  • Hey, one of the passengers should have made the call. I hate it when sneaky smokers try to ruin things for people. If you must smoke stay home or get your own transportation. Why do you have to subject us to that cancer? I know it's an addiction but sheesh. When you have to hide in a toilet to do it don't you think it's time for step one?

  • Hello 'Grumpy Old Man'. I'm sure you are right - In my view coach drivers generally do a very good job but they will get the occasional idiot passenger. Everyone has to endure the odd idiot from time to time and like everyone else the drivers are free to get a different job if they don't like it...As for telling us to walk or buy a car (not a great advert for the bus industry?) people are free to use that thing called 'choice' and choose how they want.to travel.   • Cumbria Police are very good at reacting to minor offences like this. When a major incident breaks out, like Dereck Bird - they are useless!! In short - drive with a fog light on and they will have you - produce a gun and they will make excuses as to why they couldnt do anything. Cumbria Police should merge with Lancashire Police!

  • Well, as a coach driver myself, if he used a hands free device he would not have been braking the law. However in this situation, if he pulled the coach up, and then phoned the rozza's, it may cause more conflict, thus more endangering and being detrimental to the health safety, and welbeing of his other passengers. Maybe joe public ought to look into how they behave on transport in general.

    It only takes 1 badly disgarded fag on plastic or fabric, and you could have a disaster on your hands!

The driver could have stopped the bus and phoned the police; or the smoker could have apologised for smoking in the bus and promised not to do it again, and there the matter would have been resoved one way or the other. As it were, the Police got involved and worse still the driver could have caused a fatality while he was on the phone. Why can't we see sense sometimes???

  • The bus driver was taken to the police car where I believe he was cautioned, but he was then released and continued to drive the bus. The passenger who caused the driver to call the police by smoking in the toilets and then refusing to leave the bus, was given a lift to the nearest train station by the coppers. I don't know if the smoker was fined.

  • In retrospect, maybe Megabus has a systemic problem. I wonder if a cell phone was to blame when the driver peeled the second floor of their double decker off this morning, KILLING 4 PEOPLE!

  • @charlieiscool1000 Do you still feel the same way now you know this same police force did nothing to stop a gunman on a killing spree. Seems the are tough when it is an unarmed bus driver but just follow you if you are killing people. I think a crack head would have done a better job.

  • @djmetty206 I know some police shouldn't be police. But I also know that one at least one occassion, when I've phoned the police (Salford police direct, rather than 999 which would probs send Manchester police who would prob take hours), they turned up quickly

  • If a bus driver is required to use a mobile they are supposed to stop in a safe place, turn the engine off and leave the bus to make the call..... thats the law.... BUT.. most bus/coach companies policy is that once the driver leaves the cab then they have left the bus unattended which is a sackable offence, so us bus drivers are in a "catch 22" situation with this, but as some have said it doesnt show the bus moving whilst he is on the phone!!!

  • @12mozzofull I cannot remember why I said that - but I am pretty sure in an emergency you are allowed to use the phone whilst driving (ie someone is trying to get you, like the boogeyman :p).

    Oh I see why, the driver called the Police - depends on circumstances really, never know the drunk might have been abusive at the time the driver stopped and asked him to get off but wanted to drive on to calm said drunk down whilst he made the call etc (we never know this kind of things, misreported often)

  • For anyone supporting the driver: using a mobile whilst driving is at least as dangerous as smoking. If someone wants to complain about breaking the law, then it's just plain silly to be breaking the law at the time of making the report. The amount of times I've nearly been hit by drivers on their mobiles is ridiculous.

    A simple challenge really, show us on the video where you can see the driver driving and using a mobile at the same time??

    You can't because the video doesn't show that. It shows a non-moving bus with the driver being pulled of the bus by Police.

    So, please show us on the video where you see driving and using a mobile phone?

    I'm not good at maths but this video didn't last 30 minutes so i'm guessing this video was shot from the last 1.26 of the 30 minutes it took for the police to arrive.

  • If he wasn't driving, why would he be arrested? It's not illegal to use a mobile whilst stationary, except maybe at traffic lights or something

    It was the Bus driver who made the first call to the police regarding the drunk man. The bus driver would have had to stop somewhere in order to allow the police to meet at the same location.

    Therefore, when the police arrive on the scene the bus is not driving therefore as you stated no law was brocken. His arrest wouldn't go as far as the CPS because as I pointed out before the video does not show anyone driving and using a mobile.

  • i find it quite sad that the smoker couldnt wait for a fag, that the bus driver thought it was necessary to phone an emergency service for someone smoking in the toilet, that people think that smoking in the toilet is an "emergency" serious enough to justify the legal exemption they discuss and that the film-maker has tried to film the police in such a ridiculous incident. Do they film when old ladies get mugged in the street? er no. You tube should be full of naked chicks and not this toss!

  • who ever put this video on you tube need to get a life and to stop trying to get someone to loose there job just because he was protecting everyone else on board the coach. Its not always an easy job. The public on board the coach should respect the law and other people on the coach. Its simple dont smoke on public transport or drink alcohol and nothing like this will happen. this driver has not been sacked im glad to say he has been giving a warning instead this matter has now been resolved.

  • @pinkladymsn the driver should just have put the smoker oo the coachthere & then, i did so in the past when i worked for stagecoach, only that time it was a bunch of glue sniffers on a coach from aberdeen to london, they got on in arbroath started sniffing & got chucked off in dundee, the rules are the rules or in the case of the smoker the Law

  • @pinkladymsn - How could he lose his job if he wasn't doing anything wrong? Nobody says it's an easy job. What's more endangering to the passengers though? A drunk, smoking passenger, or a driver who's on the phone while driving? The common-sense approach would be to ask the passenger to stop. If they don't stop, then stop the bus and call the police. I'm glad he could keep his job. However, to pretend that he didn't do anything wrong would endanger passengers of this bus line.

  • @BayviewFinch Hey, it depends on the situation. If the drive is on a road and is paying attention but using the phone then he's just like the state troopers you see all the time using the phone. If the smoker causes someone to have an asthma attack or blows up the bus because someone's on oxygen then I'd say the smoker. I'm bias though lol.

  • The driver was completly in the right for using his phone whilst driving as stated in the mobile phone act 1999, mistermark2007 needs a life and i have also reported this incident to you tube and you need to remove this video immediatly.

  • the driver was right on what he did.if the guy in-deed was smoking in the toilet let's not forget that the toilet is a chemical toilet it woild not be the first time a coach has caught fire due to someone smoking on a coach and also the same law applies on a coach as smoking in a public place as the coach has a traffic class of p.s.v (public service vehicle) would we be so slow to praise the driver if the coach caught fire due to the guy smoking which could have put lives at risk driver was o.k

  • If he had thrown the cigarette butt down the toilet and and the chemicals had indeed ignighted, the driver would have about 1 minute at most to evacuate the vehicle before it would be almost destroyed.

  • Get your facts right he was interviewed as to why he had used a mobile phone whilst driving . He was taken to the police car to give a statement about the incident on the bus. The police have no interest in the charge as it is legal to use a mobile phone in an emergency . As to laws you have broken did you have permission from stagecoach to film on that bus? Did you have permission from the driver to film him? Did you know it is illegal to use a camera on a bus without permiss

  • Hi DICK92191. - What rights have I infringed exactly? and who's? As far as I am aware, the bloke smoking on the bus and the driver who used his phone whilst driving are the ones who were in the wrong., not me for simply reporting the facts.

    waynechain - are you doubting the evidence I am presenting? why dont you simply ask the driver if you know him or ask Cumbria Police for a copy of their report?
