The only way we maintain our rights is to stand up for them. The cop's "obstructing my field investigation" was a load of garbage. The "acting suspiciously" is also a load of garbage. Both of his statements are designed specifically to get you to comply with his request. He has the right to ASK, but you have the right to refuse and there's nothing he can do about it.
This officer just exposed it himself that you should NEVER give your ID to the police even if you are doing nothing wrong. People often say, well if you aren't doing anything wrong or have anything to hide, then you shouldn't fear IDing yourself. However, this officer said himself that he wanted his ID to "idex his name". Now why would an officer index your name if you are doing nothing wrong? I think we all know that answer.
@1775novten By the way, by admitting that you were the registered owner of the car, you indirectly just gave him your name. So now you are indexed in their "shit list". Wouldn't be surprised if you started getting more traffic citations after this event.

@1775novten ya well I was on my way home from church and I usually avoid sewer caps or bumps anyhow apparently they thought I was drunk and followed me for a long time and I turned down diff streets to make sure they were following me and then that's when I approached pulled over and approached the fire truck to ask why they were following me then with the authority they don't have yelled at me to get back in my vehicle where I waited for the cops to give me a breath test in what not funny tho
@bleedingcry Odd, yeah I'm sure it wasn't funny at the time. And since when do firemen track down drunk drivers? Maybe they should stick to fighting fires.
@1775novten I should have ignored the firemen following me and went home opening my garage door and closing it and if the police came I wouldn't have to answer my door- that's what I should have done but as a polite citizen decided to wait for the cops and they thought it was funny too lol good stuff

As for the "You look suspicious" bit, it is a lie and a trick, try: "Can you tell me exactly what crime or crimes you have a reasonable, articulable suspicion we have committed or are about to commit?" See Terry v. Ohio. Also, make sure your doors are locked and DON'T roll your window down so far...remember, some of those cops have very little self-control and they want to hurt you for standing up to them. Stay safe.

The higher US Courts have ruled that when you are detained by police without a warrant you are still under arrest. What happened to you constitutes false arrest or being held against your will. Those two cops broke the law and you guys didn't know it. You need to be prepared with knowledge before you go out again. Get your states DMV Code and go through it page by page. Find out what cops can and can't do. It's in there. You must be armed with knowledge of the law.

The question is if there is an official complaint. With no official complaint there is no grounds for an official investigation therefore there is no obstruction of an official investigation. I'm no lawyer-maybe I should be. I helped my sister study up for her bar exam. Cops use legalese to shake your confidence and intimidate so you will submit to unlawful interrogation.
DC cops and the numerous agencies' representation in the NCR are no different.
For anybody who is interested in the way law enforcement conduct themselves in this situation, I highly recommend the FLETC handbook. You can get a PDF copy of it with a google search. Look at the section on the 4th Amendment.
A passenger has NO requirement to id themselves. The cop is stopping the car and thus the driver. The passenger can just sit there and do nothing. Tell the cop to take a hike if they wish. But the cop has no legal grounds for pushing the passenger to comply with his illegal demands.
@yoyo762 Look up the legal definition of 'passenger'. To paraphrase: A passenger is a 'person' whom has paid fare. A driver, to paraphrase again, is a 'person' participating in commerce. Read the motor vehicle act from your prov or state with a Black's Law dictionary handy to cross-reference all the lovely legalese. Careful choosing your words as they can be deceptive. stewart...youre a bit confused...putting the cart before the horse. The Terry frisk has nothing to do with defining probable cause or suspicion. The Terry firsk being what is allowed AFTER a cop has determined enough probable cause to detain, but not under arrest. The Terry frisk for weapons is for the safety (understandably) of the cop . If arrested then a search of the person is authorized and the suspect MIrandized.
Before you get into trouble, you really need to study the laws (1968 Terry v. Ohio, etc). Under such suspicious circumstances (two men parked in an empty parking lot near an incident scene at night), police do indeed have the authority to ask for identification & question your activities. It's called a "stop and frisk," which Supreme Court has repeatedly ruled in favor of. Probable cause or evidence of crime is not required. Failure to comply can result in arrest & conviction (obstruction).

Anytime a cop wants to detain someone, they will say you were "being suspicious".
This is the loophole in the law which gives them the right to question you further and harass you.
