Any store representative is capable, legally. If what you said was true, than any film maker would be allowed to make a movie in Wal-Mart.

Once confronted by any retailers LP officer about shoplifting and you resist they have a LEGAL right to take you down and hold you until police arrive. Ask any cop if that's true. Cops love retailers who prosecute. Places of business that are open to the public are STILL private property.

We aren't cops, we do have the right to detain a person that has shoplifted until the police arrive or they are released. I've never worked for Wal-Mart but LP is pretty universal across all retail companies. They can charge him with assault if he put his hands on any of them, same as anywhere else. She can't take the guys camera however.
You cannot charge someone with assault for not putting their hands behind their back, and a none peace officer cannot charge anyone with assault to begin with. They can only file a complaint. To be charged with assault you must either enflict great bodily harm: 1st degree assault; inflict substantial bodily harm with a weapon: 2nd degree assault; inflict substantial bodily harm: 3rd degree assault; physical assualt to a police officer, firefighter ect: Fourth degree assault
The only thing he could of been charged with is resisting arrest, but since the "security" people at walmart are not licensed peace officers they cannot charge anyone for anything. They can only present evidence and hope that the person is charged before a judge. Ultimately the judge makes the final decision. So assault charge wont happen. Unless he physically struck the walmart security.
And on top of that the security has to be careful how they detain someone because walmart can be liable for any injuries to the perp. Depending on the circumstances of course.

She can not take his camera. That is just silly. Legally she has the right to tell him to stop recording because he is on private property. That is what she should have told him. No one is going to take anyone seriously when they walk up to them stating that they have to turn over their camera and that it is no longer theirs.

Most supermarkets have a sign on the wall absolving themselves from responsabilty from ongoing`s in the car park i.e Theft and damage to cars etc.. But by doing that, They have given up the right to interfere in any usual goings on in the car park, You can tell her to fuck off if you want, They can`t do shit. It`s a bit like the pavement outside your house, You have a bylaw allowing access etc.., But the pavement belongs to the state.

Any store representative is capable, legally. If what you said was true, than any film maker would be allowed to make a movie in Wal-Mart.

@sirbuick Well, the cashier can't FORCE you to stop filming. Nobody can do that, even the manager. BUT, if the cashier or anyone could identify you, you can be sued for copyright infringments. You must get approval from Wal-Mart to film or photograph. That goes for ANY private property. Your house, the movie theatre, any private property. That is the law.

1) No one that works at Wal-Mart is licensed to detain anyone, unless they're an off-duty police officer.
2) She can't detain the camera, the police can. She has to be able to prove that the company has a no filming/photography policy.
3)The only loop-hole they have is if they have signs saying no filming/photography allowed. Another fact is she can't even detain the guy to try to get the camera.

Any civilian, in the state of Texas, can arrest for Felony or "disturbance of the Peace," such as tresspass, theft, etc. The only thing that lady could have done, would have been to boot the camera man from their property. Once confronted by any retailers LP officer about shoplifting and you resist they have a LEGAL right to take you down and hold you until police arrive. Ask any cop if that's true. Cops love retailers who prosecute. Places of business that are open to the public are STILL private property.

We aren't cops, we do have the right to detain a person that has shoplifted until the police arrive or they are released. I've never worked for Wal-Mart but LP is pretty universal across all retail companies. They can charge him with assault if he put his hands on any of them, same as anywhere else. She can't take the guys camera however.

You cannot charge someone with assault for not putting their hands behind their back, and a none peace officer cannot charge anyone with assault to begin with. They can only file a complaint. To be charged with assault you must either enflict great bodily harm: 1st degree assault; inflict substantial bodily harm with a weapon: 2nd degree assault; inflict substantial bodily harm: 3rd degree assault; physical assualt to a police officer, firefighter ect: Fourth degree assault

The only thing he could of been charged with is resisting arrest, but since the "security" people at walmart are not licensed peace officers they cannot charge anyone for anything. They can only present evidence and hope that the person is charged before a judge. Ultimately the judge makes the final decision. So assault charge wont happen. Unless he physically struck the walmart security.

If you resist, they can use force, I asked my LP officer the other day, just to make sure. He said YES you can use force if they resist, also if they resist even though he is LP you can still be charged with resisting. My LP officer approaches the suspect, introduces himself, asks to shake their hand and and asks them to follow the manager on duty toward the LP office. IF they resist he CAN LEGALLY TACKLE THEM. Also, just because it is private property they DEFINITELY can use force if youresist
