Because I'm big & strong, it's arguable that forcing my way out could've been considered assault. The main issue would be proving malice or motive. It's obvious that emotions are running high. Because I'm big & strong, it's arguable that forcing my way out could've been considered assault. The main issue would be proving malice or motive. It's obvious that emotions are running high. But I think a judge would have to determine if the force to make your way out is commensurate with your need to leave. Would you agree?

Our apartment was small; there was only 1 door. The problem is that I had a bad temper in those days myself. BUT, I learned to walk away when my anger was getting the best of me. She actually tried to force ME to stay & fight. IS pushing past her assault?
