happened.

Federal law has been passed and signed into law by the United States Congress and the President. If you do not like that, then vote for someone else next time.     Not in this incident as that law enforcement personnel did not have probable cause that a crime had been or was being committed.

    If you actually read the law it, you would see that law enforcement does not need probable cause to break the window. The fact that the idiot didn't step out of the car gave them reason to suspect something was afoot. It is called officer safety, police have the right to order someone out of the car for safety reasons. Secondly, there was, IN FACT, probable cause, once the canine alerted. Lastly, Mr Anderson was not found "not guilty" the case was subsequently dismissed....

But as I previously stated, probable cause is not warranted in order for an officer to order someone out of their car. failing to do results in what happened to this moronic pastor....WWJD??? hmm my guess is that Jesus would have got out and preached to them instead of making himself look like an idiot. The courts decided that they had neither, so found for the driver and against law enforcement. The driver is now free to bring criminal charges against the law enforcement personnel who were breaking the law. Apparently, he is doing just that.

    Oh, and he wasn't trying to leave the country, he was miles away form the border.

    Thank you for seeing this for what it is since some people in here act like a bunch of programmed robots.   • Dude, I think you have many valid points about Obama, homosexuals ect, you can still make those points but try a more caring and loving approach, you are hindering your own ministry by being forceful. I do believe there is a time to be tough, but it isn't all the time Christ knew when to be tender and firm. You can be tender and still say what you have to say, trust me it will help your message.
