In the context of this particular situation, two variables are clear. You can't trust everyone, even though you are surrounded by everyone at all times in public, and you can't trust the police, because as this instance clearly portrays, sometimes, they just go dumb. It's a good thing this person was able to maintain a charisma of order within himself, by having a displayed firearm. Otherwise, that bone-headed, thick character would've surely injured or hurt him. Laws like that vary by state. Do you live in NH? NH has no state law about the possession of a firearm in a school zone. Many other states do. I live in NH and carry a gun every day. According to NH state law(and many other states), he does not even NEED a permit to carry an UNconcealed gun, but only a concealed one. I'll say it again, regardless, there is NO permit which gives people the right to carry firearms(concealed or open) on school property or federal property- which is where he was. He was carrying on school property- which is why he got busted.
You are right. He does not need a permit to carry openly. But there is an exception to the federal gun free school zone act. If you have a permit to carry that includes a background check (which NH does), then the gun free zone does not apply to them. It does not matter is the permit is for open or concealed carry. There is another video of Will talking to a Portsmouth PD officer. They talk about what I just said.

In further videos, WK kept stating he has a permit to carry, but NH law does not require a permit to open carry- so either WK forgot he was open carrying or he just keeps repeating something that does not even apply in this situation to make it seem like his actions were legal.
Will had a permit to carry a concealed handgun- which:
#1 Does not apply since he was open carrying. Permit only applies to concealed.
#2 NH law states no permit is required to open carry.
#3 Even with a permit (including BG check), there are still places & situations which are excluded-NO MATTER THE PERMIT- such as on public school property- which he is plainly on initially.
It does not matter how he was carrying, all that matters is that he had a permit issued by the state that includes a background check. If he had truly broken the law, he would have been in handcuffs. The city has the right to ask anyone to leave school grounds. If you listened in the other video, the officer asks will to leave because city legal wanted him to, not because of the law.
It absolutely DOES matter how he was carrying (and where he was carrying)- that is the crux of the concealed vs. open carry laws. This is standard practice in every 'liberal' gun law state- you need a permit to carry concealed, but not to open carry. WTF!
The federal law says there is an exception for those who are properly licensed by the state, and have a background check. If you look at a NH carry permit, NOWHERE on it does it say "concealed". If fact, all it says is "Pistol/Revolver Licence". So YES I understand you do not need a permit to open carry. But EVEN when OPEN carrying, it meets the background check requirements for the federal law.
per RSA 159:4): (1) to carry a loaded handgun concealed upon the person, other than in your home or place of business (where you can do so without a license); and (2) to have a loaded handgun in a vehicle (whether the handgun is concealed or not). Again, a permit is required for concealed guns only, not open carry.

While the state police may know, I would rather look up the actual laws on the books in NH. This would be the true & accurate record of which permits are or are not required for carrying firearms in NH. While I respect the police- many times they are not current on civil right laws (including the right to keep & bear arms). And as a probable liberatarian, I would hope u do not blindly follow what the police state tells you.
@DRfronkensteen: if you want advice regarding gun laws, i encourage you to contact not police, but rather prosecutors, any DA in the state of NH or a state attorney's office regarding this matter. There is a reason why the judiciary interprets in laws in our country & we do not ask the police or 'police state' for legal advice. I would hope if any of us is ever arrested or charged with a crime, we do not contact prosecuting authorities for legal advice.
And I hesitate to advise contacting a DA or prosecuting attorneys as well, b/c they have a vested interest in putting ppl behind bars. Rather contact civil rights attorneys who specialize in gun laws & protection of individual rights. Yes, even your local chapter of the ACLU would probably direct you to good attorneys who specialize in this kinda law. But the very last ppl I would ask for advice would be the prosecuting authorities or police state of any type.

I am merely stating the law in NH, in states that allow concealed carry- a permit is typically required. Depending on the state, an open carry permit sometimes/often NOT required & i agree with that (but only for certain types of fire arms). For assault weapons, its another matter entirely- just my opinion though.
"(1) It shall be unlawful for any individual knowingly to possess a firearm at a place that the individual knows, or has reasonable cause to believe, is a school zone.
Exception: This does not include possession of a firearm on private property that is not part of school grounds or possession of a loaded firearm by an individual who is licensed to do so by the State. (i.e. a concealed carry, weapon, or firearm permit).
The exception you state does not allow any Jo-blow citizen that has a concealed carry permit or 'background check' permit to carry ANY federal property- including schools, post offices, etc. I never said that permit gives anyone that right, and indeed it does not. A permit allows you to carry on public property only, not federal property or private property (if the owner specifically excludes it).
Schools are not federal property, but the feds have the right to enforce federal law in specific situations- firearms on school property, enforcing desegregation in the 1950's- remember the national guard was called out to enforce federal law over state law. So in some specific situations, fed law trumps state law on school grounds- and one of these situations is non peace officers carrying (concealed or open).

Laws like that vary by state. Do you live in NH? NH has no state law about the possession of a firearm in a school zone. Many other states do. I live in NH and carry a gun every day. According to NH state law(and many other states), he does not even NEED a permit to carry an UNconcealed gun, but only a concealed one. I'll say it again, regardless, there is NO permit which gives people the right to carry firearms(concealed or open) on school property or federal property- which is where he was. He was carrying on school property- which is why he got busted.

You are right. He does not need a permit to carry openly. But there is an exception to the federal gun free school zone act. If you have a permit to carry that includes a background check (which NH does), then the gun free zone does not apply to them. It does not matter is the permit is for open or concealed carry. There is another video of Will talking to a Portsmouth PD officer. They talk about what I just said.

There is no permit in existence that allows private citizens to carry a gun on public school property- again, no matter their permit, no matter the background check. It does not exist. I have watched that vid & according to the police & the rational bystander- Kostic was violating the law, until he removed himself from public school property.

If he was violating that law, they would have charged him with possession of a firearm in a federal gun free zone. But the Portsmouth detective says he will charge will with trespassing. Will violated no laws here. The city wanted him to leave school grounds. Not because of the federal law. You are correct in the fact that the state permit will not allow you to carry in federal buildings, like federal courts and post offices.

Um, no, NH & city detectives are very lenient & typically gun-friendly & gave him a warning letting him know he was in violation & if he did not comply, he would have then been arrested. They did this as a courtesy, not because it was a favor to the city. According to the law, school buildings are considered federal buildings just like fed courts & post offices.

Officer says he doesn't know the law as to whether WK is allowed to open carry on school property, just that WK will be arrested if he does not leave. WK 'prettied' it up to make it seem like its what you said. In further videos, WK kept stating he has a permit to carry, but NH law does not require a permit to open carry- so either WK forgot he was open carrying or he just keeps repeating something that does not even apply in this situation to make it seem like his actions were legal.

Will had a permit to carry a concealed handgun- which:
#1 Does not apply since he was open carrying. Permit only applies to concealed.
#2 NH law states no permit is required to open carry.
#3 Even with a permit (including BG check), there are still places & situations which are excluded-NO MATTER THE PERMIT- such as on public school property- which he is plainly on initially.
#4 He initially violated the law.

It does not matter how he was carrying, all that matters is that he had a permit issued by the state that includes a background check. If he had truly broken the law, he would have been in handcuffs. The city has the right to ask anyone to leave school grounds. If you listened in the other video, the officer asks will to leave because city legal wanted him to, not because of the law.

The federal law says there is an exception for those who are properly licensed by the state, and have a background check. If you look at a NH carry permit, NOWHERE on it does it say "concealed". If fact, all it says is "Pistol/Revolver Licence". So YES I understand you do not need a permit to open carry. But EVEN when OPEN carrying, it meets the background check requirements for the federal law.

While the state police may know, I would rather look up the actual laws on the books in NH. This would be the true & accurate record of which permits are or are not required for carrying firearms in NH. While I respect the police- many times they are not current on civil right laws (including the right to keep & bear arms). And as a probable liberatarian, I would hope u do not blindly follow what the police state tells you.

@DRfronkensteen: if you want advice regarding gun laws, i encourage you to contact not police, but rather prosecutors, any DA in the state of NH or a state attorney's office regarding this matter. There is a reason why the judiciary interprets in laws in our country & we do not ask the police or 'police state' for legal advice. I would hope if any of us is ever arrested or charged with a crime, we do not contact prosecuting authorities for legal advice.

And I hesitate to advise contacting a DA or prosecuting attorneys as well, b/c they have a vested interest in putting ppl behind bars. Rather contact civil rights attorneys who specialize in gun laws & protection of individual rights. Yes, even your local chapter of the ACLU would probably direct you to good attorneys who specialize in this kinda law. But the very last ppl I would ask for advice would be the prosecuting authorities or police state of any type.

I am merely stating the law in NH, in states that allow concealed carry- a permit is typically required. Depending on the state, an open carry permit sometimes/often NOT required & i agree with that (but only for certain types of fire arms). For assault weapons, its another matter entirely- just my opinion though.

The exception you state does not allow any Jo-blow citizen that has a concealed carry permit or 'background check' permit to carry ANY federal property- including schools, post offices, etc. I never said that permit gives anyone that right, and indeed it does not. A permit allows you to carry on public property only, not federal property or private property (if the owner specifically excludes it).

Schools are not federal property, but the feds have the right to enforce federal law in specific situations- firearms on school property, enforcing desegregation in the 1950's- remember the national guard was called out to enforce federal law over state law. So in some specific situations, fed law trumps state law on school grounds- and one of these situations is non peace officers carrying (concealed or open).
