Actually, not everyone uses the same instruments or the same language. Regardless, the similarities between these two songs runs to deep to be dismissed as coincidence. If it were as easy as you claim to inadvertently copy another hit song, there would be considerably less diversity in music.

Avril doesn't write her own material. The chorus is too close to be a coincidence. Probably, whoever wrote it for her wanted to keep their job and had nothing original to offer so they "borrowed". Avril the individual is probably innocent of intentional theft, but the song is still an example of plagiarism on teh part of her employees.

As for the rest: We're talking about a tremendously popular song from both the seventies and the nineties (cover). It's a very well known song even if the current teenage generation is unfamiliar with it. Do I think she needs to steal from this band? By her own admission, she does not write all her own material. Even the music is the same. Maybe Avril is honest about not intentionally ripping this band off because she was doing something closer to Lush's cover of the Rubinoos' song. The only difference is that I'm pretty sure--at least I hope so--that Lush mentioned in the album's credits that it was a cover.
