  • Fahad's Court Hearing Recap

    10.14.2008

October 14--Today's court appearance was a victory against many odds. The majority of it was held behind closed doors. Judge Preska, a Bush I appointee, continues to be unsympathetic to questions of Fahad's civil rights and the inhumane conditions of his confinement. And the court officers --looking at the crowd of more than 100 --announced that once the seats in the court room were taken, no one else would be let in.

  • And yet, the power of the people could not be squelched. When the doors were opened, people packed every available seat--and dozens more were turned away and waited in the hall. Fahad turned around and was able to watch the courtroom fill up-- his face lighting up as he recognized friends and saw new faces. He set eyes on his 2-year-old niece. He saw the crowd and beamed.

  • The court--and the government--also saw the crowd of more than 100. As did the reporters. The court set a motion schedule, and Fahad's lawyer Sean Maher once again raised objections to the draconian nature of the Special Administrative Measures that Fahad is being held under.

  • While the public portion of today's court appearance lasted less than ten minutes, we made a powerful statement. In a process filled with secrecy, we made the government look at us. In a process marked by isolation, we reminded Fahad that he does not go into that courtroom alone. In a process designed to make people fearful, we bore witness that solidarity is more powerful.
