I think that they are both gimmicks. Obama's gimmick is a bit more painful because we are going to be paying for our own energy credit because the oil companies aren't going to eat their new tax bill, they'll just pass it on.

First of all, I think that you are right. This seems like political gimmickery from both Obama and McCain. Most economists agreed that the proposed gas tax holiday would have had a small impact on fuel prices and that it would have been more like a subsidy for the oil industry than a "holiday" for consumers. And Obama's windfall-profits tax would likely cause fuel prices to go up because, as you allude to, the greedy oil executives aren't going to pay themselves less, just charge us more...

How would one lawfully implement such a plan?
