@samooia Listen I did not make the hate crime law. It is a new law passed that says if one incites another to commit a crime that is based on prejudice hate etc it can be prosecuted as hate crime. See my set of videos reading the text of that law and discussing it. This video I made in showing that it is inequally applied. Under the new hate crime legislation this guy should be prosecuted. I do not agree with much of that new bill. It wanders into constitutional violation.

I'll give you another example of hypocrisy; in reports about the murder of David Kao where they omit the detail that Cory Azor and Chris Levy are Black, people who claim to be Black say they are disgusted that racist Jews killed an Asian. When they see they are Black suddenly race had nothing to do with it and I'm racist for pointing out that they are Black. When they think Whites did it, it's racist. When they see Blacks did it, it's not racist.

It is GREAT to try to make laws to promote equality. Yet if a law makes new victims of inequality to try to MAKE UP for the past it is only repeating the past and actually causing more problems. In general, the law does not recognize speech alone, no matter how offensive, to itself constitute assault. The apprehension of violence must be immediate; meaning that it must lead a reasonable person to believe that serious bodily harm is about to be inflicted almost simultaneously to the conduct giving rise to the apprehension.

If someone calls on the phone and says they will kill you tomorrow, you can probably get a restraining order, but this will not itself constitute an assault.

But tying to the legislation, it doesn't seem to me that the Hate Crime Bill addresses this conduct.  This would be considered hate speech, but hate speech itself is not criminal. There are whacked out caucasian groups that have similar views about blacks or Jews, and they are Constitutionally permitted to speak out on these positions.

The conduct is only criminal if actual violence is carried out in furtherance of these positions.

See clip one where I read the defintion of crime of violence. The defintion is not in the bill you have to look it up separately. Seriously though if this guy had access to nukes he would use it. Thanks for the heads up. I looked up 18 USC 16 and found the language you were referring to. Note that by tagging on "or threatened use of force" in this context appears to be referring to common law assault, even though they do not use the word "assault."

One thing to note is that the new class of crimes addressed by the bill itself are self-contained in scope, and specifically require physical assault.

Well I would look at some criminal cases to see how the definiton has been used. Because seems you and I are interpreting the definition differently. Ultimately it is the judges who end up doing the interpretation. AND of course they will go to the intent of the legislation to determine how to interpret it...which is why alot of people are upset about the grey areas in the new bill, rightfully so.Have you read any cases how such definiton is used thus far in federal courts?

I did not see this language in 18 USC 16, but will grant that a general aiding-and-abetting clause is implicit in all crimes, whether stated or not.

Keep in mind, though, that this generally only applies when actual crimes are committed by a principle. Encouraging violence is not criminal unless it is knowingly and directly connected to the actual commission of an act of violence; e.g., spurring on a friend to attack someone right in front of you.

Here is the definition for CRIMES OF VIOLENCE per the quited law in the text 18 USC 16 (a) an offense that has an element the use, attempted use, or threatened use of physical force against the person or property of another or

(b) any OTHER offense that is a FELONY and that, by its nature, involves a subsatntial RISK that physical force against the person or properrty of another may be used in the course of committing the offense. SO in applying the defintion to the act of (see next comment)
