  • This will sound cold but it is the truth, with as many people as have used the patch 50 is a small number. I agree the system is broken and corrupt, and yet deaths from properly taken drugs are not (yet) what kills most people. Herbal pills are not regulated, people accept the RISK, miss labeling is unacceptable. Once you say our product (defined as x) can result in y you can not sue x for y

  • Absolutely small... but the fact is also that J&J knowingly mislead the public in terms of how much estrogen the patch released. To claim a pre-exempt status based on FDA approval seems a bit far reaching.

  • Unfortunately, we have a precedence here that makes it really hard to sue the government.

  • You are forgetting 1 major factor in the logic there. Over the years the materials thay use do change. It could very well be that way back then they were teling the truth, but somewhere along the line they needed to find a different supplier for chemical X and that changed the whole formula without anyone knowing it.

    Being self employed I have had, on more then one time, had to find a new supplier because the one I was using doesn't make what I need anymore or went out of business.

  • In the this case, the data from J&J shows they knew it provided more estrogen than the advertised 20micrograms. But as I said, if something unforeseen happened, and they acted in good faith and quickly, then that would be responsible behavior.

  • Interesting. Pharmaceutical companies in the US seem so powerful. I think people should stop taking so many medications.

  • Pretty interesting. I'd day I'd be ok with pre-exemption but if the company is found to be lieing or mistaken then people shoudl be allowed to sue. Of course then we're trusting the FDA with out health even more than now. Might work out ok that way but they shouldn't get a free pass if their marketing material is a lie or just a mistake.

  • It is so broken and corrupt it is down right scary.

  • I wish there was a website that compared the reports submitted by drug companies with what we find out later to be the truth. We could then have a report card and vote with our dollars. If I have to choose between taking two drugs I want to send my business to the company that has a history of being honest with the FDA and the public.

  • The Ortho-Evra patch is no different than the birth control pill at least in terms of effects. The birth control pill has all those risks as well especially if you smoke and/or are over 35.

    I don't agree any drug company should have this exemption at all especially when the FDA is not doing a good job.

  • Absolutely.... Ortho-Evra is a bit different in that it nearly doubled the posted dosage.
